Public Hearing
1.  1901 East River Terrace (BZZ #5677, Ward: 2) (Sether)
Variance: William Olive and Danika Hoffmann have applied for a variance to reduce the minimum southeast interior side yard from 6 feet to approximately 1 foot to allow for a new detached garage accessory to the existing single-family dwelling located at 1901 East River Terrace in the R1 Single-Family District and SH Shoreland Overlay District.
Action: Notwithstanding staff recommendation, the Board of Adjustment approved the variance to reduce the minimum southeast interior side yard from 6 feet to approximately 1 foot to allow for a new detached garage accessory to the existing single-family dwelling located at 1901 East River Terrace in the R1 Single-Family District, MR Mississippi River Critical Area Overlay District and UA University Area Overlay District with the following findings:
  1. Practical difficulties exist in complying with the ordinance due to circumstances unique to the parcel. Placing the detached garage in the rear 40 feet of the lot would create a practical difficulty due to the existing slope and runoff from the adjacent property. Locating the garage in the rear 40 feet would lead to water damage and maintenance issues with the garage in the future. Placing the detached garage 6 feet from the southeast interior side property line would create practical difficulty due to the existing water drainage, increased runoff, the location of the pond and the likelihood that the existing water issues in the basement of the dwelling would worsen. These circumstances have not been created by the applicant.
  2. The purpose of yard requirements is to provide for orderly development and use of land and to minimize conflicts among land uses between principal and accessory uses. The subject property and the adjacent property to the southeast are both 75 feet wide. The adjacent dwelling at 1909 East River Terrace is located nearer to their southeast property line and would be located at least 40 feet from the proposed detached garage and dense vegetation exists along the shared property line minimizing any potential impacts.
  3. The proposed variance will not alter the essential character of the locality or be injurious to the use or enjoyment of other property in the vicinity. The subject property and the adjacent property to the southeast are both 75 feet wide. The adjacent dwelling at 1909 East River Terrace is located nearer to their southeast property line and would be located at least 40 feet from the proposed detached garage and dense vegetation exists along the shared property line minimizing any potential impacts. The proposed detached garage would be clad with 4 inch hardiboard siding and shakes to match the exterior materials of the dwelling. The roof would be a 4/12 gable roof, unlike the 8/12 gable roof of the dwelling to minimize the height and allow more storm water to be directed on-site. Finally, granting of the variance will not be detrimental to the health, safety, or welfare of the general public or of those utilizing the property or nearby properties, as long as it is constructed to current building codes.

Variance: James Sharp, on behalf of Jeanne Voigt, has applied for a variance to reduce the minimum north interior side yard from 6 feet to 3 feet to allow for a cantilever addition to the existing single-family dwelling located at 2529 Thomas Avenue South in the R1 Single-Family District and SH Shoreland Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the minimum north interior side yard from 6 feet to 3 feet to allow for a cantilever addition to the existing single-family dwelling located at 2529 Thomas Avenue South in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval: 
  1. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development – Planning Division.
  2. All site improvements shall be completed by August 23, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The addition shall have compatible materials to the existing structure.

Variance: Bradley Keely has applied for a variance to reduce the required front yard setback along James Avenue South from approximately 29 feet to approximately 11 feet to allow for the construction of a new detached garage accessory to an existing single-family dwelling on a reverse corner lot located at 1700 61st Street West in the R1 Single-Family District and SH Shoreland Overlay District.
Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the required front yard setback along James Avenue South from approximately 29 feet to approximately 11 feet to allow for the construction of a new detached garage accessory to an existing single-family dwelling on a reverse corner lot located at 1700 61st Street West in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions:
  1. The exterior materials used for the garage shall complement and be similar to the exterior materials of the principal structure on the property.
  2. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development – Planning Division.
  3. All site improvements shall be completed by August 23, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Action: The Board of Adjustment adopted staff findings and approved the variance to reduce the east interior side yard setback from 5 feet to approximately 1 foot to allow for a new tuck-under garage with a roof-top deck to an existing single-family dwelling for the property located at 2910 45th Street West in the R1A Single-Family District, subject to the following conditions of approval:
  1. The exterior materials used for the accessory structure shall complement the exterior materials of the principal structure on the property.
  2. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development – Planning Division.
  3. All site improvements shall be completed by August 23, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
