This item was Continued from the February 14, 2013, Board of Adjustment meeting.
Appeal: Application by Eric H. Galatz, on behalf of Megabus USA, LLC, for an appeal of the Zoning Administrator’s determination that the bus passenger loading and unloading at 247 Chicago Avenue South is classified as a Bus Turnaround under the Minneapolis Code of Ordinances, thus requiring a conditional use permit (CUP).
Action: The Board of Adjustment Continued the appeal of the Zoning Administrator’s determination that the bus passenger loading and unloading at 247 Chicago Avenue is classified as a Bus Turnaround under the Minneapolis Code of Ordinances, thus requiring a conditional use permit (CUP) for one cycle to the April 4, 2013, Board of Adjustment meeting.

Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the interior side yard setback from 6 feet to 1.4 feet to allow for an existing air-conditioner unit located at 4840 12th Avenue South in the R1 Single-Family District, AP Airport Overlay District, and SH Shoreland Overlay District subject to the following condition:
  1. The applicant installs a four (4) foot tall solid fence to screen the air-conditioning unit from view adjacent properties.

Variance: Twin Cities Habitat for Humanity has applied for a variance to reduce the required front yard setback along Newton Avenue North from the setback established by connecting a line from the front of two adjacent homes to 20 feet, to construct a new single family dwelling located at 2930 Newton Avenue North in the R2B Two-Family District.
Action: The Board of Adjustment adopted staff findings and approved a variance to reduce the required front yard setback along Newton Avenue North from the setback established by connecting a line from the front of two adjacent homes to 20 feet, to construct a new single family dwelling and related features located at 2930 Newton Avenue North in the R2B Two Family District subject to the following condition:
  1. Final site and elevation plans must be approved by CPED staff.

Variance: Marissa Rosenblum and David Upin have requested a variance to reduce the front yard setback along Logan Avenue South established by connecting a line between the two adjacent neighbors from 26.8 feet to approximately 21 feet to allow for the construction of an expanded ground level patio at the front of an existing single-family dwelling located at 1785 Logan Avenue South in the R2 Two-Family District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the front yard setback along Logan Avenue South established by the adjacent neighbor to the north from 26.8 feet to approximately 21 feet to allow for the construction of an expanded ground level patio at the front of an existing single-family dwelling located at 1785 Logan Avenue South in the R1 Single-Family District, SH Shoreland Overlay District and AP Airport Overlay District, subject to the following conditions of approval:
  1. Approval of the final site plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by March 21, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance

  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.

Action: The Board of Adjustment accepted the withdrawal of the variance to increase the maximum area of a wall sign from approximately 80 square feet to 242 square feet for the Michael’s Arts and Crafts Store located in the existing Quarry Shopping Center at 1500-1710 New Brighton Boulevard.
