Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

2.   Land Sale – 714 30th Ave N (Staff: Jim Voll)

Review for consistency with the Comprehensive Plan the sale of 714 30th Ave N for the construction of a single family home or combination with the adjacent church parcels.

1. 2635 4th St SE (Vac-1617, Ward: 2), 2635 4th St SE (Kimberly Holien).

Staff report

A. Vacation: Application by Fountain Residential Partners to vacate drainage and utility easements on the property at 2635 4th St SE, in the R6, Multiple-family district and the ILOD, Industrial Living, UA, University Area and PO, Pedestrian Oriented overlay districts.

Recommended Motion: The Community Planning and Economic Development Department recommends that the City Planning Commission and the City Council adopt the findings and approve the vacation of the drainage and utility easements.

2. 3128-38 Snelling Ave (BZZ-5969, Ward: 9), 3128-38 Snelling Ave (Aly Pennucci).

Staff report

A. Conditional Use Permit: Application by James Ries of Buell Consulting, on behalf of Verizon Wireless, for a conditional use permit to establish a wireless telecommunication tower at 3128-38 Snelling Ave, in the I2 Medium Industrial District and PO Pedestrian Oriented Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the conditional use permit for the construction and maintenance of a 100-foot telecommunications tower for the property located at 3128-38 Snelling Ave, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. CPED Planning staff review and approval of the final site and landscaping plans.

3. Cox Residence (BZZ-5970, Ward: 13), 75 Forest Dale Rd (Janelle Widmeier).

Staff report

A. Conditional Use Permit: Application by Jim Scott with Quartersawn, on behalf of Heather Cox, for a conditional use permit to construct a structure using an alternative elevation method (vehicle parking below elevating living space above) in the Floodplain Overlay District to allow an addition to an existing single-family dwelling located at the property of 75 Forest Dale Rd.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the conditional use permit to construct a structure using an alternative elevation method (vehicle parking below elevating living space above) in the Floodplain Overlay District to allow an addition to an existing single-family dwelling located at the property of 75 Forest Dale Road, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. As required by section 551.640 of the zoning code, the structure's design and as-built condition shall be certified by a registered professional engineer or architect as being in compliance with the general design standards of the State Building Code.

4. The Blake School, Center for Science, Design and Research (BZZ-5984, Ward: 7), 411 Kenwood Parkway and 1600 Emerson Ave S (Aaron Hanauer).

Staff report

A. Conditional Use Permit: Application by James Dayton, on behalf of The Blake School, for a conditional use permit to allow for a school expansion in the R2/Two Family District at 411 Kenwood Parkway and 1600 Emerson Ave S. 

Recommended Motion: The Community Planning and Economic Development Department recommends that the City Planning Commission adopt the findings and approve the conditional use permit to allow an addition to an existing K-12 school for the property at 411 Kenwood Parkway and 1600 Emerson Ave S, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. Approval of the final site, landscaping and refuse storage enclosure plans by the Department of Community Planning and Economic Development.
  3. All site improvements shall be completed by April 22, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  4. The parking and loading areas along Kenwood Parkway shall have landscaping and screening consisting of either a masonry wall, fence, berm or hedge or combination thereof that forms a screen three (3) feet in height and not less than sixty percent opaque.
  5. The construction of the new addition shall meet the shoreland overlay development standards outlined in section 551.500.
  6. New mechanical equipment shall be screened in compliance with Section 535.70.

B. Variance: Application by James Dayton, on behalf of The Blake School, for a variance to increase the maximum floor area ratio to 0.69 at 411 Kenwood Parkway and 1600 Emerson Ave S. A previous variance was granted to increase the maximum floor area ratio from 0.50 to 0.64. 

Recommended Motion: The Community Planning and Economic Development Department recommends that the City Planning Commission adopt the findings and approve the application for a variance to increase the maximum floor area ratio from 0.681 to 0.683 for the properties at 411 Kenwood Parkway and 1600 Emerson Ave S.

