Consent

1. License Applications:

Grant Licenses recommended for approval.

Action Taken: Approved, as amended.

2. Highland Market (2600 Central Av NE):

Approve Business License Operating Conditions relating to Grocery, Meat Market and Tobacco Licenses.

Action Taken: Approved.

3. 22nd Avenue Station (2121 University Av NE):

Approve License Settlement Conference recommendations relating to On-Sale Liquor Class A with Sunday Sales License.

Action Taken: Approved.

4. Picosa Restaurant (65 SE Main St):

Approve License Settlement Conference recommendations relating to On-Sale Liquor Class B with Sunday Sales License.

Action Taken: Approved.

5. Minneapolis Economic Recovery Strategy - Energy Loan Programs:

a. Authorize submit application to Minnesota Department of Commerce, Office of Energy Security, seeking a $500,000 grant to establish a revolving loan fund to finance energy upgrades and improvements for commercial, industrial, and/or nonprofit facilities in the City.

b. Authorize staff to make such modifications as indicated by further guidance by the Department of Commerce. (Also in Comm Dev)

Action Taken: Approved.

Public Hearing

6. Savoy Uptown (2329 Hennepin Av):

Application for On-Sale Wine Class C-2 with Strong Beer License.

Action Taken: Sent forward to City Council without recommendation.

Discussion

7. Director's Fee Schedule:

Amend schedule to change "Elevator-Annual Registration" to "Elevator-Annual Registration and Inspection"; and Approve fee increases. (Refer to W&M/Budget)

Action Taken: Approved.

Quasi-Judicial Hearings

8. Rental Dwelling License at 3654 Russell Av N:

Recommend revocation of Rental Dwelling License held by Anthony Okafor.

Action Taken: License denied for at least six months; Reinstatement process to be fully complied with before a new license is issued.

9. Rental Dwelling License at 607 Erie St SE:

Request by licensee for stay of Council's decision to revoke the rental dwelling license.

Action Taken: Denied. City Attorney directed to draft Findings of Fact.

10. Rental Dwelling License at 729 E 16th St:

Request by licensee for stay of all further enforcement proceedings and all derivative notice and revocation matters relating to rental dwelling license.

Action Taken: Denied stay relating to property 729 E 16th Street. Granted stay relating to imposition of additional revocation actions for other properties owned by the licensee. City Attorney directed to draft Findings of Fact.

11. Public Markets:

Subject matter of an ordinance amending Title 10, Chapter 201 of the Minneapolis Code of Ordinances relating to Food Code: Public Markets, amending the definition of public market to allow a public market to be indoors or outdoors (Schiff).

Action Taken: Set public hearing for March 22nd Meeting.

12. Arsenic Testing:

Ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, granting the City the authority to recommend revocation of a rental license upon refusal by a licensee to cooperate with the State EPA contamination cleanup order on a residential rental lot (Schiff).

Action Taken: Set public hearing for February 18th Meeting.

13. Sidewalk Cart Vendors:

Subject matter of ordinances amending Title 10 of the Minneapolis Code of Ordinances relating to Food Code, revising regulations relating to sidewalk cart vendors, including sidewalk cart food vendors and mobile food vendors (Goodman), as follows:
a) Amending Chapter 186 relating to In General;
b) Amending Chapter 188 relating to Administration and Licensing.

Action Taken: Set public hearing for March 1st Meeting.

14. Sidewalk Cart Vendors:

Subject matter of an ordinance amending Title 13, Chapter 259 of the Minneapolis Code of Ordinances relating to relating to Licenses and Business Regulations: In General, revising regulations relating to sidewalk cart vendors, including sidewalk cart food vendors and mobile food vendors (Goodman).

Action Taken: Set public hearing for March 1st Meeting.

15. Sewer Access Charges:

Rescind Resolution 2004R-473 establishing sewer service availability and connection charges and approve a new resolution removing the three-year sunset clause and including business licenses as a method of collection for sewer service availability and connection charges. (Also in T&PW)

16. Property at 3121 Columbus Av:

a. Subject matter of bid for demolition of structure.
b. Consider July 31, 2009 Council Action ordering demolition of structure.

17. Recycling:

a. Subject matter of an ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, making compliance with Title 11, Chapter 225, Article VI relating to recycling at buildings having two or more dwelling units a licensing standard (Gordon).

b. Subject matter of an ordinance amending Title 11, Chapter 225 of the Minneapolis Code of Ordinances relating to Health and Sanitation: Garbage and Refuse, amending notice, enforcement, and penalty provisions relating to recycling at buildings having two or more dwelling units (Gordon).

T&PW Action 1/19/2010: Subject matter postponed. Staff directed to investigate and propose changes to support the city’s ability to enforce recycling requirements in buildings having four (4) or more units, unless they are part of a mixed-use development.

RE&E Action Taken: Postponed two cycles (February 18th Meeting).
