Consent Items

1. License Applications:

Grant Licenses recommended for approval.

Action Taken: Approved.

2. Obento Ya Japanese Bistro (1510 Como Av S):

Grant Wine with Strong Beer License, subject to conditions.

Action Taken: Approved.

3. Super America #4378 (2445 Bloomington Av):

Grant Grocery, Tobacco Dealer, Food Manufacturer, Gasoline Filling Station, and Off-Sale 3.2% Beer Licenses, subject to conditions.

Action Taken: Approved, as amended.

4. M & S Grill (50 S 6th St):

Approve License Settlement Conference recommendations relating to On-Sale Liquor Class E with Sunday Sales License.

Action Taken: Approved.

5. OP #6917, Bid for Refurbishing Ambulance Vehicle:

Accept bid of Sartin Services for labor and materials to refurbish ambulance vehicle for Fire Department ($208,505). (Refer to W&M/Budget)

Action Taken: Approved.

6. Rental Dwelling License Board of Appeals:

a. Approve appointments and reappointments of
Kerry Hinze; Genevieve Gaboriault; M. Cecilia Rodriguez-Melendez
Steven Schachtman; Daisy Barton; Wayne Jenson; and Brian Bushay.
b. Authorize waiver from residency requirement for Steven Schachtman; Daisy Barton; and Genevieve Gaboriault.

Action Taken: Approved.

7. Staffing:

Increase 2 Full-Time Equivalent positions to support Problem Property Unit.

8. Donation to State of Minnesota:

Authorize donate railroad tank car to State of Minnesota for emergency preparedness training purposes; and Execute necessary agreement.

Public Hearings

9. No/Low Heat in Rental Dwellings (1:15 pm):

Subject matter of an ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, changing the mechanism for enforcing no or low heat in rental units from outside temperature to calendar dates (Remington and Gordon).

Action Taken: Postponed two cycles (May 7th). Regulatory Services staff directed to review the energy consumption consequences of the ordinance, as well as the City’s own policies and procedures for responding to complaints. Health Department staff is directed to provide financial costs associated with the affect on children exposed to low temperatures for periods of time.

10. Musashi Japanese Restaurant (12 S 6th St):

Application for On-Sale Liquor Class B with Sunday Sales and Sidewalk Cafe Licenses, subject to conditions.

Action Taken: Approved.

11. U Garden Restaurant (2725 University Av SE):

Application for On-Sale Liquor Class A with Sunday Sales License.

Action Taken: Sent forward to City Council without recommendation.

12. Taxicabs:

Subject matter of an ordinance amending Title 13, Chapter 341 of the Minneapolis Code of Ordinances relating to Licenses and Business Regulations: Taxicabs, creating a new Section 341.495 which establishes an event reciprocity license to allow taxicabs licensed in other jurisdictions to provide taxicab services during times of extraordinary need (Schiff).

Action Taken: Public Hearing scheduled for April 23rd Meeting.

13. Pet Licensing:

Subject matter of an ordinance amending Title 4, Chapter 64 of the Minneapolis Code of Ordinances relating to Animals and Fowl: Dogs, Cats, Ferrets, and Rabbits, adding senior and sibling discounts to pet licenses; allowing pet stores and pet daycares to sell licenses; and deleting the provision that requires license tags to be worn (Goodman).

Action Taken: Public Hearing scheduled for April 23rd Meeting.

14. Rental Dwelling License at 1539 E 26th St:

Recommend reinstatement of license to be held by David Klein.

Action Taken: Postponed one cycle (April 23rd).

15. Unisys Contract:

Request to amend the Unisys managed services Contract C-25200 to provide support and maintenance of the "SafeZone" wireless network system; and appropriation Resolution.

16. Chapter 249 Property at 1008 Lowry Av N:

Concur with Nuisance Condition Process Review Panel to stay Order for Demolition to allow execution of Restoration Agreement, subject to conditions.

17. Pet Licensing:

Report detailing the hiring of a staff person dedicated to pet licensing.

Action Taken: Received & Filed Report. Referred to Ways & Means/Budget Committee.

Hearings

18. Johnny A’s (200 W Broadway):

Recommend revocation of On-Sale Liquor Class E with Sunday Sales and
Tobacco Dealer’s Licenses.

Action Taken: Approved revocation of license. City Attorney’s Office directed to draft Findings of Fact for adoption at City Council Meeting. Denied request for stay of adverse license decision, pending appeal.

Discussion Item (Cont’d)

19. Free Speech Work Group:

Presentation.

Action Taken: That in one cycle (April 23rd), the City Attorney’s Office be directed to provide an assessment of legal issues regarding possible voluntary notification models. That research should include discussing legal causes of action that may arise from adoption and enforcement of the voluntary notification resolution that the Free Speech Work Group has discussed.

20. Towing:

Subject matter of an ordinance amending Title 13, Chapter 349 of the Minneapolis Code of Ordinances relating to Licenses and Business Regulations: Wreckers and Tow Trucks, adding a new Section 349.270 establishing maximum service fees for Class A motor vehicle services (Schiff).

Action Taken 3/5/2008: Postponed. Regulatory Services staff requested to meet with Public Works to further understand comments heard at the public hearing regarding 1) voluntary restriction of hours of operation; and 2) other City ordinance amendments to reduce the number of days that a vehicle must be held before being brought to auction.

Action Taken: Postponed.

21. Dwelling Unit Occupancy (May 7th):

Subject matter of an ordinance amending Title 12, Chapter 244 of the Minneapolis Code of Ordinances relating to Housing: Maintenance Code, resolving differences in regulating the maximum occupancy of dwelling units and mandating disclosure of maximum occupancy of dwelling units to potential tenants (Gordon).

Action Taken: Postponed.

22. Bicycle Safety:

Subject matter of an ordinance amending Title 18 of the Minneapolis Code of Ordinances relating to Traffic Code, ensuring laws protecting the safety of bicyclists, as follows:
a) Chapter 474 relating to Vehicle Operation; and
b) Chapter 490 relating to Bicycles. (Gordon) (Also in T&PW)

Action Taken: Postponed.

23. Markers/Paint Sticks:

Subject matter of an ordinance amending Title 11, Chapter 223 of the Minneapolis Code of Ordinances relating to Health and Sanitation: Drugs, regulating the sale to minors of certain markers and paint sticks (Schiff).

Action Taken: Postponed.

24. Lurking/Loitering:

Subject matter of an ordinance amending Title 15, Chapter 385 of the Minneapolis Code of Ordinances relating to Offenses--Miscellaneous, repealing Section 385.80 entitled Lurking; and amending Section 385.50 entitled Loitering by adding new prohibitions against loitering with the intent to engage in additional criminal acts (Gordon).

Action Taken: Postponed.

25. Retail Sales:

Subject matter of the following ordinances amending Title 13 of the Minneapolis Code of Ordinances relating to Licenses and Business Regulations:
a. Adding a new Chapter 351 entitled Retail Sales Establishments Not Otherwise Licensed, requiring licensure of general retail establishments not otherwise licensed.
b. Adding a new Chapter 352 requiring licensure of commercial rental units. (Johnson)

Action Taken: Postponed.

26. Jail Fees Resolution.

Action Taken: Postponed.
