A. Street Name Petition: Application by David St. Peter of the Minnesota Ballpark Authority to change the name of the portion 3rd Ave N, between 7th St N and Glenwood Ave to Twins Way.

Action: The City Planning Commission recommends that the City Council adopt the findings and approve the petition to name/rename a street as Twins Way.

2. Target Field (RLS-57, Ward: 7), Target Field - 353 5 th St N ( Shanna Sether). This item was continued from the November 30, 2009 meeting.

Staff report

A. Registered Land Survey: Application by Keith Dahl and Tom Holker of URS Corporation, on behalf of the Minnesota Ballpark Authority and Hennepin County for a Registered Land Survey (RLS), for the Twins Ballpark located in B4C-2 Downtown Commercial District, B4S Downtown Service District, I2 Medium Industrial District and DP Downtown Parking Overlay District. The purpose of this RLS is to create different ownership, leasehold and use tracts for the Ballpark structure and related enhancements on and near the Ballpark property.

Action: The City Planning Commission continued the preliminary and final Registered Land Survey application for the Twins Ballpark located in B4C-2 Downtown Commercial District, B4S Downtown Service District, I2 Medium Industrial District and DP Downtown Parking Overlay District, to the January 11, 2010, City Planning Commission public hearing.

3. Taco Taxi (BZZ-4638, Ward: 9), 1511 E Lake St (1509 E Lake St) (Becca Farrar).

Staff report

A. Conditional Use Permit: Application by Monica Romero, on behalf of Hector Lopez and Taco Taxi, for a conditional use permit to allow 24 hour daily operation of the existing business including sit down and take-out. The business received approval of a conditional use permit in 2007 which allowed 24 hour delivery but limited the sit down and take-out hours to 12:00 am, Sunday thru Thursday, and to 1:00 am, Friday and Saturday for the property located at 1511 E Lake St (1509 E Lake St).

Action: The City Planning Commission adopted the findings and denied the conditional use permit to allow 24 hour daily operation of the sit down and take-out aspects of the existing restaurant, and in lieu thereof approved a conditional use permit to allow the restaurant to be open until 3:00 a.m. on Friday and Saturday and to 2:00 a.m. Sunday thru Thursday for sit down and take-out customers, and continue to allow delivery 24 hours per day, seven days a week, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.
  2. Compliance with the window sign provision as stated in Section 543.480 of the Zoning Code.

4. University Flats (BZZ-4635, Ward: 2), 2600 University Ave SE (Janelle Widmeier).

Staff report

A. Conditional Use Permit: Application by Gregory Schlink, on behalf of University Lofts, LLC, to amend a conditional use permit to increase the number of allowed units to 82 for the property located at 2600 University Ave SE.

Action: The City Planning Commission continued the application to amend the conditional use permit to increase the number of allowed dwelling units to 82 located at the property of 2600 University Ave SE to the February 8, 2010 City Planning Commission meeting.

5. Veterans Transitional Housing Program (BZZ-4633, Ward: 11), 5746 Sander Dr (Hilary Dvorak).

8. Hennepin County Library - Northeast Library (BZZ-4631, Ward: 1), 2200 Central Ave NE (Jim Voll).

Action: The City Planning Commission adopted the findings and approved the conditional use permit amendment for a library addition and site improvements for property located at 2200 Central Ave NE, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

B. Variance: Application by Hennepin County for a variance of the Pedestrian Overlay District standards for building placement located at 2200 Central Ave NE.

Action: The City Planning Commission adopted the findings and approved the variance to allow the building addition location from the property line on Central Ave to be increased from eight to 18.5 feet in the PO District for property located at 2200 Central Ave NE.

