Variance: Alyssa Jasko submitted an application for a variance to reduce the established front yard setback requirement to 6.7 feet adjacent to Sheridan Ave S to allow a new open porch for the property located at 3927 Sheridan Ave S.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance to reduce the established front yard setback requirement to 6.7 feet adjacent to Sheridan Ave S to allow a new open porch for the property located at 3927 Sheridan Ave S.
2.  2201 52nd Street West (BZZ #5556, Ward: 13) (Shanna Sether) (Staff Report)
Variance: Al Theisen, on behalf of Linda and Courtney Muehlbauer, has applied for a variance to allow for development on or within 40 feet of the top of a steep slope to allow for the construction of a new deck accessory to an existing single-family dwelling located at 2201 52nd St W in the R1 Single-Family District and SH Shoreland Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance to allow for development on or within 40 feet of the top of a steep slope in the SH Shoreland Overlay District in order to allow for the construction of a new deck accessory to an existing single-family dwelling located at 2201 52nd St W in the R1 Single-Family District and SH Shoreland Overlay District.
3.  3940 Washburn Avenue South (BZZ #5518, Ward: 13) (Janelle Widmeier) (Staff Report)
Variance: Karen Mayer and Joe Yuhas submitted an application for a variance to reduce the established front yard setback requirement to 14 feet adjacent to Washburn Ave S to allow a new roof gable located at the property of 3940 Washburn Ave S.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance to reduce the established front yard setback requirement to 14 feet adjacent to Washburn Ave S to allow a new roof gable located at the property of 3940 Washburn Ave S.
4.  3736 Zenith Avenue South (BZZ #5549, Ward: 13) (Shanna Sether) (Staff Report)
Variance: Bradley Fagerstrom and Robert Lewis have applied for a variance to increase the maximum height from 2.5 stories to 3 stories to allow for an addition to an existing single-family dwelling located at 3736 Zenith Ave S in the R1 Single-Family District and SH Shoreland Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance to increase the maximum height from 2.5 stories to 3 stories to allow for an addition to an existing single-family dwelling located at 3736 Zenith Ave S in the R1 Single-Family District and SH Shoreland Overlay District subject to the following conditions:
1.     The overall height of the building shall not exceed 29 feet.
2.     The addition shall not exceed 600 square feet.
5.  3840 Upton Avenue South (BZZ #5529, Ward: 13) (Janelle Widmeier) (Staff Report)
A. Variance: Steven Behnke with Donnay Homes, on behalf of Neal Shah, submitted an application for a variance to increase the maximum allowed height from 2.5 stories to 3 stories (includes the basement level) to allow a new single-family dwelling for the property located at 3840 Upton Ave S.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance to increase the maximum allowed height of a single-family dwelling from 2.5 stories to 3 stories (includes the basement level) for the property located at 3840 Upton Ave S, subject to the following condition:
1.    The height of the house shall not exceed 27 feet.
B. Variance: Steven Behnke with Donnay Homes, on behalf of Neal Shah, submitted an application for a variance to increase the maximum floor area ration from 0.5 to 0.772 (includes the basement level) to allow a new single-family dwelling for the property located at 3840 Upton Ave S.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance to increase the maximum floor area ratio of a single-family dwelling from 0.5 to 0.772 (includes the basement level) for the property located at 3840 Upton Ave S, subject to the following condition:
1.    Department of Community Planning and Economic Development—Planning Division staff review and approval of the final site/grading/drainage plan, building plans and elevations.
C. Variance: Steven Behnke with Donnay Homes, on behalf of Neal Shah, submitted an application for a variance to reduce the south interior side yard from 6 feet to 4 feet 4 inches to allow a landing and stairs that extend more than 4 feet above the adjacent natural grade to allow a new single-family dwelling for the property located at 3840 Upton Ave S.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance to reduce the south interior side yard from 6 feet to 4 feet 4 inches to allow a landing and stairs that extends more than 4 feet above the adjacent natural grade for the property located at 3840 Upton Ave S.
