1.   3748 West Lake Calhoun Parkway (BZZ #6058, Ward 13) (Robb Clarksen)(Staff report)

A. Variance: Application by Jolene Schmelzer of Lakewest, LLC, for a variance to increase the maximum gross floor area ratio from .5 to approximately .7 for property located at 3748 West Lake Calhoun Parkway in the R1 Single-Family District and SH Shoreland Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and deny the variance to increase the maximum permitted floor area ratio permitted in the residential zoning districts from approximately .59 to approximately.7 to allow for a new single-family dwelling located at 3748 West Lake Calhoun Parkway in the R1 Single-Family District and SH Shoreland Overlay District.

B. Variance: Application by Jolene Schmelzer of Lakewest, LLC, for a variance to reduce the required front yard setback along West Lake Calhoun Parkway from the setback established by connecting a line between two adjacent neighbors from approximately 34 feet to 23 feet (for the structure) and from 34 feet to 3 feet (for a retaining wall) for property located at 3748 West Lake Calhoun Parkway in the R1 Single-Family District and SH Shoreland Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the front yard setback as established by the line connecting the front of the adjacent dwellings along West Lake Calhoun Parkway from approximately 34 feet to 26 feet to allow for a new single-family dwelling and from approximately 34 feet to 20 feet for a ground level patio which shall not exceed the width of the principal structure located at 3748 West Lake Calhoun Parkway in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval:

  1. Approval of the project will require the applicant to complete the City’s administrative site plan review process and obtain any approvals required by outside agencies, including but not limited to the Minneapolis Park and Recreation Board, and the Public Works department prior to issuance of building permits.
  2. The applicant shall submit a landscaping plan clarifying the impact of development on existing vegetation on the subject property and in the area between the front lot line and West Lake Calhoun Parkway.
  3. The Applicant shall provide a tree protection plan authored by a licensed arborist to assess the potential preservation of any trees over 10” diameter at breast height (4.5 feet above grade, on or offsite) that may be affected by the proposed development. 
  4. CPED staff shall review and approve the final site, landscaping, building and elevation plans prior to the issuance of building permits. 
  5. All site improvements shall be completed by June 20, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

C. Variance: Application by Jolene Schmelzer of Lakewest, LLC, for a variance to allow for development on or within 40 feet of the top of a steep slope for property located at 3748 West Lake Calhoun Parkway in the R1 Single-Family District and SH Shoreland Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the variance to permit development on a steep slope or bluff or within 40 feet of the top of a steep slope in the SH Shoreland Overlay District to allow for a new single-family dwelling and ground level patio located at 3748 West Lake Calhoun Parkway, subject to the following conditions of approval:

  1. The principal structure shall comply with a 26’ setback from the front lot line, as established by adjacent development to the west.
  2. A ground level patio shall comply with a 20’ setback from the front lot line, as established by adjacent development to the west. 
  3. The applicant shall complete the City’s administrative site plan review process.
  4. The applicant shall obtain approval from the Minneapolis Park and Recreation Board prior to issuance of building permits.
  5. The applicant shall provide a landscaping plan shall clarify how the view of the property from Lake Calhoun will be consistent with pre-development conditions to the extent practical.
  6. The Applicant shall provide a tree protection plan authored by a licensed arborist to assess the potential preservation of any trees over 10” diameter at breast height (4.5 feet above grade, on or offsite) that may be affected by the proposed development.

2.   4838 Bryant Ave S (BZZ #6071, Ward 13) (Shanna Sether)(Staff report)

A. Variance: Application by John Barbour of Shelter Architecture, on behalf of Marcus Waterbury, for a variance to increase the maximum floor area for accessory structures from 676 square feet to 1,322 square for an existing single-family dwelling located at 4838 Bryant Ave S in the R1 Single-Family District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and deny the variance to increase the maximum floor area for accessory structures from 804 square feet to 1,258 square feet to allow for the construction of a new 704 square foot attached garage, existing 360 square foot detached garage, 96 square foot shed and 98 square foot gazebo accessory to an existing single-family dwelling located at 4838 Bryant Ave S in the R1 Single-Family District.

B. Variance: Application by John Barbour of Shelter Architecture, on behalf of Marcus Waterbury, for a variance to reduce the north interior side yard setback from 6 feet to 0 feet to allow for a new attached garage located at 4838 Bryant Ave S in the R1 Single-Family District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and deny the variance to reduce the north interior side yard setback from 6 feet to 0 feet to allow for a new attached garage accessory to an existing single-family dwelling located at 4838 Bryant Ave S in the R1 Single-Family District.

C. Variance: Application by John Barbour of Shelter Architecture, on behalf of Marcus Waterbury, for a variance to increase the maximum height of a fence located in the required north interior side yard setback from 6 feet to approximately 7 feet 6 inches for property located at 4838 Bryant Ave S in the R1 Single-Family District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and deny the variance to increase the maximum height of a fence located in the required north interior side yard setback from 6 feet to approximately 7 feet 6 inches accessory to an existing single-family dwelling located at 4838 Bryant Ave S in the R1 Single-Family District.

3.   222 Hennepin Ave (BZZ #6086, Ward 7) (Shanna Sether)(Staff report)

A. Variance: Application by Jim Doyle of Ryan Companies US, Inc., on behalf of 222 Hennepin Investors, LLC, for a variance to increase the maximum height of four wall signs from 28 feet to approximately 97 feet located at 222 Hennepin Ave in the B4S-2 Downtown Service District. 

Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the staff findings and approve of the variance to increase the maximum height of four wall signs from 28 feet to approximately 97 feet located at 222 Hennepin Ave in the B4S-2 Downtown Service District, subject to the following condition of approval:

  1. Approval of the master sign plan by the Department of Community Planning and Economic Development.

4.   1100 2nd St S (BZZ #6087, Ward 7) (Shanna Sether)(Staff report)

A. Variance: Application by Jeff Sommers of Izzy’s Ice Cream Café, on behalf of River road Holdings, LLC, for a variance to allow for a new wall sign located on a non-primary building wall for property located at 1100 2nd St S in the I1 Light Industrial District and IL Industrial Living Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the staff findings and approve of the variance to allow for a new wall sign located on a non-primary building wall for the property located at 1100 2nd St S in the I1 Light Industrial District, subject to the following condition of approval:

  1. Approval of the sign permit by the Department of Community Planning and Economic Development.

B. Variance: Application by Jeff Sommers of Izzy’s Ice Cream Café, on behalf of River road Holdings, LLC, for a variance to increase the maximum area of a wall sign from 0 square feet to approximately 25 square feet for property located at 1100 2nd St S in the I1 Light Industrial District and IL Industrial Living Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the staff findings and approve of the variance to increase the maximum area of a new wall sign from 0 square feet to approximately 25 square feet for the property located at 1100 2nd St S in the I1 Light Industrial District, subject to the following conditions of approval:

  1. Approval of the sign permit by the Department of Community Planning and Economic Development.