C. Site Plan Review: Application by Hennepin County for a site plan review for property located at 2200 Central Ave NE.

Action: The City Planning Commission adopted the findings and approved the site plan review for property located at 2200 Central Ave NE, subject to the following conditions:

  1. CPED Planning staff review and approve the site plan, lighting plan, landscaping plan, and elevations before permits may be issued.
  2. All site improvements shall be completed by December 14, 2010, (unless extended by the Zoning Administrator) or permits may be revoked for noncompliance.
  3. Provision of landscaping, fencing, or a combination thereof that will provide a six foot high screen for the length of the parking lot adjacent to the residential structure as required by Section 530.170(c)(2). The remainder of the west property line in front and behind the house may be screened as shown on the submitted site plan.

9. Florence Court Redevelopment (BZZ-4632, Ward: 3), 1000 and 1022 University Ave SE (Hilary Dvorak).

A. Conditional Use Permit: Application by Clark Gassen, with CAG Development, for a conditional use permit for a 121-unit (84 proposed and 37 existing) Planned Unit Development for the property located at 1000 and 1022 University Ave SE.

Action: The City Planning Commission adopted the findings and approved the conditional use permit application for a 121-unit (84 proposed and 37 existing) Planned Unit Development located at 1000 and 1022 University Ave SE subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.
  2. As required by section 527.120 of the zoning code, the development includes the following amenities from Table 527-1, Amenities: historic preservation, outdoor open space, and pedestrian improvements.

B. Variance: Application by Clark Gassen, with CAG Development, for a variance of the UA University Area Oriented Overlay District standards as they pertain to vehicle and bike parking for the property located at 1000 and 1022 University Ave SE.

Action: The City Planning Commission adopted the findings and approved the variance of the University Area Oriented Overlay District standards to reduce the off-street parking requirement from 157 spaces to 128 spaces and the bicycle parking requirement from 313 spaces to 254 spaces for property located at 1000 and 1022 University Ave SE.

C. Variance: Application by Clark Gassen, with CAG Development, for a variance to reduce the east interior side yard setback from the required 15 feet to a distance ranging between 13.5 feet and 10 feet for a variety of building elements and to 2 feet for a relocated detached garage for the property located at 1000 and 1022 University Ave SE.

Action: The City Planning Commission adopted the findings and approved the variance application to reduce the east interior side yard setback from the required 15 feet to a distance ranging between 13.5 feet and 10 feet for a variety of building elements and to 2 feet for a relocated detached garage located at 1000 and 1022 University Ave SE.

D. Site Plan Review: Application by Clark Gassen, with CAG Development, for a site plan review for the property located at 1000 and 1022 University Ave SE.

Action: The City Planning Commission adopted the findings and approved the site plan review for the property located at 1000 and 1022 University Ave SE subject to the following conditions:

  1. Approval of the final site, landscaping, elevation and lighting plans by the Community Planning and Economic Development Department – Planning Division.
  2. All site improvements shall be completed by December 14, 2011, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

E. Plat: Application by Clark Gassen, with CAG Development, for a preliminary and final plat for the property located at 1000 and 1022 University Ave SE.

Action: The City Planning Commission adopted the findings and approved the preliminary and final plat application for the property located 1000 and 1022 University Ave SE.

10. Clare Midtown (BZZ-4616, Ward: 9), 3105 23 rd Ave S ( Hilary Dvorak).

Staff report

A. Conditional Use Permit: Application by Clare Housing for a conditional use permit for a 45-unit supportive housing development for the property located at 3105 23rd Ave S.

Action: The City Planning Commission adopted the findings and approved the conditional use permit for a 45-unit supportive housing development located at 3105 23rd Ave S subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.
  2. There shall be no more than 45 dwelling units in the building.
  3. On-site services shall be for residents of the facility only, except where part of a regimen of scheduled post-residential treatment.

B. Variance: Application by Clare Housing for a variance to increase the number of persons served from the maximum 32 to 45 for the property located at 3105 23rd Ave S.

Action: The City Planning Commission adopted the findings and approved the variance to increase the number of persons served from the maximum 32 to 45 located at 3105 23rd Ave S.

C. Variance: Application by Clare Housing for a variance to reduce the front yard setback to allow a staircase and front patio that exceed the dimensional requirements for permitted obstructions for the property located at 3105 23rd Ave S.

