Consent Items

1. License Applications:

Grant Licenses recommended for approval.

Action Taken: Approved, as amended.
(Postponed #10 Club Spin/ClubCream/Club New York; and Sent forward to City Council without recommendation #71 44 Degrees)

2. Main Street Food Market (3653 Chicago Av):

Approve business operating conditions relating to Grocery License.

Action Taken: Approved.

3. Sushi Tango (3011 Hennepin Av):

Approve business operating conditions relating to On-Sale Liquor

Action Taken: Approved.

4. Cedar Country Boy (4164 Cedar Av):

Approve License Settlement Conference recommendations relating to Off-Sale Beer License.

Action Taken: Approved.

5. 8th Street Grill & Tavern (800 Marquette Av):

Approve License Settlement Conference recommendations relating to On-Sale Liquor Class C-1 with Sunday Sales License.

Action Taken: Approved revised agreement.

6. Zipp’s Liquor (2618 E Franklin Av):

Approve License Settlement Conference recommendations relating to Off-Sale Liquor License.

Action Taken: Approved.

7. Homeland Security Grant:

Execute amendment #2 to grant agreement with Minnesota Department of Public Safety to extend the grant period for satisfactory completion of the project to prevent, protect against, respond to and recover from terrorist attacks, major disasters and other emergencies. (Refer to W&M/Budget)

Action Taken: Approved.

8. Bid for Weed Cutting:

OP #7133, accept low bid of Over the Top Inc to provide weed cutting and related services for a 12 month period beginning in 2009 ($65,000).

Action Taken: Approved.

9. National Association of County and City Health Officials Advance Practice Center Grant:

Extend agreement with Hennepin County to proceed with grant activities relating to planning responses to potential threats to food, water and safety during a disaster or public health emergency; and Approve appropriation of $136,489. (Refer to W&M/Budget)

Action Taken: Approved.

10. Rental Dwelling License at 3130 Pillsbury Av S:

Approve license reinstatement to be held by Franklin National Bank, Albert Alexander, Vice President.

Action Taken: Approved.

11. Fitness Memberships:

Issue Request for Proposals to sworn personnel in the Police and Fire Departments. (Refer to W&M/Budget)

Action Taken: Approved.

12. Health Testing:

Amend contract with Med Compass to provide mandatory health testing of Fire personnel.

Action Taken: Approved.

13. Mounted Patrol:

Execute multi-year agreement with Horsemen Inc for horse boarding services ($62,000 for 2009). (Refer to W&M/Budget)

Action Taken: Approved.

14. Domestic Violence:

Extend and increase sub-recipient contracts with the Domestic Abuse Project, Casa de Esperanza and Asian Women United of Minnesota to reallocate funding within the grant budget relating to the grant award from the United States Department of Justice Office of Violence Against Women. (Refer to W&M/Budget)

Action Taken: Approved.

15. Internet Crimes Against Children Task Force:

Execute Joint Powers Agreement with Minnesota Bureau of Criminal Apprehension to participate in task force and accept up to $5,000 for overtime expenses and additional reimbursable travel expenses as approved; and Approve appropriation. (Refer to W&M/Budget)

16. Internal Affairs Unit:

Update report relating to

a. Providing additional interview rooms that are sound resistant for IAU investigations.

b. IAU reporting directly to the Chief of Police.

c. Adopting a mediation program for minor complaints.

Action Taken: Received & Filed Verbal Report.

17. Chapter 249 Property at 2321 Fremont Av N:

Adopt findings of the Nuisance Condition Process Review Panel to uphold the Director’s Order and demolish the property at 2321 Fremont Av N, after consideration of additional information regarding the re-establishment of condition use permit.

Action Taken: Approved demolition.

Hearing

18. Rental Dwelling License at 2222 Emerson Av N:

Director of Inspections recommendation to revoke the license held by Jason White.

Action Taken: Approved revocation.

19. Tropic World Foods (3328 E Lake St):

Deny renewal of Grocery License for failure to pay false alarm fees.

Action Taken: Approved to deny license renewal.

Public Hearings

20. Taxicab Meter Fares:

Ordinance amending Title 13, Chapter 341 of the Minneapolis Code of Ordinances relating to Licenses and Business Regulations: Taxicabs, that Section 341.775 relating to Review of Fares shall become effective on March 1, 2010; and prior to March 1, 2010, the maximum meter fare amounts for mileage charges shall be equal to the amounts as were authorized to be charged on February 28, 2009. (Gordon)

Action Taken: Approved $2.35 rate ordinance (February 28th rates).

21. Vacant Commercial Property Registration:

Subject matter of ordinance amending Title 12, Chapter 249 of Code relating to Housing: Vacant Dwelling or Building, Nuisance Condition, relating to vacant commercial property registration (Samuels; Introduced 8/22/2008).

Action Taken: Approved.

22. Rental Licensing:

a. Ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, amending Section 244.1870 to require a $450 fee for the inspection of a rental dwelling which has a change of ownership. (Johnson).

b. Approve 5 Full-Time Equivalent positions to implement the change of ownership inspection.

c. Approve appropriation of $612,000. (Refer to W&M/Budget)

Action Taken: Approved.

23. Rental Licensing:

Ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, as follows:

a. Adding a new Section 244.265 entitled Tenant to be notified of mortgage foreclosure or cancellation of contract for deed, requiring that the tenant be notified of mortgage foreclosure or cancellation of a contract for deed.

b. Section 244.1910, including as a new rental housing licensing standard that if an owner has a second offense operating a rental without a license, it may be grounds to revoke all licenses held by the owner or where the owner has an interest in a rental property for a period of 24 months.

c. Section 244.1910, including new rental housing licensing standards related to the notification requirement to tenants of mortgage foreclosure or cancellation of a contract for deed may be grounds to revoke the rental license.

d. Section 244.1945, relating to revocation cost recovery for the City when a rental dwelling license is revoked and the same owner is obtaining a license reinstatement, the fee will remain at $1,000. (Samuels) (Refer to W&M/Budget)

24. Rental Licensing:

Ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, repealing Section 244.1950 entitled Rental Dwelling license board of appeals; and amending Section 244.1960 to shift from a citizen board to an administrative hearing process when the Director recommends denial, non-renewal, revocation or suspension of a rental license. (Schiff)

Action Taken: Approved.

25. OM (401 1st Av N Suite #100):

Application for On-Sale Liquor Class E with Sunday Sales License; and State issued 2:00 a.m. Permit.

Action Taken: Approved.

26. Palmer’s Bar (500 Cedar Av):

Application for On-Sale Liquor Class B with Sunday Sales License.

Action Taken: Sent forward to City Council without recommendation.

27. Floating World (2629 E Lake St):

Application for On-Sale Wine Class E with Strong Beer License.

Action Taken: Approved.

Postponed Item

28. Police Mounted Patrol Horse Barn Facility:

Report back with a final recommendation as to the siting of the Mounted Patrol Horse Barn Facility.

Action Taken: Postponed.
