APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. 1.       2019 Zoning Board of Adjustment Calendar

Recommended motion: Approve the 2019 BOA calendar.

1.       2512 21st St W, Ward 7

This item was continued from the October 25 and November 8, 2018 meetings.

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the application by Aron Lipkin.

A.      Variance to reduce the front yard setback.

Recommended Motion: Deny the variance to reduce the front yard setback from 20 feet to 4 feet.

B.      Variance to the width and location restrictions on attached garages. 

Recommended Motion: Deny the variance to increase the maximum width of a front-facing garage from 60% to 79% and to increase the maximum projection from five feet to 10.5 feet.

2.       1817 Emerson Ave N, Ward 5

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the application by Dan Frolek.

A.      Zoning Administrator Appeal.

Recommended Motion: Deny the appeal of the decision of the zoning administrator’s decision that the legal use of the property is one (1) dwelling unit and five (5) rooming units.

3.       323 41st St E, Ward 8

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the application by Ken Thompson.

A.      Variance to the front yard setback.

Recommended Motion: Approve the application to reduce the setback to 26 feet for a new single-family dwelling, subject to the following conditions:

1.       Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by December 13, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

B.      Variance to the reverse corner front yard setback.

Recommended Motion: Approve the application to reduce the setback to 12.5 feet for a new single-family dwelling, subject to the following conditions:

1.       Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by December 13, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

4.       720 Minnehaha Pkwy E, Ward 11

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the application by Eric and Tanya Fox.

A.      Variance to decrease the front yard setback.

Recommended motion: Continue the variance to reduce the reverse corner front yard setback adjacent to Columbus Avenue to the January 10, 2019 meeting of the Zoning Board of Adjustment.

B.      Variance to decrease the front yard setback.

Recommended motion: Continue the variance to reduce the interior side yard setback to the January 10, 2019 meeting of the Zoning Board of Adjustment.

5.       5048 28th Ave S, Ward 11

A.      Variance.

Recommended Motion: Approve the variance to reduce the corner side yard setback from eight feet to five feet for a single-family dwelling, subject to the following conditions:

1.       Approval of the final site, elevation, and floor plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by December 13, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.

6.       4020 Washburn Ave S, Ward 13

A.      Variance.

Recommended Motion: Approve the variance to reduce the front yard setback from twenty-five (25) feet to twenty (20) feet, subject to the following conditions:

1.       Approval of administrative site plan review application and final site and construction plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by December 13, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

7.       4741 Drew Ave S, Ward 13

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the application by Thomas and Roberta Maki.

A.      Variance.

Recommended Motion: Approve the application to allow for a rear addition to the existing single-family dwelling, subject to the following conditions:

1.       Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by December 13, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

3.       The applicant shall implement the erosion control measures prior to construction and said measures shall be maintained and retained until construction is completed.

8.       318 4th St NE, Ward 3

A.      Variance.

1.       Approval of the final site, elevation, and floor plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by December 13, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.
