This item was Continued from the February 14 and March 21, 2013, Board of Adjustment meetings.
Appeal: Application by Eric H. Galatz, on behalf of Megabus USA, LLC, for an Appeal of the Zoning Administrator’s determination that the bus passenger loading and unloading at 247 Chicago Avenue South is classified as a Bus Turnaround under the Minneapolis Code of Ordinances, thus requiring a conditional use permit (CUP).
Action: The Board of Adjustment continued the appeal of the Zoning Administrator’s determination that the bus passenger loading and unloading at 247 Chicago Avenue is classified as a Bus Turnaround under the Minneapolis Code of Ordinances, thus requiring a conditional use permit (CUP), one cycle to the April 18, 2013, Board of Adjustment public hearing.

Appeal: Application by Mark Thieroff, on behalf of Nathan and Katie Bard, for an Appeal of the Zoning Administrator’s determination that Chapter 525 of the Minneapolis Code of Ordinances does not authorize a variance for a detached accessory structure in excess of sixteen (16) feet in height or sixty (60) percent of the height of the principal residential structure for the property located at 5240 West Lake Nokomis Parkway in the R1 Single Family District, SH Shoreland Overlay District and the AP Airport Overlay District.
Action: The Board of Adjustment accepted the withdrawal of the Appeal of the Zoning Administrator’s determination that Chapter 525 of the Minneapolis Code of Ordinances does not authorize a variance for a detached accessory structure in excess of sixteen (16) feet in height or sixty (60) percent of the height of the principal residential structure for the property located at 5240 West Lake Nokomis Parkway in the R1 Single Family District, SH Shoreland Overlay District and the AP Airport Overlay District.

3.   4151 Vincent Avenue South (BZZ #5971, Ward 13) (Sether)
Variance: Glenn Campbell of MN Renovations, on behalf of Susan and Matt Stowman, has applied for a variance to reduce the required front yard setback along 42nd Street West from 25 feet to approximately 13 feet 7 inches to allow for a rear two and a half story addition with an attached garage to an existing single-family dwelling on a reverse corner lot located at 4151 Vincent Avenue South in the R1 Single-Family District.  
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the required front yard setback along 42nd Street West from 25 feet to approximately 13 feet 7 inches to allow for a rear two and a half story addition with an attached garage to an existing single-family dwelling on a reverse corner lot located at 4151 Vincent Avenue South in the R1 Single-Family District, subject to the following conditions of approval:
  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by April 4, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