Action: The City Planning Commission adopted the findings and approved the variance application to reduce the front yard setback from the required 15 feet to a distance ranging between six feet and one-foot to allow a staircase and front patio that exceed the dimensional requirements for permitted obstructions in required yards located at 3105 23rd Ave S.

D. Variance: Application by Clare Housing for a variance to reduce the corner side yard setback to allow a staircase and front patio that exceed the dimensional requirements for permitted obstructions for the property located at 3105 23rd Ave S.

Action: The City Planning Commission adopted the findings and approved the variance application to reduce the corner side yard setback from the required 15 feet to a distance ranging between six feet and one-foot to allow a staircase and front patio that exceed the dimensional requirements for permitted obstructions in required yards located at 3105 23rd Ave S.

E. Site Plan Review: Application by Clare Housing for a site plan review for the property located at 3105 23rd Ave S.

Action: The City Planning Commission adopted the findings and approved the site plan review application for the property located at 3105 23rd Ave S subject to the following condition:

  1. Additional landscaping shall be planted along the south property line in order to screen the electrical panel from the adjacent residential building and the public right-of-way.
  2. Additional landscaping shall be planted along the north property line in order to screen the partially exposed basement level from the public right-of-way.
  3. Approval of the final site, elevation, landscaping and lighting plans by the Department of Community Planning and Economic Development – Planning Division.
  4. All site improvements shall be completed by December 14, 2010, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

11. Danish American Center Addition at Danebo (BZZ-4637, Ward: 12), 3030 W River Rd (Becca Farrar).

Staff report

A. Nonconforming Use Expansion: Application by Glen Olsen, on behalf of Danebo Incorporated, for an expansion of a non-conforming use for an existing club/lodge for the property located at 3030 W River Parkway S.

Action: The City Planning Commission adopted the findings and approved the application to allow a 2,479 square foot expansion of a legal non-conforming use as a club/lodge on the property located at 3030 W River Pkwy S.

B. Variance: Application by Glen Olsen, on behalf of Danebo Incorporated, for a variance to allow drive aisles and surface parking in the required front yard setback along 48th Ave S (west property line) as well as to allow parking between the principal structure and the front lot line for the property located at 3030 W River Parkway S.

Action: The City Planning Commission adopted the findings and approved the application for a variance to allow driveways and surface parking in the required front yard setback along 48th Ave S (west property line) as well as to allow parking between the principal structure and the front lot line for property located at 3030 W River Pkwy S subject to the following condition:

  1. No parking spaces may extend beyond the property line.

C. Variance: Application by Glen Olsen, on behalf of Danebo Incorporated, for a variance to allow drive aisles and surface parking in the required front yard setback along W River Parkway S (east property line) as well as to allow parking between the principal structure and the front lot line for the property located at 3030 W River Parkway S.

Action: The City Planning Commission adopted the findings and approved the application for a variance to allow driveways and surface parking in the required front yard setback along W River Pkwy S (east property line) as well as to allow parking between the principal structure and the front lot line for property located at 3030 W River Pkwy S.

D. Variance: Application by Glen Olsen, on behalf of Danebo Incorporated, for a variance to allow surface parking in the required interior side yard setback along the south property line for the property located at 3030 W River Parkway S.

Action: The City Planning Commission adopted the findings and approved the application for a variance to allow surface parking in the required interior side yard setback along the south property line for property located at 3030 W River Pkwy S.

E. Site Plan Review: Application by Glen Olsen, on behalf of Danebo Incorporated, for a site plan review for a 2,479 square foot building addition to The Danish American Center at Danebo located at 3030 W River Parkway S.

