1.  401 7th Ave SE (BZZ #6353, Ward 3) (Shanna Sether)
Continued from the December 12, 2013 Board of Adjustment meeting.
Variance: Jaret Giesbrecht has applied for a variance to reduce the front yard setback along 4th St SE from approximately 32 feet 5 inches to approximately 14 feet to allow for air conditioning equipment accessory to an existing two-family dwelling located on a reverse corner lot at 401 7th Ave SE in the R2B Two-Family District and UA University Area Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the front yard setback along 4th Street SE from approximately 32 feet 5 inches to approximately 14 feet to allow for air conditioning equipment accessory to an existing two-family dwelling located on a reverse corner lot at 401 7th Avenue SE in the R2B Two-Family District and UA University Area Overlay District, subject to the following conditions of approval:
  1. Approval of the final site plan by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 1, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The air conditioning equipment shall be screened from view from the public street.

A. Variance: Ann Rauvola and Jayant Saraph have applied for a variance to reduce the established front yard setback along Orlin Ave SE from approximately 29 feet 6 inches to approximately 11 feet to allow for the new attached garage and roof-top deck for the property located at 58 Orlin Ave SE in the R1A Single-Family District and UA University Area Overlay District.
     
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the established front yard setback along Orlin Avenue SE from approximately 29 feet 6 inches to approximately 11 feet to allow for the new attached garage and roof-top deck accessory to an existing single-family dwelling located at 58 Orlin Avenue SE in the R1A Single-Family District and UA University Area Overlay District, subject to the following conditions of approval:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by January 9, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The exterior materials of the proposed garage shall complement the existing dwelling.

  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.

  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by January 9, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Action: The Board of Adjustment adopted the findings and approved a variance to allow for development, including the construction of a single-family dwelling, on or within 40 feet of the top of a steep slope for the property located at 1918 Cedar Lake Parkway in the R1 Single Family District and SH Shoreland Overlay District subject to the following condition of approval:
  1. The applicant shall apply to obtain necessary approvals for administrative site plan review.
  2. The Applicant shall provide a soil erosion control plan with the site plan review application.
  3. CPED staff review and approve the final site plan, building plans, and elevations. 
  4. All site improvements shall be completed by January 9, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

A. Variance:Maurice Jamaledin has applied for a variance to reduce the required front yard setback on a reverse corner lot along West 38th Street from the established front yard to 9 feet for the property located at 3801 Pillsbury Ave in the R1A/Single Family District.
Action: The Board of Adjustment adopted the findings and approved the variance to reduce the required front setback on a reverse corner lot along West 38th Street from the established front yard to 9.30 feet to allow a new single-family dwelling at 3801 Pillsbury Avenue in the R1A/Single Family District subject to the following conditions:
  1. Final site and elevation plans must be approved by CPED staff.
  2. Reduce the width of the proposed stairway in the required front yard to no more than 6 feet.

Action: The Board of Adjustment adopted the findings and approved the variance to construct a detached garage within five feet of a rear lot line that coincides with the west side lot line of a property in a residence district, at 3801 Pillsbury Avenue in the R1A/Single Family District subject to the following conditions:
  1. Final site and elevation plans must be approved by CPED staff.
  2. Reduce the height of the proposed garage to 12’ maximum or demonstrate approval of an application for an Administrative Review of Accessory Structures to Increase Height or Floor Area. 
  3. Widen the existing curb cut to match the width of the proposed driveway.

Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the required front yard setback along 32nd Street West from 15 feet to approximately 10 feet 6 inches, measured to the structure and from 15 feet to approximately 6 feet measured to the open front porch to allow for the new construction of a four-unit, multiple family dwelling on a reverse corner lot located at 600 32nd Street West and 3144-46 Garfield Avenue South in the R4 Multiple-Family District, subject to the following conditions of approval:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by January 9, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The proposed structure shall comply with the administrative design review standards per Chapter 530 of the zoning code.
