1.   1811 Taylor St NE (BZZ-5459, Ward: 1) (John Smoley) (Staff Report)
Variance: Application by Mike Lindor for a variance to reduce the required front yard setback along Taylor St NE from the setback established by connecting a line from the front of two adjacent homes to 25 feet, to construct a new single family dwelling located at 1811 Taylor St NE in the R2B Two Family District.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve a variance to reduce the required front yard setback along Taylor St NE from the setback established by connecting a line from the front of two adjacent homes to 25 feet, to construct a new single family dwelling and related features located at 1811 Taylor Street Northeast in the R2B Two Family District subject to the following conditions:
1.      Increase the window area on the first floor of the left elevation and the second floor of the right elevation to meet the minimum 5% requirement (Zoning Code section 535.90(c)).
2.      Preserve or mitigate for the loss of all trees 12” in diameter at breast height (measured at 4.5’ above grade) or larger (Zoning Code section 535.300). 
3.      Ensure any proposed air conditioning units comply with Zoning Code table 535-1 by either:
a.      Keeping any proposed freestanding air conditioning unit out of the required front and side yards; or
b.      Demonstrating that any freestanding AC unit in the side yard is no higher than 4 feet and demonstrating that the adjacent home has no windows or doors in the wall facing the proposed AC unit; or
c.      Demonstrating that any proposed side yard AC unit is no higher than 4 feet and submitting a letter from the adjacent property owner indicating that they have central air and understand that the proposed mechanical equipment will be located next to their home.
4.      Final site and elevation plans must be approved by CPED-Planning staff.
2.   509-513 1st Ave NE (BZZ-5479, Ward: 3) (Janelle Widmeier) (Staff Report)
Variance: Application by Anne Saxton to amend a sign variance that was granted for a projecting sign to remove the condition of approval not allowing any other projecting or wall signs to be installed for the business for the property located at 509-513 1st Ave NE to allow additional signage for the Red Stag Supperclub.
Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the Board of Adjustment adopt the findings and approve the amendment to the previously granted sign variance for a projecting sign to remove the condition of approval not allowing any other projecting or wall signs to be installed for the business for the property located at 509-513 1st Ave NE to allow additional signage for the Red Stag Supperclub, subject to the following condition:
1.      Not more than 75 square feet of signage shall be allowed on the 1st Avenue Northeast building wall for this business or future occupants of this tenant space.
