1.  4920 Emerson Avenue South (BZZ #5564, Ward: 13) (Shanna Sether) (Staff Report)
Variance: Janet Fransen has applied for a variance to reduce the north interior side yard setback from 6 feet to approximately 3 feet to allow for a new enclosed screen porch to the front of an existing single-family dwelling located at 4920 Emerson Ave S in the R1 Single-Family District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and deny the variance to reduce the north interior side yard setback from 6 feet to approximately 3 feet to allow for a new enclosed screen porch to the front of an existing single-family dwelling located at 4920 Emerson Ave S in the R1 Single-Family District.
2.  4047 Beard Avenue South (BZZ #5565, Ward: 13) (Shanna Sether) (Staff Report)
Variance: Bill Himmelwright has applied for a variance to reduce the front yard setback along Beard Ave S from approximately 25 feet 7 inches to 20 feet 2 inches to allow for a new ground level patio and second story addition to an existing single-family dwelling located at 4047 Beard Ave S in the R1 Single-Family District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment accept the withdrawal of the variance to reduce the front yard setback along Beard Ave S from approximately 25 feet 7 inches to 20 feet 2 inches to allow for a new ground level patio and second story addition to the existing single-family dwelling located at 4047 Beard Ave S in the R1 Single-Family District.
 
3.  132 31st Avenue Northeast (BZZ #5554, Ward: 1) (Jake Steen) (Staff Report)
Variance: Tom and Tammie Swanson, owners of CBASE (Swanson Holdings, LLC), have applied for a variance of the surfacing requirements for parking areas for the property located at 132 31st Ave NE.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance of the surfacing requirements for parking and storage areas for the property located at 132 31st Ave NE, subject to the following conditions:
1.     Department of Community Planning and Economic Development – Planning Division staff review and approval of the final site and landscaping plan.
2.     Site improvements required by the zoning code or by the Zoning Board of Adjustment shall be completed by June 7, 2013, or the permit may be revoked for non-compliance.
4.  2449 31st Avenue South (BZZ #5570, Ward: 2) (Shanna Sether) (Staff Report)
A. Variance: Shannon Laveen, on behalf of William Laveen, has applied for a variance to increase the maximum height of a cedar and steel fence along 31st Ave S, from 3 feet to 6 feet for the property located at 2449 31st Ave S in the R1A Single-Family District, on a reverse corner lot.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and deny the variance to increase the maximum height of a cedar and steel fence, along 31st Avenue South from 3 feet to 6 feet on a reverse corner lot located at 2449 31st Ave S in the R1A Single-Family District.
B. Variance: Shannon Laveen, on behalf of William Laveen, has applied for a variance to increase the maximum height of a steel fence and gate along the north property line, from 3 feet to 6 feet for the property located at 2449 31st Ave S in the R1A Single-Family District, on a reverse corner lot.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and deny the variance to increase the maximum height of a steel fence and gate along the north property line, from 3 feet to 6 feet on a reverse corner lot located at 2449 31st Ave S in the R1A Single-Family District.
5.  219 Morgan Avenue North (BZZ #5563, Ward: 5) (Shanna Sether) (Staff Report)
Variance: Monica Arons has applied for a variance to increase the maximum height of a new detached garage from 10 feet to approximately 17 feet, measured from natural grade to the top plate, for the property located at 219 Morgan Ave N in the R1A Single-Family District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance to increase the maximum height of a new detached garage from 10 feet to approximately 17 feet, measured from the floor to the top plate, for the property located at 219 Morgan Ave N in the R1A Single-Family District, subject to the following conditions of approval:
1.     The exterior materials used for the accessory structure shall complement and be similar to the exterior materials of the principal structure on the property.
2.     The primary roof pitch of the garage is 12/12 and is a gable roof to match the pitch and roof type of the principal structure.
3.     Approval of the final site and elevation plans by the Department of Community Planning and Economic Development – Planning Division.
4.     All site improvements shall be completed by June 7, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
6.  2380 West Lake of the Isles (BZZ #5551, Ward: 7) (Jake Steen) (Staff Report)
Appeal: Application by Steven J. Wells for an appeal of the Zoning Administrator’s approval (BZZ #5396) of a new single family dwelling located at 2380 W Lake of the Isles, on the basis that the front yard setback was improperly determined.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and deny the appeal of the Zoning Administrator’s approval of a new single family dwelling located at 2380 West Lake of the Isles (BZZ 5396), on the contention that the front yard setback was improperly determined.
7.  1935 Penn Avenue South (BZZ #5569, Ward: 7) (Shanna Sether) (Staff Report)
Variance: Howard Theis, of Wooden Dreams, on behalf of Dawn and Whitney Tope, has applied for a variance to reduce the front yard setback along Penn Ave S from approximately 47 feet to approximately 30 feet to allow for an elevated walkway/deck to the front of an existing single-family dwelling located at 1935 Penn Ave S in the R1 Single-Family District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt staff findings and approve the variance to reduce the required front yard setback along Penn Ave S from approximately 47 feet to approximately 30 feet to allow for an elevated walkway/deck to the front of an existing single-family dwelling located at 1935 Penn Ave S in the R1 Single-Family District subject to the following conditions:
1.     Approval of the final site and elevation plans by the Department of Community Planning and Economic Development – Planning Division.
2.     All site improvements shall be completed by June 7, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
3.     The elevated walkway/deck shall have compatible materials to the existing structure.
