1.   247 Chicago Avenue South (BZZ #5910, Ward 7) (Steen) (Staff Report)
This item was Continued from the February 14, March 21, and April 4 Board of Adjustment meetings.
Appeal: Application by Eric H. Galatz, on behalf of Megabus USA, LLC, for an appeal of the Zoning Administrator’s determination that the bus passenger loading and unloading at 247 Chicago Avenue South is classified as a Bus Turnaround under the Minneapolis Code of Ordinances, thus requiring a conditional use permit (CUP).
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and deny the appeal of the Zoning Administrator’s determination that the bus passenger loading and unloading at 247 Chicago Avenue South is classified as a Bus Turnaround under the Minneapolis Code of Ordinances, thus requiring a conditional use permit (CUP).
2.   3112 33rd Street East (BZZ #5986, Ward 9) (Sether) (Staff Report)
A. Variance: Jill Lipski Cain has applied for a variance to reduce the minimum distance between a detached accessory building and a dwelling from 6 feet to approximately 4 feet to allow for the reconstruction of a detached garage accessory to an existing single-family dwelling located at 3112 33rd Street East in the R1A Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the minimum distance between a detached accessory building and a dwelling from 6 feet to approximately 4 feet to allow for the reconstruction of a detached garage accessory to an existing single-family dwelling located at 3112 33rd Street East in the R1A Single-Family District, subject to the following conditions of approval:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by April 18, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
B. Variance: Jill Lipski Cain has applied for a variance to allow for the reconstruction of a detached garage not entirely to the rear of the principal residential structure of an existing single-family dwelling located at 3112 3rd Street East in the R1A Single-Family District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the variance to allow for the reconstruction of a detached parking garage not entirely to the rear of the principal residential structure located at 3112 33rd Street East in the R1A Single-Family District, subject to the following conditions of approval:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by April 18, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
3.   4031 Queen Avenue South (BZZ #5982, Ward 13) (Sether) (Staff Report)
Variance: Jon Colliander of TreHus, on behalf of David Beck, has applied for a variance to allow for development within 40 feet of the top of a steep slope to allow for a second story addition to an existing single-family dwelling located at 4031 Queen Avenue South in the R1 Single-Family District and SH Shoreland Overlay District.
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the variance development within 40 feet of the top of a steep slope to allow for a second story addition to the rear of an existing single-family dwelling located at 4031 Queen Avenue South in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by April 18, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
4.   945 Broadway Street NE, 1121 Central Avenue NE, and 1120 Tyler Street NE (BZZ #5987, Ward 1) (Sether) (Staff Report)
Variance: Melissa Gorman of First & First, LLC, has applied for a variance to increase the maximum height of a wall sign from 28 feet to approximately 35 feet to allow for a new wall sign facing Central Avenue NE located on an existing building located at 945 Broadway Street NE in the I2 Medium Industrial District.   
Staff Recommendation: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the variance to increase the maximum height of a wall sign from 28 feet to approximately 35 feet to allow for a new wall sign facing Central Avenue NE located on an existing building located at 945 Broadway Street NE in the I2 Medium Industrial District and IL Industrial Living Overlay District, subject to the following conditions of approval:
  1. Approval of the sign plans by the Department of Community Planning and Economic Development.
  2. Approval of the sign permit must be given by April 18, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
