Consent

1. License Applications:

Grant Licenses recommended for approval.

Action Taken: Approved.

2. C-Gas Stop (2606 Penn Av N):

Approve Business License Operating Conditions relating to Grocery, Tobacco, Food Manufacturer, and Gasoline Filling Station Licenses.

Action Taken: Approved.

3. Rental Dwelling License at 2732 Bloomington Av:

Approve license reinstatement to be held by Gallop Solutions, Tom & Becky Bohlen.

Action Taken: Approved.

4. Minneapolis Tree Advisory Committee:

Designate Robin Garwood as the City Council's representative to the Committee; and Shannon McDonough as an alternate.

Action Taken: Approved.

5. Resolution sponsoring Good Jobs, Green Jobs: National Green Job Conference.

Action Taken: Approved.

6. Traffic Control:

a. Ordinance amending Title 1, Chapter 2 of the Minneapolis Code of Ordinances relating to General Provisions: Administrative Enforcement and Hearing Process, amending sections 2.20 and 2.50 to authorize Traffic Control Agents to issue administrative citations and clarifying the manner in which parking code citations should be issued (Glidden).

b. Ordinance amending Title 18, Chapter 478 of the Minneapolis Code of Ordinances relating to the Traffic Code: Parking, Stopping and Standing, adding a new section relating to Traffic Control Agent Service Fees and establishing these fees in the Director’s Fee Schedule, to include an hourly traffic control agent fee and a separate overtime fee if required (Glidden).

c. Ordinance amending Title 5, Chapter 91 of the Minneapolis Code of Ordinances relating to Building Code: Permit Fees, including Traffic Control Agent service fees in the Director’s Fee Schedule (Glidden).

Action Taken: Public hearing set for April 5th Meeting.

7. Public Markets:

Subject matter of an ordinance amending Title 10, Chapter 201 of the Minneapolis Code of Ordinances relating to Food Code: Public Markets, amending the definition of public market to allow a public market to be indoors or outdoors (Schiff).

Action Taken: Ordinances sent forward to City Council without recommendation. Staff directed to meet with stakeholders before Committee of the Whole to determine next steps.

8. Recycling:

a. Subject matter of an ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, making compliance with Title 11, Chapter 225, Article VI relating to recycling at buildings having two or more dwelling units a licensing standard (Gordon).

b. Subject matter of an ordinance amending Title 11, Chapter 225 of the Minneapolis Code of Ordinances relating to Health and Sanitation: Garbage and Refuse, amending notice, enforcement, and penalty provisions relating to recycling at buildings having two or more dwelling units (Gordon). (Also in T&PW)

Action Taken: Approved.

9. Sidewalk Cart Vendors: Subject matter of the following ordinances revising regulations relating to sidewalk cart vendors, including sidewalk cart food vendors and mobile food vendors:

a. Amending Title 17 of the Minneapolis Code of Ordinances relating to Streets and Sidewalks, as follows:

Chapter 427 relating to Streets and Sidewalks: In General;
Chapter 430 relating to Streets and Sidewalks: Right-of-Way Permits;
Chapter 439 relating to Streets and Sidewalks: Nicollet Mall;
Chapter 442 relating to Streets and Sidewalks: Downtown Special Service District;
Chapter 448 relating to Streets and Sidewalks: Nicollet Avenue South Special Service District; and
Chapter 465 relating to Streets and Sidewalks: Downtown Business Improvement Special Service District. (Goodman)

Action Taken: Ordinances returned to author.

b. Amending Title 10 of the Minneapolis Code of Ordinances relating to Food Code, as follows:
Chapter 186 relating to In General;

Chapter 188 relating to Administration and Licensing. (Goodman)

Action Taken: Ordinances sent forward without recommendation to City Council, to include an effective date of May 1, 2010. Staff directed to report back with a proposal for a Task Force, to include a plan for recycling.

c. Amending Title 13, Chapter 259 of the Minneapolis Code of Ordinances relating to Licenses and Business Regulations: In General. (Goodman).

Action Taken: Ordinances returned to author.

Quasi-Judicial Hearing

10. Rental Dwelling License at 2939 Lyndale Av N:

Director of Inspections recommendation to revoke license held by Aaron & Mary Durkop.

Action Taken: Approved license revocation.

11. Sewer Access Charges:

Rescind Resolution 2004R-473 establishing sewer service availability and connection charges and approve a new resolution removing the three-year sunset clause and including business licenses as a method of collection for sewer service availability and connection charges. (Also in T&PW)

Postponed 1/21/2010.

12. Drainage:

Subject matter of an ordinance amending Title 3, Chapter 52 of the Minneapolis Code of Ordinances relating to Air Pollution and Environmental Protection: Erosion and Sediment Control for Land Disturbance Activities, including enforcement language to deal with drainage complaints (Schiff).
