Public Hearings

1. Moratorium Waiver (1805 East Lake Street):

Waiver request filed by Hamoudi Sabri on behalf of Lake Cedar, LLC, from the moratorium on the establishment, reestablishment, or expansion of principal parking facilities in the area bound by Chicago Avenue on the west, the Midtown Greenway/Hennepin County Regional Railroad Authority right-of-way to the north, 31st Street E to the south, and Hiawatha Avenue to the east, in order to file the needed land use applications to construct a new principal parking facility on the property (Ward 9).

Action Taken: Waiver denied

2. 2908 16th Avenue South:

Appeal filed by Joseph Spangler from the decision of the Zoning Board of Adjustment, notwithstanding the recommendation of staff, granting an application for a nonconforming use certificate to establish legal nonconforming rights to a seven unit multiple family dwelling in the R2B district (Ward 9).

Action Taken: Appeal granted

3. Green & DeLaittre Company Wholesale Warehouse Building (500 North 3rd Street):

Appeal filed by Michael Norton, on behalf of 500 LLC, from the decision of the Heritage Preservation Commission denying a Certificate of Appropriateness application for a rehabilitation and new construction project (Ward 7).

Action Taken at Z&P 7/9/2009: Continued One Cycle to 7/23/2009

Action Taken: Appeal denied

4. HERC (419 5th Street N, aka 505 6th Avenue N):

Appeal filed by Covanta Energy, on behalf of Hennepin County Environmental Services, from the decision of the City Planning Commission, notwithstanding the recommendation of staff, denying application for an amended conditional use permit for the Hennepin Energy Recovery Center to allow for the facility to process at its designed capacity of 1,212 tons of waste per day (Ward 5).

Action Taken: Continued One Cycle Until 8/6/2009

5. Stone Arch Phase II (600 Main Street SE):

Appeal filed by Call Your Bluff Development, LLC, and Bluff Street Development, LLC, from the decision of the Planning Commission denying applications for a) a conditional use permit for 79 dwelling units, b) a conditional use permit to increase the height to 6 stories or 70 feet from 4 stories or 56 feet in the I2 Industrial Overlay District, c) a variance to reduce the minimum lot area per dwelling unit by 30 percent, and d) a site plan review application, all to allow for a 79 unit residential building (Ward 3).

Action Taken at Z&P 7/9/2009: Continued One Cycle to 7/23/2009

Action Taken: Sent Forward Without Recommendation

6. Karmel Village (2848 Pleasant Ave & 2825 Grand Ave S):

Appeal filed by Leo Whitebird from the decision of the City Planning Commission granting an application for a conditional use permit and site plan review to increase the size of the building addition for the development at the subject property previously approved by the City council in March of 2008 by approximately 26,000 feet. (Ward 6).

Action Taken: Appeal Granted

7. Aeon (714 & 718 E 17th Street):

Approve petition to rezone the property from R6 to the OR2 High Density Office Residence District, while retaining the DP Downtown Parking Overlay District, to allow for a 19 space surface parking lot (Ward 7).

Action Taken: Approved

8. Housing for the Elderly (Zoning Code Text Amendment):

Subject matter of ordinances amending Title 20 of the Minneapolis Code of Ordinances relating to Zoning Code, for first reading and referral to the Zoning & Planning Committee (to more clearly distinguish housing for the elderly from supportive housing), as follows:
a. Chapter 520 relating to Introductory Provisions; and

b. Chapter 536 relating to Specific Development Standards.

Recommended Action/Action Taken: Referred to CPED/Planning Division

9. Reception or Meeting Halls (Zoning Code Text Amendment):

Subject matter of ordinances amending Title 20 of the Minneapolis Code of Ordinances relating to Zoning Code, for first reading and referral to the Zoning & Planning Committee (to amend regulations related to reception or meeting halls), as follows:
a. Chapter 520 relating to Introductory Provisions;

b. Chapter 536 relating to Specific Development Standards;

c. Chapter 537 relating to Accessory Uses;

d. Chapter 548 relating to Commercial Districts; and

e. Chapter 551 relating to Overlay Districts.

Recommended Action/Action Taken: Referred to CPED/Planning Division
