1.  4452 Vincent Avenue South (BZZ #5614, Ward: 13) (Sether) (Staff Report)
A. Variance: Seth Paradis has applied for a variance to reduce the front yard setback along 45th Street West from 20 feet to approximately 11 feet 6 inches to allow for the construction of a new addition and tuck-under garage for the property located at 4452 Vincent Avenue South in the R1A Single-Family District and SH Shoreland Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the front yard setback along 45th Street West from 20 feet to approximately 11 feet 6 inches to allow for the construction of a new addition and tuck-under garage for the property located at 4452 Vincent Avenue South in the R1A Single-Family District, subject to the following conditions:
  1. The exterior materials used for the addition shall complement and be similar to the exterior materials of the principal structure on the property.
  2. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development - Planning Division.
  3. All site improvements shall be completed by July 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
B. Variance: Seth Paradis has applied for a variance to reduce the front yard setback along 45th Street West from 20 feet to approximately 7 feet 7 inches for a covered roof-top deck for the property located at 4452 Vincent Avenue South in the R1A Single-Family District and SH Shoreland Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the front yard setback along 45th Street West from 20 feet to approximately 7 feet 7 inches for a covered roof-top deck for the property located at 4452 Vincent Avenue South in the R1A Single-Family District, subject to the following conditions:
  1. The exterior materials used for the addition shall complement and be similar to the exterior materials of the principal structure on the property.
  2. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development - Planning Division.
  3. All site improvements shall be completed by July 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
C. Variance: Seth Paradis has applied for a variance to reduce the front yard setback along 45th Street West from 20 feet to approximately 14 feet 8 inches to allow for a new open front porch for the property located at 4452 Vincent Avenue South in the R1A Single-Family District and SH Shoreland Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the front yard setback along 45th Street West from 20 feet to approximately 14 feet 8 inches to allow for a new open front porch for the property located at 4452 Vincent Avenue South in the R1A Single-Family District, subject to the following conditions:
  1. The finish of the porch shall match the finish of the dwelling or the trim on the dwelling.
  2. Raw or unfinished lumber shall not be permitted on an open front porch.
  3. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development - Planning Division.
  4. All site improvements shall be completed by July 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
2.  2429 Franklin Avenue East (BZZ #5571, Ward: 2) (Sether) (Staff Report)
A. Variance: Thomas Rapson of Rapson Architects, on behalf of KAAH Express, has applied for a variance to reduce the west interior side yard setback from 11 feet to 4 feet to allow for a building addition to an existing commercial building located at 2429 Franklin Avenue East in the C1 Neighborhood Commercial District and PO Pedestrian Oriented Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the west interior side yard setback from 11 feet to 4 feet to allow for a building addition to an existing commercial building for the property located at 2429 Franklin Avenue East in the C1 Neighborhood Commercial District and PO Pedestrian Oriented Overlay District, subject to the following conditions of approval:
  1. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development - Planning Division.
  2. All site improvements shall be completed by July 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The applicant shall provide a minimum of 10% glazing on the west facade, as permitted by the building code.
  4. There shall be no blank walls in excess of 25 feet, per section 530.120 of the zoning code.
  5. The exterior materials of the proposed addition shall complement the existing building.
B. Variance: Thomas Rapson of Rapson Architects, on behalf of KAAH Express, has applied for a variance to reduce the required off-street parking from 4 spaces to 3 spaces for the building located at 2429 Franklin Avenue East in the C1 Neighborhood Commercial District and PO Pedestrian Oriented Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the required off-street parking from 4 spaces to 3 spaces for the property located at 2429 Franklin Avenue East in the C1 Neighborhood Commercial District and PO Pedestrian Oriented Overlay District, subject to the following conditions of approval:
  1. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development - Planning Division.
  2. All site improvements shall be completed by July 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
3.  3424 Zenith Avenue South (BZZ #5626, Ward: 13) (Sether) (Staff Report)
Variance: Jeremy McCrank, of Balancing Rock Design, LLC, on behalf of Lisa and Arthur Ide, has applied for a variance to reduce the required front yard along Zenith Avenue South to allow for a second floor bump-out addition to an existing single-family dwelling on a reverse corner lot located at 3424 Zenith Avenue South in the R1 Single-Family District and SH Shoreland Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustmentadopt staff findings and approve the variance to reduce the required front yard along Zenith Avenue South to approximately 80 feet to allow for a second floor bump-out addition to an existing single-family dwelling on a reverse corner lot located at 3424 Zenith Avenue South in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions:
  1. The exterior materials used for the addition shall complement and be similar to the exterior materials of the principal structure on the property.
  2. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development - Planning Division.
  3. All site improvements shall be completed by July 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Certificate of Nonconforming Use: David Klopp and Esme Murphy have applied for a certificate of nonconforming use to establish a two-family dwelling on the property located at 3715 Cedar Lake Road South in the R1 Single Family District and SH Shoreland Overlay District
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and deny the certificate of nonconforming use to establish a two-family dwelling for the property located at 3715 Cedar Lake Road South in the R1 Single Family District and SH Shoreland Overlay District.
5.  1961 Kenwood Parkway (BZZ #5627, Ward: 7) (Sether) (Staff Report)
Variance: Anne and Frank Taylor have applied for a variance to reduce the required front yard setback along Queen Avenue South from approximately 28 feet to approximately 17 feet 6 inches to allow for a one-story, rear addition to an existing single-family dwelling on a reverse corner lot located at 1961 Kenwood Parkway in the R1 Single-Family District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the required front yard setback along Queen Avenue South from approximately 28 feet to approximately 17 feet 6 inches to allow for a one-story, 32.5 square foot rear addition to an existing single-family dwelling on a reverse corner lot located at 1961 Kenwood Parkway in the R1 Single-Family District, subject to the following conditions:
  1. The exterior materials used for the additon shall complement and be similar to the exterior materials of the principal structure on the property.
  2. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development - Planning Division.
  3. All site improvements shall be completed by July 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

A. Variance: Martin Howard, of Next Level Designers and Builders, on behalf of the Obergfells, has applied for a variance to reduce the required north interior side yard from 5 feet to 3 feet to allow for a one-story addition to the rear of the existing single-family dwelling located at 3348 Irving Avenue South in the R2B Two-Family District and SH Shoreland Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the required north interior side yard from 5 feet to 3 feet to allow for a one-story addition to the rear of the existing single-family dwelling located at 3348 Irving Avenue South in the R2B Two-Family District and SH Shoreland Overlay District, subject to the following conditions of approval: 
  1. The exterior materials used for the addition shall complement and be similar to the exterior materials of the principal structure on the property.
  2. Approval of the final site and elevation plans by the Department of Community Planning and Economic Development - Planning Division.
  3. All site improvements shall be completed by July 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

7.  223 West Minnehaha Parkway (BZZ #5635, Ward: 11) (Sether) (Staff Report)
Variance: Justin and Jessie Pickar have applied for a variance to reduce the required west interior side yard setback from 6 feet to 3 feet to allow for an addition to an existing single-family dwelling located at 223 West Minnehaha Parkway in the R1 Single-Family District and SH Shoreland Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve a variance to reduce the required west interior side yard setback from 6 feet to 3 feet to allow for an addition to an existing single-family dwelling located at 223 West Minnehaha Parkway in the R1 Single-Family District and SH Shoreland Overlay District, subject to the following conditions of approval: 
  1. Approval of the final site and elevation plans by the Deparmtne of Community Planning and Economic Develoopment - Planning Division.
  2. All site improvements shall be completed by July 26, 2013, unless extended  by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The addition shall have compatible materials to the existing structure.
