Public Hearing

1. The Local (931 Nicollet Mall):

Application for On-Sale Liquor Class C-1 with Sunday Sales License
(expansion of premises for expanded sidewalk cafe area).

Action Taken: Approved.

2. Booting:

Ordinance amending Title 13, Chapter 349 of the Minneapolis Code of Ordinances relating to Licenses and Business Regulations: Wreckers and Tow Trucks, adding a new Section 349.270 establishing a maximum service fee for licensees performing Class A Motor Vehicle Service and requiring that licensees performing Class A Motor Vehicle Service accept all forms of payment accepted by the City of Minneapolis impound facility (Goodman).

3. License Fees:

Ordinance amending Appendix J of the Minneapolis Code of Ordinances relating to License Fees Schedule, for first reading and referral to the Public Safety & Regulatory Services Committee (increasing 2007 license fees to account for inflationary increases incurred from 2005 to 2006).

4. Animals:

a. Subject matter of an ordinance amending Title 4, Chapter 62 of the Minneapolis Code of Ordinances relating to Animals and Fowl: In General, eliminating the enforcement of Chapters 64 and 66 by the Department of Health and giving enforcement powers to Minneapolis Animal Care & Control (Samuels).

b. Subject matter of ordinance amending Title 4, Chapter 64 of the Minneapolis Code of Ordinances relating to Animals and Fowl: Dogs, Cats, Ferrets, and Rabbits, eliminating veterinarian partial reimbursement for spaying/neutering and eliminating petty misdemeanor penalty and replacing with an administrative fine; removing $100 fine for not having a pet license and replacing with an administrative fine; creating a $30 annual license fee for both dogs and cats regardless of spay/neuter status; creating a lifetime license with requirements for both dogs and cats; and transferring the authority for animal regulation from the Commissioner of Health and/or Licenses & Consumer Services to Minneapolis Animal Care & Control (Samuels; Referred by City Council 6/30/2006).

6. D’Amico Cucina (100 N 6th St):

Approve Business Licensing Pre-Enforcement Recommendations relating to On-Sale Liquor License.

Action Taken: Approved.

7. Alarmed and Alert Smoke Alarm Program:

Execute agreement with State of Minnesota Department of Health to participate in Program; and Accept $4,000 to reimburse Fire Department for program related costs; and Approve appropriation. (Refer to W&M/Budget)

Action Taken: Approved.

8. Speed Limit Enforcement Program:

Accept $7,200 grant and execute grant agreement with Minnesota Department of Public Safety, State Patrol Division, to reimburse overtime costs to officers for increased enforcement targeting speed violations and other enforcement to reduce accidents; and Approve appropriation. (Refer to W&M/Budget)

Action Taken: Approved.

9. Police Motorcycles:

Execute agreement with Fairbault Harley-Davidson to provide police motorcycles to Department for one year. (Refer to W&M/Budget)

Action Taken: Approved.

10. Underage Drinking:

Accept $3,000 and execute agreement with Minnesota Commissioner of Public Safety to support liquor compliance in Second Precinct for enforcement and investigation to address "party houses" in University of Minnesota area; and Approve appropriation.

11. Rubbish and Refuse Removal:

OP #6400 increase contract with Trades Unlimited for a new two-year expenditure of $400,000 by reallocating $100,000 from existing contracts which have lower expenditures. (Refer to W&M/Budget)

License Hearings

13. Rental Dwelling Licenses at 309 24th Av N; 420 30th Av N; 3627 Lyndale Av N;
2228 Bryant Av N; 3514 Colfax Av N; 2334 Logan Av N; and 4418 Nicollet Av:

Concur with recommendation of Director of Inspections to revoke, deny, non-renew licenses held by Jay Petsche for failure to meet licensing standards, in accordance with Chapter 244 of Code.

Action Taken: Approved revocation, denial and non-renewal of licenses.

14. Divas Gentlemans Club (417 2 nd Av N):

Deny application for Place of Entertainment Class A License.

Action Taken: Approved denial.

15. Safety/Security Cameras:

City Council directive to the City Coordinator to work with the Chief of Police to design a fair and open selection process for the future placement of safety/security cameras. PS&RS will report to the Council within 60 days with a proposed selection process.

Action Taken: Referred directive to staff, with a report back to PS&RS Committee at August 23rd Meeting.

16. Residence Location for Sex Offenders:

Subject matter of ordinance amending Title 15 of the Code relating to Offenses--Miscellaneous by adding a new Chapter 405 relating to Sexual Offenders, establishing a residence location prohibition for designated sexual offenders. (Ostrow and Schiff; Referred by City Council 3/10/2006)

17. Use of Alleys by Pedestrians:

Subject matter of an ordinance amending Title 15, Chapter 385 of the Minneapolis Code of Ordinances relating to Offenses—Miscellaneous: In General, prohibiting use of alleys for through pedestrian traffic, except for abutting property owners, tenants, their guests and invitees, law enforcement personnel, emergency medical or fire personnel, persons performing public service activities or inspections, and person performing services for public or private utility, garbage collection, or communication companies (Lilligren; Referred by City Council 5/26/2006)

18. Condominium Conversions:

Subject matter of an ordinance amending Title 12, Chapter 250 of the Minneapolis Code of Ordinances relating to Housing: Condominium Conversions, adding notice and City approval requirements, as well as improved protections for buyers and provisions to address the loss of affordable rental housing due to condominium conversions (Gordon; Referred by City Council 6/16/2006).

19. Civilian Police Review Authority:

Subject matter of ordinance amending Title 9, Chapter 172 of Code relating to Fire and Police Protection: Civilian Police Review Authority, adding language to Section 172.20 entitled Scope of authority, and Section 172.130 entitled Disciplinary decision (Hodges; Referred by City Council 6/30/2006).
