1. 5912 Girard Avenue South (BZZ-4141, Ward 13) :
Dan Radunz has filed an appeal of the Zoning Administrator’s decision that the proposed structure
- exceeds the maximum height regulation, and
- the front elevation does not comply with the minimum 15% window requirement
for a dwelling at 5912 Girard Avenue South in the R1 Single Family Residential District.
CPED Department Planning Division Recommendation by Mr. Clarksen:
Mr. Ditzler moved and Mr. Perry seconded the motion to adopt staff recommendation and deny the appeal of the decision of the Zoning Administrator that the proposed structure at 5912 Girard Avenue South 1) exceeds the maximum height regulation resulting in a 3 story dwelling, and 2) the front elevation does not comply with the minimum 15% window requirement for a proposed single family home at 5912 Girard Avenue South in the R1 Single Family Residential District.

That motion failed.
Notwithstanding staff recommendation, Mr. Finalyson moved to grant the applicants request and approve the appeal of the decision of the Zoning Administrator that the proposed structure at 5912 Girard Avenue South 1) exceeds the maximum height regulation resulting in a 3 story dwelling, and 2) the front elevation does not comply with the minimum 15% window requirement for a proposed single family home at 5912 Girard Avenue South in the R1 Single Family Residential District.
There was no second to that motion and no vote.
This item will be continued to the November 20th Board of Adjustment meeting.

Dan Radunz has filed an appeal of the Zoning Administrator’s decision that the proposed structure
Scot Pekarek has applied for a certificate of nonconforming use to legally establish a two family dwelling at 1117 Spring Street Northeast in the R1A Single Family District.

Mr. Finlayson moved and Ms. Lasky seconded the motion to uphold staff recommendation and approve the Certificate of Nonconforming Use to legally establish a two-family dwelling at 1117 Spring Street NE in the R1A Single-Family District.

Nate Morris, on behalf of Laurence Reardon, has filed an appeal of the Zoning Administrator’s decision that the existing structure at 2609 Fremont Avenue South is not a lawfully established 16 unit multiple family dwelling.

4. 4839 Bryant Avenue South (BZZ-4227, Ward 13) :
Dan Radunz has filed an appeal of the Zoning Administrator’s decision that the proposed structure
Carolyn Moore has filed an appeal of the decision of the Zoning Administrator that property at 4839 Bryant Avenue South is in violation of the Minneapolis Zoning Ordinances Chapter 546 Table 1, as it has been determined by the Zoning Administrator that the current use of the property is substantially similar to a hotel/motel or bed and breakfast, which is prohibited in the R1 zoning district and not a single family dwelling as the appellant asserts.

This item was recommended for continuance by the Zoning Administrator. Mr. Ditzler moved and Mr. Perry seconded the motion to continue one cycle to the November 20th Board of Adjustment meeting. The motion passed unanimously.
5. 4323 Dupont Avenue South (BZZ-4204, Ward 13) :
Dan Radunz has filed an appeal of the Zoning Administrator’s decision that the proposed structure
Jane Hallas has applied for a variance to increase the height of a fence in the interior side yard from 6 feet to 8 feet at 4323 Dupont Avenue South in the R1A, Single-Family District and SH, Shoreland Overlay District.
CPED Department Planning Division Recommendation by Mr. Hanauer:
Mr. Perry moved and Mr. Finlayson seconded the motion to uphold staff recommendation and deny the variance to increase the height of the fence at 4323 Dupont Avenue South in the R1A/Single-Family District and SH/Shoreland Overlay District.
