1.  1927 Washington Street NE (BZZ-5538, Ward: 1) (Shanna Sether) (Staff Report)
A. Variance: Application by Jim Stremel for a variance to reduce the minimum required front yard setback along Washington St NE from 20 feet to approximately 8 feet 6 inches to allow a new open front porch accessory to an existing duplex located at 1927 Washington St NE in the R2B Two-Family District on a reverse corner lot.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Zoning Board of Adjustment adopt the findings and approve the variance to reduce the minimum required front yard setback along Washington St NE from 20 feet to approximately 8 feet 6 inches to allow for a new open front porch located at 1927 Washington St NE in the R2B Two-Family District, subject to the following conditions:
1. The second floor of the porch shall have guardrails only, not to exceed 3 feet in height or be more than 50 percent opaque.
2. The finish of the porch shall match the finish of the dwelling or the trim on the dwelling.
3. Raw or unfinished lumber shall not be permitted on an open front porch.
B. Variance: Application by Jim Stremel for a variance to reduce the minimum required front yard setback along 20th Ave NE from 20 feet to approximately 15 feet for property located at 1927 Washington St NE in the R2B Two-Family District on a reverse corner lot.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Zoning Board of Adjustment adopt the findings and approve the variance to reduce the minimum required front yard setback along 20th Ave NE from 20 feet to approximately 15 feet to allow for a new open front porch located at 1927 Washington St NE in the R2B Two-Family District, subject to the following condition:
1. The second floor of the porch shall have guardrails only, not to exceed 3 feet in height or be more than 50 percent opaque.
2. The finish of the porch shall match the finish of the dwelling or the trim on the dwelling.
3. Raw or unfinished lumber shall not be permitted on an open front porch.
2.  109 and 215 27th Ave NE (BZZ-5519, Ward: 1) (Janelle Widmeier) (Staff Report)
A. Variance: Application by Lance Elliott with Elliot Design, on behalf of Consolidated Container Company, for a variance of the surfacing requirements for parking areas for the property located at 109 and 215 27th Ave NE.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance of the surfacing requirements for parking areas for the property located at 109 and 215 27th Ave NE, subject to the following conditions:
1. Parking areas shall comply with the screening and landscaping requirements of 541.360 of the zoning code.
2. Boulders or bollards shall be installed adjacent to the rain gardens to define the parking area and restrict vehicle access.
3. Department of Community Planning and Economic Development—Planning Division staff review and approval of the final site and landscaping plan.
4. Site improvements required by the zoning code or by the Zoning Board of Adjustment shall be completed by May 3, 2013, or the permit may be revoked for non-compliance.
3.  3844 Washburn Ave S (BZZ-5531, Ward: 13) (Becca Farrar) (Staff Report)
A. Variance: Application by Anne Herwig for a variance to allow for the construction of a new porch in the established front yard along the east property line adjacent to Washburn Ave S. The porch as proposed would extend 8 feet into the required front yard, which is greater than the 6 feet allowance outlined in the Zoning Code. The specific variance request would be from the established 33 feet to 25 feet to allow an open porch. The property is zoned R1 (Single-family) District and is located at 3844 Washburn Ave S.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance application to allow a reduction in the established front yard setback requirement along the east property line from approximately 33 feet to approximately 25 feet in order to allow a new open porch that extends 8 feet instead of the allowable 6 feet into the required yard on the property located at 3844 Washburn Ave S subject to the following conditions of approval:
1. The finish of the porch must match the finish of the dwelling or the trim on the dwelling.
2. The open porch shall meet all other criteria as outlined in Chapter 535 of the Zoning Code.
4.  3700 Nicollet Ave (BZZ-5536, Ward: 8) (Becca Farrar) (Staff Report)
A. Variance: Application by PCNF Nicollet Housing, L.P., on behalf of Nicollet Square and Butter Bakery Café, to amend a previously approved variance application that allowed for an increase in the size of the neighborhood serving retail sales and services use within the building located at 3700 Nicollet Ave, in order to remove the condition of approval pertaining to a maximum of 30 seats within the proposed coffee shop/delicatessen.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the above findings and approve the variance application to amend a previously approved variance application that allowed for an increase in the size of the neighborhood serving retail sales and services use within the building, by removing the condition of approval pertaining to a maximum of 30 seats within the proposed coffee shop/delicatessen on the property located at 3700 Nicollet Ave.
B. Variance: Application by PCNF Nicollet Housing, L.P., on behalf of Nicollet Square and Butter Bakery Café, for a variance to allow more than 30 seats within the coffee shop/delicatessen. The applicant proposes a total of 66 seats, 50 indoor and 16 outdoor for the property located at 3700 Nicollet Ave.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance application to allow a total of 66 seats, 50 indoor and 16 outdoor for the proposed coffee shop/delicatessen on the property located at 3700 Nicollet Ave subject to the following conditions of approval:
1. The maximum capacity shall be 66 seats which includes no more than 50 indoor seats and no more than 16 outdoor seats.
2. All outdoor seating shall be located along Nicollet Ave.
3. No outdoor seating shall be provided along W 37th St.
C. Variance: Application by PCNF Nicollet Housing, L.P., on behalf of Nicollet Square and Butter Bakery Café, for a variance of the enclosed building requirement in order to allow outdoor seating in the OR2 (High Density Office Residence) district for property located at 3700 Nicollet Ave.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the variance application of the enclosed building requirement in order to allow outdoor seating in the OR2 (High Density Office Residence) district on the property located at 3700 Nicollet Ave subject to the following conditions of approval:
1. All outdoor seating shall be located along Nicollet Ave and there shall be no more than 16 outdoor seats. No outdoor seating shall be permitted after 9pm daily.
2. No outdoor seating shall be provided along West 37th Street.
3. The coffee shop/delicatessen shall comply with the applicable Specific Development Standards as outlined in Chapter 536.20 of the Zoning Code. Specifically, the premises, all adjacent street, sidewalks and alleys, and all sidewalks and alleys within one hundred (100) feet shall be inspected regularly for purposes of removing any litter found thereon.
5.  1001-13 Nicollet Mall and 81-87 10th St S (BZZ-5532, Ward: 7) (Hilary Dvorak) (Staff Report)
A. Variance: Application by John Montgomery with Ryan Companies US, Inc, on behalf of Target Corporation, for a variance of the Nicollet Mall Overlay District standards requiring Retail Sales and Services uses or Food and Beverage uses to occupy at least 60 percent of the gross floor area of the first floor of the building and 60 percent of the first floor façade fronting on Nicollet Mall. The applicant is not proposing to have Retail Sales and Services uses or Food and Beverage uses in the building located at 1001-13 Nicollet Mall and 81-87 10th St S.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Zoning Board of Adjustment adopt the findings and approve the variance of the Nicollet Mall Overlay District standards requiring Retail Sales and Services uses or Food and Beverage uses to occupy at least 60 percent of the gross floor area of the first floor of the building and 60 percent of the first floor façade fronting on Nicollet Mall. The applicant is not proposing to have Retail Sales and Services uses or Food and Beverage uses in the building located at 1001-13 Nicollet Mall and 81-87 10th Street South subject to the following conditions:
1. A minimum of 40 percent of the first floor windows located along Nicollet Mall and 10th Street South shall allow views into and out of the building at eye level. Shelving, mechanical equipment or other similar fixtures shall not block views into and out of the building in the area between four (4) and seven (7) feet above the adjacent grade.
2. The first floor windows shall have clear or lightly tinted glass with a visible light transmittance ratio of six-tenths (0.6) or higher.
