Public Hearing
1.   2329 Marshall St NE (BZZ #6049, Ward 3) (Shanna Sether)
Variance: Application by Thomas Siwek for a variance to reduce the required front yard setback along Marshall Street NE from the setback established by connecting a line between the two adjacent structures from approximately 45 feet to approximately 15 feet 8 inches to allow for a new open front porch to an existing single-family dwelling located at 2329 Marshall St NE in the R2B Two-Family District and MR Mississippi River Critical Area Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the required front yard setback along Marshall St NE from the setback established by connecting a line between the two adjacent structures from approximately 45 feet to approximately 15 feet 8 inches to allow for a new open front porch to an existing single-family dwelling located at 2329 Marshall St NE in the R2B Two-Family District and MR Mississippi River Critical Area Overlay District, subject to the following conditions of approval:
1.    The handrails shall not exceed 3 feet in height or be more than 50 percent opaque.
2.    The finish of the porch shall match the finish of the dwelling or the trim on the dwelling.
3.    Raw or unfinished lumber shall not be permitted on an open front porch.
4.    Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
5.    All site improvements shall be completed by August 8, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.   401 7th Ave SE (BZZ #6154, Ward 3) (Shanna Sether)
A. Variance: Application by Jaret Giesbrecht has applied for a variance to reduce the front yard setback along 7th Ave SE from 20 feet to approximately 13 feet 4 inches to allow for a one and a half story addition over the existing first floor of a two-family dwelling located on a reverse corner lot at 401 7th Ave SE in the R2B Two-Family District and UA University Area Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the front yard setback along 7th Ave SE from 20 feet to approximately 13 feet 4 inches to allow for a one and a half story addition over the existing first floor of an existing two-family dwelling on a reverse corner lot located at 401 7th Ave SE in the R2B Two-Family District, subject to the following conditions of approval:
1.     The exterior materials used for the addition shall be of a durable material and compliment the exterior materials of the principal structure on the property.
2.     The proposed addition should have a consistent window pattern and window area to match the existing first floor on the front-facing elevations.
3.     Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
4.     All site improvements shall be completed by August 8, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the front yard setback along 4th St SE from approximately 32 feet 5 inches to approximately 14 feet to allow for a one and a half story addition over the existing first floor of an existing two-family dwelling on a reverse corner lot located at 401 7th Ave SE in the R2B Two-Family District, subject to the following conditions of approval:
1.    The exterior materials used for the addition shall be of a durable material and compliment the exterior materials of the principal structure on the property.

Variance: Application by Greg Hjelle of Providence Development, LLC, for a variance to reduce the minimum off-street parking requirement from 27 to 26 spaces, where 26 spaces are legally nonconforming, to allow for one additional dwelling unit within an existing multiple-family structure located at 1812 1st Ave S in the OR3 Institutional Office Residence District and PO Pedestrian Oriented Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the minimum off-street parking requirement from 23 to 22 spaces, where 22 spaces are legally nonconforming, to allow for one additional dwelling unit within an existing multiple-family structure located at 1812 1st Ave S in the OR3 Institutional Office Residence District and PO Pedestrian Oriented Overlay District, subject to the following conditions of approval:
1.    Bicycle parking shall be provided to accommodate no fewer than five (5) bicycles on the property and shall meet the minimum requirements for long-term bicycle parking.   
2.    Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
3.    All site improvements shall be completed by August 8, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

4.   3407 28th St W (BZZ #6155, Ward 7) (Shanna Sether)
Variance: Application by Ron Sonnek of Sicora, Inc., on behalf of Yuri Reinberg, for a variance to increase the maximum floor area ratio from 0.66 to approximately .71 to allow for an addition to an existing single-family dwelling located at 3407 28th St W in the R1 Single-Family District and SH Shoreland Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to increase the maximum floor area ratio from 0.66 to approximately .71 to allow for an addition to an existing single-family dwelling located at 3407 28th St W in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval:
1.    The exterior materials used for the addition shall match the exterior materials of the principal structure on the property.
2.    Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.

Variance: Application by Mike Russell of Sussel Builder, on behalf of Wen Thole and Katie Galloway, has requested a variance to reduce the minimum south interior side yard setback from 5 feet to approximately 1 foot to allow for the construction of a new detached garage accessory to an existing single-family dwelling located at 4209 Colfax Ave S in the R1A Single-Family District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the minimum south interior side yard setback from 5 feet to approximately 1 foot to allow for the construction of a new detached garage accessory to an existing single-family dwelling located at 4209 Colfax Ave S in the R1A Single-Family District, subject to the following conditions of approval:
1.    The exterior materials used for the accessory structure shall complement and be similar to the exterior materials of the principal structure on the property.
2.    Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
3.    All site improvements shall be completed by August 8, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
