Public Hearings

1. Downtown Business Improvement Special Service District:
a) Approve operating plan which includes special services and budget cost estimates in the total amount of $6,187,500 for 2010;
b) Approve service charges and the lists of service charges (assessments) in the total amount of $6,113,145.05 for 2010;
c) Direct the City Clerk to transmit certified copies of the lists of service charges to the Hennepin County Auditor; and
d) Direct the City Engineer to proceed with the work.

2. Chicago-Lake, Bloomington-Lake, and East Lake Special Service Districts:
a) Approve the special services and the budget cost estimates in the total amount of $113,750 for 2010;
b) Approve service charges and the lists of service charges (assessments) in the total amount of $106,430 for 2010;
c) Direct the City Clerk to transmit certified copies of the lists of service charges to the Hennepin County Auditor; and
d) Direct the City Engineer to proceed with the work.

3. Progressive Bicycle Cities Coalition:
a) Accept donation for travel expenses and related events from the City of Portland and Mia Birk for a bicycle delegate to attend the Progressive Bicycle Cities Coalition Gathering in Portland, Oregon, to be held October 1-3, 2009; and
b) Authorize the proper City officers to designate a Public Works employee to represent the City on this trip.

4. Critical Traffic and Parking Area:
Adopt the findings and approve a "Type A" Critical Traffic and Parking Area (2 Hour Parking, 8:00 am to 5:00 pm Daily, Except by Permit), on the 3300 block of Prospect Terrace (south side).

5. Lease of City-Owned Office Space (709 2nd St S):
a) Rescind Council action of August 8, 2008, executing a six-year lease with Froisatoni, LLC for office space in the Mill Quarter Municipal Parking Ramp, due to tenant forming the corporation under a different name; and
b) Authorize the negotiation and execution of a five-year lease, to include renewal options, with Froid Holdings, LLC for office and storage space in the Mill Quarter Municipal Parking Ramp. Revenue from the lease will be deposited into the Parking Fund.

6. Pump Station No. 4 Renovation:
Approve increase to contract with Madsen-Johnson Corporation, in the estimated amount of $460,145.22, for construction change orders to allow for work not included in the original scope of the contract. Funds are available within the existing project budget.

7. Dewatering Plant Improvements Project:
Increase the scope of services in the engineering services agreement with HDR Engineering, Inc. by $470,000 to allow for work outside the requested scope of the agreement and/or added value to the project. No additional appropriation required.

8. Bid:
OP 7176, Accept low bid of W.W. Goetsch Associates, Inc., in the amount of $124,800, to furnish and deliver submersible sludge pumps to the Water Works Division.

9. Special Service Districts:
Set a public hearing to be held on October 20, 2009, to consider the proposed services and service charges for 2010 for the Uptown (Hennepin-Lake), Dinkytown, Central Ave, Stadium Village, Nicollet Ave S, S Hennepin Ave, Riverview, 48th St E and Chicago Ave S, and Linden Hills (43rd St W and Upton Ave S) Special Service Districts, and direct staff to give notice of the public hearing.

Items 14 & 15 Action Taken: Postponed. Staff directed to work with the Chair of the T&PW Committee and Council Member Johnson and report back to Committee with a plan for a Work Group to study the City’s Labor Peace Resolution and the current responsible bidder policy as well as the proposal to expand the policy.

15. Solid Waste and Recycling Collection:
Adopt a Resolution of Intent to elect to exercise the option to further organize solid waste and recycling collection within the City by considering the expansion of organized collection to include residential properties with more than four (4) units, commercial properties, and properties in the downtown core, and to follow the process and procedures set out in Minnesota Statutes, Section 115A.94, Subd. 4.

16. Hiawatha Trail Connection Project:
Contingent upon Transit for Livable Communities (TLC) approval of $460,000 in additional federal grant funding for the Hiawatha Trail Connection Project:
a) Approve resolution committing support of a 2010 capital appropriation that includes $267,000 for the Hiawatha Trail Connection Project;
b) Authorize the proper City officers to execute Interagency Agreements with Mn/DOT for federal participation in the project; and
c) Authorize the proper City officers to negotiate and acquire trail easements/use permits for the project.