5. 1400 12th Ave NE (BZZ-5993, Ward: 1), 1400 12th Ave NE (Aly Pennucci).

Staff report

A. Nonconforming Use Change: Application by Tricia Khutoretsky of Public Functionary for a change of nonconforming use from an art studio to an art studio and art gallery at 1400 12th Ave NE, in the R2B Two-family Residence District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the change of nonconforming use from an art studio to an art gallery in the R2B, Two-family Residence District for the property at 1400 12th Ave NE, subject to the following condition:

  1. A minimum of four (4) bicycle parking spaces shall be provided to the south of the building, outside of all required yards.

6. 115 5th St NE (BZZ-5974, Ward: 3), 115 5th St NE (Hilary Dvorak).

Site plan

A. Variance: Application by Greg Ottum with Master Properties MN, LLC, on behalf of DRS Investments, LLC, for a variance to reduce the off-street parking requirement from 22 spaces to 13 spaces for the property located at 115 5th St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the variance application to reduce the off-street parking requirement from 22 spaces to 13 spaces for the property located at 115 5th St NE subject to the following conditions:

  1. A minimum of one bicycle parking space shall be provided per dwelling unit.
  2. A minimum of four bicycle parking spaces for guests shall be provided in the right-of-way along 5th St NE.

B. Variance: Application by Greg Ottum with Master Properties MN, LLC, on behalf of DRS Investments, LLC, for a variance of the surfacing requirements to not pave the driveway leading to the off-street parking area for the property located at 115 5th St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and deny the variance of the surfacing requirements to not pave the driveway leading to the off-street parking area for the property located at 115 5th St NE.

C. Variance: Application by Greg Ottum with Master Properties MN, LLC, on behalf of DRS Investments, LLC, for a variance to reduce the minimum lot area requirement by 28 percent (from 700 square feet per dwelling unit to 506 square feet per dwelling unit) for the property located at 115 5th St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the variance application to reduce the minimum lot area requirement by 28 percent (from 700 square feet per dwelling unit to 506 square feet per dwelling unit) for the property located at 115 5th St NE.

D. Site Plan Review: Application by Greg Ottum with Master Properties MN, LLC, on behalf of DRS Investments, LLC, for a site plan review to convert an existing building into 22 dwelling units for the property located at 115 5th St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to convert an existing building into 22 dwelling units located at 115 5th St NE subject to the following conditions:

  1. Approval of the final site, landscaping, elevation and lighting plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by April 22, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The glass in the sidelight next to the new entry door on the front of the building shall be clear.
  4. The glass block windows on the back of the building shall be clear glass.
  5. The glass in the sidelight to the left of the entry door on the back of the building shall be clear.
  6. Plant materials that will grow to a height of six feet and be at least 95 percent opaque shall be planted between the northwesterly property line and the parking lot.
  7. The refuse and recycling containers shall be enclosed on all four sides by screening compatible with the principal structure not less than two feet higher than the refuse container or shall be otherwise effectively screened from the street, adjacent residential uses located in a residence or office residence district and adjacent permitted or conditional residential uses as required by section 535.80 of the zoning code
  8. All lighting shall comply with Chapter 535, Regulations of General Applicability and Chapter 541, Off-Street Parking and Loading.

Amending Chapter 525 related to Zoning Code: Administration and Enforcement

Amending Chapter 535 related to Zoning Code: Regulations of General Applicability

Amending Chapter 536 related to Zoning Code: Specific Development Standards

Amending Chapter 543 related to Zoning Code: On-Premise signs

The purpose of the amendment is to define exhibition or temporary markets (e.g. flea markets) and allow this use as a temporary use with specific development standards.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the zoning code text amendment, amending chapters 530, 525, 535, 536 and 543. Staff further recommends that Chapters 537, 541, 546, 547, 548, 549, 550 and 551 be returned to the author.
