Encroachment and right-of-entry permits

You need a permit to use any part of a city street or sidewalk for private structures.

When you need an encroachment permit

You need an encroachment permit to build or place something that projects out onto, under, or over a street, sidewalk or alley.

This includes objects and structures such as:

  • Public parklets
  • Signs and marquees
  • Canopies and awnings
  • Bay and oriel windows
  • Balconies, steps and stairs
  • Eaves, gutters and cornices

Note: You must obtain all required encroachment permits before obtaining building permits.

Step one

  • Pay your application fee.

The City will review your application. If approved, we will send you:

  • Return the completed forms to us.
  • Once you return both forms, the City will issue your permit.

Groups who may review the request

In some cases, multiple groups may need to review your application. For example:

  • Community Planning & Economic Development - Planning and Zoning
  • Regulatory Services Department
  • Minneapolis Park Board 
  • Public Works divisions

Leased properties

We may require a letter from the fee owner of the property for:

  • Leased property, or
  • Property being purchased by a Contract for Deed

When the City may remove an encroachment

The permit allows you to use a part of the public right-of-way (ROW).

The City can take back this permission for public purposes at any time. For example, due to public safety concerns.

Acceptance form

If we approve your application, we'll send you an acceptance form.

In the form, the property owner must agree to the terms that the City sets for the permit.

Insurance and liability coverage forms

If we approve your application, we'll send you an insurance form.

The property owner's insurance must:

  1. Complete the insurance endorsement form.
  2. Complete a certificate of liability coverage form.*

Return the completed forms to us.

*The City must be additional insured

The insurance must name the City of Minneapolis as an additional insured party. Use the mailing address listed in the application as the additional insured address.

Temporary use of City-owned land

When you need a right-of-entry permit

The City requires a Right of Entry Permit to temporarily use City-owned land.