6.  2610 Lyndale Avenue South (BZZ #5558, Ward: 10) (Brad Ellis) (Staff Report)
Variance: Steve Shapiro, on behalf of French Meadow Bakery and Café, has applied for a variance to reduce the off-street parking requirement from six parking spaces to zero parking spaces to allow for an expansion to the existing sit-down restaurant located at 2610 Lyndale Ave S.
Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance to reduce the required number of off-street parking spaces from six spaces to zero spaces for the expansion of a sit-down restaurant in an existing building for the property located at 2610 Lyndale Ave S in the C4 General Commercial District, subject to the following condition of approval:
1.     Bicycle racks shall be provided to accommodate no fewer than eleven (11) bicycles on the property and shall meet the minimum requirements for short term bicycle parking. The bicycle parking may be located in the public right-of-way with permission of the city engineer.
7.  221 Franklin Avenue West (BZZ #5561, Ward: 6) (Tom Leighton) (Staff Report)
Variance: Leroy E Broberg and G T Hoehn have applied for a variance to reduce the minimum required front yard setback along Pleasant Ave from the required 15 feet to 0 feet for a parking lot for a six unit building on a reverse corner lot located at 221 Franklin Ave W.
Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the Board of Adjustment adopt the findings and deny the variance to reduce the minimum required front yard setback along Pleasant Ave from the required 15 feet to 0 feet for a parking lot for a six unit building on a reverse corner lot, and in lieu thereof approve a variance to reduce the minimum required front yard setback along Pleasant Ave from the required 15 feet to 7 feet for the proposed turnaround area and to 12’-6” for the parking spaces, for a parking lot for a six unit building on a reverse corner lot located at 221 Franklin Ave W, subject to the following condition of approval:
1.    The landscaping plan shall meet the landscaping and screening requirements of Section 530.170 of the zoning code, subject to review and approval of CPED-Planning staff.
8.  3948 40th Avenue South (BZZ #5541, Ward: 12) (Shanna Sether) (Staff Report)
Variance: Scott Rajavouri of Titus Contracting, on behalf of Ziyad Al-Rashid, has applied for a variance to reduce the minimum north interior side yard setback from 5 feet to 2 inches to allow for a new egress window well accessory to an existing single-family dwelling located at 3948 40th Ave S in the R1A Single-Family District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and deny the variance to reduce the north interior side yard requirement from 2 feet to approximately 2 inches to allow an egress window well that was installed accessory to an existing single-family dwelling located at 3948 40th Ave S in the R1A Single-Family District.
9.  4116 Vincent Avenue South (BZZ #5534, Ward: 13) (Shanna Sether) (Staff Report)
A. Variance: Pam Jewson and Peter Swenson have submitted a variance to reduce the minimum required front yard setback along Vincent Ave S from approximately 36 feet 6 inches to approximately 1 foot 9 inches to allow for a new pergola over an existing roof-top deck atop an existing attached garage located at 4116 Vincent Ave S in the R1 Single-Family District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Zoning Board of Adjustment adopt the findings and deny the variance to reduce the minimum required front yard setback along Vincent Ave S from approximately 36 feet 6 inches to approximately 10 feet to allow for a new pergola over an existing roof-top deck atop an existing attached garage for the property located at 4116 Vincent Ave S in the R1 Single-Family District.
B. Variance: Pam Jewson and Peter Swenson have submitted a variance to reduce the minimum required north interior side yard setback from 6 feet to approximately 1 foot 9 inches to allow for a new pergola over an existing roof-top deck atop an existing attached garage located at 4116 Vincent Ave S in the R1 Single-Family District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Zoning Board of Adjustment adopt the findings and deny the variance to reduce the minimum required north interior side yard setback from 6 feet to approximately 1 foot 9 inches to allow for a new pergola over an existing roof-top deck atop an existing attached garage for the property located at 4116 Vincent Ave S in the R1 Single-Family District.
