1.   1012 29th Ave N and 2900 Dupont Ave N (BZZ #6356 Ward 3) (Shanna Sether)
Variance: Mahin Hamilton, of Urban Homeworks, Inc., has applied for a variance to allow for a new detached accessory structure (garage) not located entirely to the rear of the principal dwelling for the properties located at 1012 29th Ave N and 2900 Dupont Ave N in the R2B Two-Family District.
Action: The Board of Adjustment adopted staff findings #1 and #2 and modified finding #3 to:
Finding #3: Staff would typically have concerns about the proposed location of the detached garage on a corner lot, 30 feet from the front property line. However, staff finds that the proposed variance will not alter the essential character of the locality or be injurious to the use or enjoyment of other property in the vicinity, with the recommended design changes.Staff is recommending that the applicant match exterior materials of the existing dwelling and that the garage have additional design features including windows and a dormer with windows, consistent with the existing dwelling. Finally, granting of the variance will not be detrimental to the health, safety, or welfare of the general public or of those utilizing the property or nearby properties. The subject property has the only curb cut along Dupont Avenue South and staff’s preference would be to have the garage accessed via 29th Avenue North, consistent with other curb cuts and alleys in the surrounding area. Further, the consolidation of curb cuts is required per 541.230(1) of the zoning code. The proposed detached garage will require a building permit and compliance with the applicable building and life safety ordinances.

  3. The exterior materials of the proposed garage shall match the existing dwelling.
  4. The detached garage shall have windows and a dormer with windows, consistent with the existing dwelling.
  5. The detached garage shall be accessed via the existing curb cut along Dupont Ave N.
  6. The remaining curb cuts not accessed via driveway shall be closed with a permit issued by the Department of Public Works.

A. Variance: Brad Goering, on behalf of Sherman Associates, has applied for a variance to reduce the required front yard from fifteen (15) feet to nine (9) feet for the front building wall and to (0) feet for a patio for a new two-family dwelling in the C1 Neighborhood Commercial district for the property located at 2931-2937 Bloomington Ave.
Action: The Board of Adjustment adopted the findings and approved the variance to reduce the required front yard to reduce the required front yard from fifteen (15) feet to nine (9) feet for the front building wall and to (0) feet for a patio to allow for the construction of a new two-family dwelling with accessory commercial parking located at 2931-2937 Bloomington in the C1 Neighborhood Commercial District.
B. Variance: Brad Goering, on behalf of Sherman Associates, has applied for a variance to increase the maximum number of vehicles permitted to be parked outdoors for a residential use from four (4) to eight (8) for the property located at 2931-2937 Bloomington Ave.
Action: The Board of Adjustment adopted the findings and approved the variance to increase the maximum number of vehicles permitted to be parked outdoors for a residential use from four (4) to eight (8) to allow for the construction of a new two-family dwelling with accessory commercial parking located at 2931-2937 Bloomington in the C1 Neighborhood Commercial District, subject to the following condition:
  1. The Department of Community Planning and Economic Development and any other applicable City departments review and approve the final site and landscape plans.

Variance: Mark Nelson of David Heide Design Studio, on behalf of John Thompson and Anne Viviano has applied for a variance to reduce the front yard setback along 26th St W from approximately 42 feet to 14 feet 9 inches to allow for the construction of a new enclosed porch accessory to an existing single-family dwelling on a reverse corner lot located at 1612 26th St W in the R1 Single-Family District and SH Shoreland Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the front yard setback along 26th St W from approximately 42 feet to 14 feet 9 inches to allow for the construction of a new enclosed porch accessory to an existing single-family dwelling on a reverse corner lot located at 1612 26th St W in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by December 12, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Variance: Tim Smith and Toni Hansen have applied for a variance to reduce the required front yard setback along Thomas Ave S from approximately 28 feet to approximately 19 feet to allow for a remodel and addition to the rear of an existing single-family dwelling on a reverse corner lot located at 2622 49th St W in the R1 Single-Family District and SH Shoreland Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the required front yard setback along Thomas Ave S from approximately 28 feet to approximately 19 feet to allow for a remodel and addition to the rear of an existing single-family dwelling on a reverse corner lot located at 2622 49th St W in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval:
  1.  Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by December 12, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the required front yard setback along Seymour Ave SE from approximately 25 feet to approximately 11 feet 7 inches to allow for a remodel and second story addition to an existing single-family dwelling on a reverse corner lot located at 1901 East River Parkway in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.

Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the required front yard setback along Seymour Ave SE from approximately 25 feet to approximately 7 feet 9 inches to allow for a new roof-top deck to an existing single-family dwelling on a reverse corner lot located at 1901 East River Parkway in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by December 12, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
C. Variance: Jonathan Query, on behalf of David Foster and Sarah Stoesz, has applied for a variance to reduce the required front yard setback along Seymour Ave SE from approximately 25 feet to approximately 5 feet to allow for a rain barrel for the property located at 1901 East River Parkway in the R1 Single-Family District, MR Mississippi River Critical Area Overlay District, SH Shoreland Overlay District and UA University Area Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the required front yard setback along Seymour Ave SE from 25 feet to approximately 5 feet to allow for a rain barrel to an existing single-family dwelling on a reverse corner lot located at 1901 East River Parkway in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval:
  1.  Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by December 12, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Variance: Jaret Giesbrecht has applied for a variance to reduce the front yard setback along 4th St SE from approximately 32 feet 5 inches to approximately 14 feet to allow for air conditioning equipment accessory to an existing two-family dwelling located on a reverse corner lot at 401 7th Ave SE in the R2B Two-Family District and UA University Area Overlay District.
Action: This item was continued one cycle to the January 9, 2014 BOA meeting.
