1. License Applications:

Grant Licenses recommended for approval.

Action Taken: Approved, as amended
(Sent forward without recommendation Motor Vehicle Repair Garage License for Ducati Minneapolis, 2800 Lyndale Av S; and Approved Liquor License for The Melting Pot Restaurant, 80 S 9th St).

2. Tacqueria Los Ocampo (809 E Lake St):

Application for Special Late Hour Food License to serve food from 2:00 a.m. to 5:00 a.m. Thursday to Sunday.

Action Taken: Approved.

3. Rental Dwelling License at 4007 Emerson Av N:

Approve license reinstatement to be held by AAA North Properties, LLC, Sean Maynard.

Action Taken: Approved.

4. Citizen Environmental Advisory Committee:

Approve City Council appointment of Marty Broan, representing Conservation Minnesota, to fill the unexpired term of Karen Monahan to expire December 31, 2010.

Action Taken: Approved.

5. Earth Hour 2010:

Resolution supporting Earth Hour on March 27, 2010 from 8:30 to 9:30 p.m.

Action Taken: Approved.

6. Drainage:

Subject matter of an ordinance amending Title 3, Chapter 52 of the Minneapolis Code of Ordinances relating to Air Pollution and Environmental Protection: Erosion and Sediment Control for Land Disturbance Activities, including enforcement language to deal with drainage complaints (Schiff).

7. Waste Tire Programs:

Subject matter of an ordinance amending Title 3, Chapter 48 of the Minneapolis Code of Ordinances relating to Air Pollution and Environmental Protection: Minneapolis Watershed Management Authority, amending Section 48.20 to include Minnesota Rules, Chapter 9220 relating to Waste Tire Programs to allow for the enforcement of record keeping requirements of tire retailers as well as Minnesota Pollution Control Agency Identification requirements of tire haulers (Glidden).

Action Taken: Approved.

8. Director, Regulatory Services:

Mayor's nomination and recommendation of Executive Committee to appoint Rocco Forte for a term to expire January 2, 2012.

Action Taken: Approved.

Discussion

9. Technology Replacement Plan:

Approve updated funding plan for technology replacement project and approve related transfers of expense appropriation, when authorized by the Assistant City Coordinator, Regulatory Services & Emergency Preparedness, as needed to implement the plan. Direct Department Heads of departments that will use the new land management system or KIVA replacement system to identify and implement methods of providing funding for their adaption and usage of the new system. (Refer to W&M/Budget)

Action Taken: Referred to Information Services Policy Study Group (ISPSG).

10. Administrative Fine Schedule:

Approve revised schedule of fees. (Refer to W&M/Budget)

11. Sidewalk Cart Vendors: Subject matter of the following ordinances revising regulations relating to sidewalk cart vendors, including sidewalk cart food vendors and mobile food vendors:

a. Amending Title 17 of the Minneapolis Code of Ordinances relating to Streets and Sidewalks, as follows:

Chapter 427 relating to Streets and Sidewalks: In General;
Chapter 430 relating to Streets and Sidewalks: Right-of-Way Permits;
Chapter 439 relating to Streets and Sidewalks: Nicollet Mall;
Chapter 442 relating to Streets and Sidewalks: Downtown Special Service District;
Chapter 448 relating to Streets and Sidewalks: Nicollet Avenue South Special Service District; and
Chapter 465 relating to Streets and Sidewalks: Downtown Business Improvement Special Service District. (Goodman)

12. 3111 Dupont Av N:

Nuisance Condition Process Review Panel recommendation to uphold the Director’s Order to demolish the property.

Action Taken: Approved demolition.

13. Rental Dwelling License at 3538 Dupont Av N:

Director of Inspections recommendation to revoke license held by Kevin Sheeley.

Action Taken: Approved license revocation; City Attorney's Office directed to draft Findings of Fact.

14. Rental Dwelling License at 3245 Fremont Av N:

Director of Inspections recommendation to revoke license held by Troy F. Hayden.

Action Taken: Approved license revocation; City Attorney's Office directed to draft Findings of Fact.

15. Sewer Access Charges:

Rescind Resolution 2004R-473 establishing sewer service availability and connection charges and approve a new resolution removing the three-year sunset clause and including business licenses as a method of collection for sewer service availability and connection charges. (Also in T&PW)

16. Public Markets:

Subject matter of an ordinance amending Title 10, Chapter 201 of the Minneapolis Code of Ordinances relating to Food Code: Public Markets, amending the definition of public market to allow a public market to be indoors or outdoors (Schiff).

17. Recycling:

a. Subject matter of an ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, making compliance with Title 11, Chapter 225, Article VI relating to recycling at buildings having two or more dwelling units a licensing standard (Gordon).

b. Subject matter of an ordinance amending Title 11, Chapter 225 of the Minneapolis Code of Ordinances relating to Health and Sanitation: Garbage and Refuse, amending notice, enforcement, and penalty provisions relating to recycling at buildings having two or more dwelling units (Gordon).