Action: The City Planning Commission adopted the findings and approved the site plan review application for property located at 3030 W River Pkwy S subject to the following conditions:

  1. Planning Staff review and approval of the final site, elevation and landscaping plans.
  2. All site improvements shall be completed by December 14, 2010 unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. Modification of the west elevation to comply with the 30% window requirement and even distribution of windows per Section 530.120 of the Zoning Code.
  4. All ground level windows must be transparent (non-reflective) as required by Section 530.120 of the Zoning Code.
  5. No EIFS shall be utilized on the exterior of the building addition.
  6. A minimum of two bicycle parking spaces shall be relocated to meet the short-term bicycle parking standards as outlined in Section 541.180 of the Zoning Code.
  7. Planning Staff will work with the applicant to relocate the dumpster on the subject site. Details of the enclosure must be provided in the final plan sets and the materials utilized must be compatible with those located on the building.
  8. Any changes to the site plan as a result of Preliminary Development Review may result in another public hearing by the City Planning Commission if the Zoning Administrator deems such changes significant under sections 525.360 and 530.100 of the zoning code.

A. Text Amendment: Amending Title 20 of the Minneapolis Code of Ordinances related to the Zoning Code, as follows:

Amending Chapter 543 related to Zoning Code: On-Premise Signs

Amending Chapter 544 related to Zoning Code: Off-Premise Signs

AND

Amending Title 5 of the Minneapolis Code of Ordinances relating to the Building Code, as follows:

Amending Chapter 109 related to Building Code: Billboards

The purpose of the amendment is to make corrections to the recently revised zoning code and building code provisions related to on-premise signs.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the zoning code text amendment, amending chapters 543 and 544 and approve the building code text amendment, amending chapter 109.

13. Midtown Greenway Rezoning Study (Wards: 2, 6, 7, 8, 9, 10 and 13), (Amanda Arnold). This item was continued from the September 28, October 13 and October 26, 2009 meetings.

A. Text Amendment: Amending Chapter 521, Zoning Districts and Maps for the purpose of implementing the following adopted plans: The midtown Minneapolis Land Use and Development Plan, The Industrial Land Use and Employment Policy Plan, The Midtown Greenway Land Use and Development Plan, The Seward Longfellow Area Land Use and Predevelopment Study, The Uptown Small Area Plan and the Lyn-Lake Small Area Plan. The proposed rezoning affects primary and overlay zoning districts contained in Plates 18,23,24,25,26,27, and 28.

Action: The City Planning Commission recommended that the City Council find that obtaining consent signatures for the rezoning of properties from residential to commercial in the Midtown Greenway Rezoning Study Area would be impractical and further recommends that the City Council adopt the findings and approve the zoning map amendment with the following amendments:

  1. Cedar Lake Townhomes, 3411-3449 St. Louis Ave, retain existing R1 zoning; deny staff recommendation of R5.
  2. 2622 W Lake St, retain OR2 zoning; deny staff recommendation of R5.
  3. 2915 Dean Parkway, retain existing R6 zoning; deny staff recommendation of R5.
  4. 3016 and 3020 Fremont Ave S, retain existing R3; deny staff recommendation of R4.
  5. For all properties located in the Central, Powderhorn Park, Midtown Phillips and East Phillips neighborhoods, properties that are recommended for rezoning from R2B zoning to R3 shall retain their R2B zoning.
  6. The south end of the 2600 blocks of 29 th and 30 th Ave S (2633, 2634, 2636, 2637, 2640, 2641, 2644 29 th Ave S, 2632 2636, 2642 30 th Ave S, & 2912 27 th St E); deny staff recommendation of R4 zoning and approve OR1 in its stead.
  7. Doppler Gear, 2720 30 th Ave. S., retain the I2 zoning and add the IL Overlay District; deny staff recommendation of R4.
  8. 3145 Dean Court, retain R5 zoning; deny staff recommendation of R6.
  9. 2800 block of Xerxes Ave S, 2800 through 2817 Xerxes Ave. S., both sides of the street, retain existing zoning (multiple zoning categories) and deny staff recommendation of R3.

Commission Business

  1. Erika Carter is the new Mayoral appointment to the Planning Commission. Her appointment will go to City Council December 18.
  2. The CPC CoW meeting for December 17 has been cancelled. The next CPC CoW is January 14, 2010.
  3. This is Commissioner Nordyke’s last meeting. A new Park Board rep will be appointed to fill his seat.
