1. 101 32nd Street East (BZZ #6019, Ward 10) (Sether)
Variance: Eric Vagle of Minnesota Teen Challenge has applied for a variance of the specific development standards for a community residential facility which permits on-site services for residents of the facility only, except where part of a regimen of scheduled post-residential treatment. Minnesota Teen Challenge is proposing to allow for on-site outpatient chemical dependency treatment services to clients who have not completed a residential treatment program located at 101 32nd Street East in the R5 Multiple Family District.
Action: The Board of Adjustment continued the application for the variance of the specific development standards to allow for a community residential facility providing on-site, outpatient chemical dependency treatment services to clients who have not completed a residential treatment program located at 101 32nd Street East in the R5 Multiple Family District one-cycle to the June 6, 2013, Board of Adjustment public hearing.

2. 5021 Ewing Avenue South (BZZ #6034, Ward 13) (Sether)
Variance: Pat Mackey of Mackey Malin Architects, on behalf of Tim and Josie Walton, has applied for a variance to reduce the minimum front yard setback along Ewing Avenue South from approximately 29 feet 2 inches to approximately 21 feet 4 inches to allow for a new open front porch on an existing single-family dwelling located at 5021 Ewing Avenue South in the R1A Single-Family District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the minimum front yard setback along Ewing Avenue South from approximately 29 feet 2 inches to approximately 21 feet 4 inches to allow for a new open front porch on an existing single-family dwelling located at 5021 Ewing Avenue in the R1A Single-Family District, subject to the following conditions of approval:
- The handrails shall not exceed 3 feet in height or be more than 50 percent opaque.
- The finish of the porch shall match the finish of the dwelling or the trim on the dwelling.
- Raw or unfinished lumber shall not be permitted on an open front porch.
- Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
- All site improvements shall be completed by May 23, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

3. 4210 Fremont Avenue South (BZZ #6039, Ward 13) (Sether)
Variance: Tyler Hillger of Tea2 Architects, on behalf of Jay and Sharon Berlin, has applied for a variance to allow for development on and within 40 feet of the top of a steep slope to allow for rear additions, including a new attached garage with roof-top deck, ground-level patio, stairs, retaining walls, driveway, and egress windows accessory to an existing single-family dwelling located at 4210 Fremont Avenue South in the R1 Single-Family District and SH Shoreland Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to allow for development on and within 40 feet of the top of a steep slope to allow for rear additions, including a new attached garage with roof-top deck, ground-level patio, stairs, retaining walls, driveway and egress windows accessory to an existing single-family dwelling located at 4210 Fremont Avenue South in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval:
- Approval of the final site plans by the Department of Community Planning and Economic Development.
- All site improvements shall be completed by May 23, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Variance: Tim Brandvold has applied for a variance to reduce the required interior side yard setback along the north side lot line from 6 feet to 1 foot to allow for the construction of a new detached accessory structure for the property located at 3835 Thomas Avenue South in the R1 Single-Family Residence District/SH Shoreland Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the required interior side yard setback along the north side lot line from 6 feet to 1 foot to allow for the construction of a new detached accessory structure for the property located at 3835 Thomas Avenue South in the R1 Single-Family Residence District/SH Shoreland Overlay District, subject to the following conditions:
- The applicant shall apply to obtain necessary approvals for administrative site plan review.
- CPED staff review and approve the final site plan, building plans, and elevations.
- All site improvements shall be completed by May 23, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Variance: Brian Reinstra and Kathy Ferrey have applied for a variance to increase the maximum height of a fence from 3 feet to 8 feet in the required front yard setback and from 6 feet to 8 feet in the required interior and rear yard setbacks for the property located at 2925 Sunset Boulevard in the R1 Single-Family District.
Action: The Board of Adjustment adopted staff findings and approved the variance to increase the maximum height of a fence from 3 feet to 8 feet in the required front yard setback and from 6 feet to 8 feet in the required interior and rear yard setbacks for the property located at 2925 Sunset Boulevard in the R1 Single-Family District, subject to the following conditions of approval:
- Approval of the final site plan by the Department of Community Planning and Economic Development.
- Installation of the fence shall be completed by May 23, 2015, unless extended by the Zoning Administrator, or the approval may be revoked for non-compliance.
