Background

Council Member Chavez introduced a zoning code change to allow safe outdoor parking. This change would support people who are experiencing homelessness and living in their vehicles.

The amendment would allow safe, managed parking lots where people can sleep in their cars overnight. These sites would be legal and regulated. They would help people avoid tickets, towing, or being forced to move. Other City ordinances will need to be amended to allow the use as well.

The idea is based on programs already working in Duluth, Minnesota, and Denver, Colorado.

Safe Outdoor Parking is meant to:

  • Help people stay safe
  • Reduce stress and trauma
  • Provide a better option than sleeping on the street
  • Connect people to services and support
  • Support the City’s racial equity and public health goals

What the amendment does 

The amendment proposes to add Safe Outdoor Parking as a temporary use in the zoning code.

Safe Outdoor Parking sites would:

  • Allow people to sleep in their vehicles overnight
  • Be located in existing off street parking lots
  • Be managed and staffed at all times
  • Follow clear rules for safety and operations 

The draft code includes rules for:

  • Where sites can be located
  • Site operations and security
  • Meeting other City code sections 

Each site would need:

  • An interim use permit
  • A business license from the City 

The interim use permit limits the use to up to five years. It also requires a public hearing so nearby residents and businesses can share feedback.

Goals of the amendment

The goal of this amendment is to create safer, short-term options for people who are experiencing homelessness and living in vehicles.

The amendment helps:

  • Reduce harm and fear for unhoused residents
  • Offer a safer choice than sleeping on the street
  • Address racial inequities in homelessness
  • Improve access to outreach and services
