Joshua Timming has applied for a variance to reduce the established front yard setback along 54th Street West on a reverse corner lot from 36 ft. to 14 ft. to allow an existing deck partially covered by a pergola at 5401 Xerxes Avenue South in the R1A Single-Family District and SH Shoreland Overlay District.

CPED Department Planning Division Recommendation by Ms. Pennucci:

Mr. Perry moved and Mr. Ditzler seconded the motion to adopt staff recommendation and approve the variance on the consent agenda to reduce the required front yard setback along 54th Street West from 36 ft. to 14 ft. to allow for an existing deck to the rear of a single-family dwelling on a reverse corner lot subject to the following conditions:

1. CPED– Planning Division review and approve the final site plan, floor plans, and elevation.

Mr. Perry moved and Mr. Ditzler seconded the motion to adopt staff recommendation and approve the variance on the consent agenda to reduce the front yard setback from the setback established by the two adjacent residential structures to 11 ft. to allow for an 8 ft. deep front porch at 5021 Girard Avenue South, subject to the following conditions:

1. The porch match materials and color of existing principal structure, and

Nancy Davis-Ortiz has applied for the following variances to allow for a detached garage on a through lot:

• A variance to reduce the front yard setback along Brighton Avenue Northeast from 20 ft. to 1 ft.,

• A variance to reduce the required south interior side yard from 5 ft. to 1 ft., and

• A variance to allow for a detached garage to be less than 6 ft. from the primary residential structure

1. That the detached garage is a measures 20 ft. by 20 ft. and is a minimum of 3 ft. from the rear deck attached to the house,

2. That the boulevard trees are not disturbed or removed by the detached garage or curb cut,

• allow a detached garage to be located 3 ft. from the primary residential structure

at 2732 Kenilworth Place in the R1A Single-family Residence District and SH Shoreland Overlay District, subject to the following conditions:

1. The east elevation of the detached garage shall have additional fenestration or landscaping along the property line,

2. Final site, elevation, and floor plans are approved by CPED-Planning staff.

Cheryl Burrington has applied for a front yard setback variance from the setback established by the two adjacent residential structures to 10 ft. to allow for a tuck under attached garage and deck at 3547 Dupont Avenue North in the R1A Single-Family Residential District.

CPED Department Planning Division Recommendation by Ms. McCartney:

Notwithstanding staff recommendation, Mr. Manning moved to grant the variances as requested by the applicant with the following findings:

• There are no reasonable design alternatives in the back yard.

• The house was designed to have a front yard garage.

• The massing is not going to be greatly increased.

• There is a hardship created by the type of driveway.

• Granting of the variances would create a safer and more appealing home.

Ms Lasky seconded the motion to approve the following variances:

1. A variance to reduce the front yard setback from the setback established by the two adjacent residential structures to 10 ft., and

2. A variance to reduce the side yard setback from 5 ft. to 3 ft.

to allow for a tuck under attached garage and deck at 3547 Dupont Avenue North in the R1A Single-family Residence District.

at a three-story commercial building at 720 Washington Avenue Southeast, subject to the following conditions,

1. Final sign plans are review by CPED-Planning staff.
