We explain the types of decisions and how to appeal.

Types of decisions

The decision may be one or a combination of the following orders.

Imposed

If the hearing officer finds that the City followed all laws and rules, the fee or fine may be imposed. This means you must pay it.

Due date

  • Citation payments are usually due within 30 days of the hearing. The administrative hearing officer will tell you if you have a different due date.
  • Assessment payments are due by the end of the levy year. 

Reduced

The administrative hearing officer can impose a reduced amount.

Stayed

The administrative hearing officer may impose a fee or fine but stay some or all of the amount.

  • This means that under certain conditions, you would not need to pay some or all of the fee or fine.
  • Note that you must meet all conditions of the stay, or you have to pay the stayed amount.
  • For example, the hearing officer could impose a $250 citation, but stay $150 on the condition the work is completed within 30 days of the hearing. If you complete the work within 30 days of the hearing, you would only owe $100.

Dismissed

The administrative hearing officer may dismiss the issue. This means that the City failed to meet the burden of proof, and you do not need to make a payment.

How to appeal

If you disagree with a decision, you can appeal it to a higher court. Due dates and timelines are important in the filing process.

Administrative citations

You can appeal decisions from administrative citation hearings to the Minnesota Court of Appeals. Contact the court quickly to meet the filing due date.

Special assessments

You can appeal decisions from special assessment hearings in Hennepin County District Court. The notice of intent to assess letter includes important filing dates and timelines.

  • At the end of each levy year, the Minneapolis City Council votes to certify the year's assessments. In 2026, the City Council will certify the levy on November 12.
  • Within 30 days of that date, a notice of appeal must be served upon the Mayor or City Clerk of Minneapolis.
  • Within 10 days of serving notice upon the City, you must file a second notice with the Court Administrator of the District Court.
