Call to order

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. If you plan to speak to an issue on the agenda, it is recommended that you arrive at the meeting at 4:30 or contact the assigned city staff person in advance. Recommend that the City Council approve the appointment of Adam Hutchens to the Zoning Board of Adjustment for a term to expire December 31, 2021.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by United Properties and Dorsey & Whitney LLP.

A.      Registered land survey.

Recommended Motion: Approve the application for a revised registered land survey, subject to the following condition:

1.       This action of the Planning Commission shall be recorded with Hennepin County at or prior to such time as the signed RLS is presented for recording with Hennepin County.

2.       KIPP Stand Academy Addition, 5000 Oliver Ave N, Ward 4

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Minnetonka Funding Group, LLC.

A.      Conditional use permit.

Recommended Motion: Approve the conditional use permit to allow a 2,120 square foot addition to an existing K-12 school in the R1 Single Family District, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       Approval of the final site, elevation, and floor plans by the Department of Community Planning and Economic Development.

3.       All site improvements shall be completed by July 22, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.

3.       D.I.V.I.N.E. Institute, 628 E Franklin Ave, Ward 6

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Jay Isenberg.

A.      Conditional use permit.

Recommended Motion: Approve the conditional use permit to allow a community residential facility in the C1 Neighborhood Commercial District, subject to the following condition:

4.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Variance.

Recommended Motion: Approve the variance to reduce the minimum drive aisle from 22 feet to one foot to allow four parking spaces to maneuver in the alley.

C.      Variance.

Recommended Motion: Approve the variance to reduce the minimum unit size for efficiency units from 350 square feet to 265 square feet.

D.      Site plan review.

Recommended Motion: Approve the site plan review for a community residential facility and five dwelling units in an existing building, subject to the following conditions:

1.       All site improvements shall be completed by July 22, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall submit the tax parcel division, combination, or lot line adjustment request form to CPED and submit proof of the filing with Hennepin County.

4.       All signs shall comply with Chapter 543 of the zoning code. All signage requires a separate permit from CPED.

5.       The final plans shall be revised to demonstrate how all building entrances and walkways will be lit to maintain a minimum acceptable level of security while not creating glare or excessive lighting of the site to comply with sections 530.130 and 530.260 of the zoning code.

6.       The applicant shall plant no less than two trees on site that meet the definition of a canopy tree.

7.       The air conditioning condenser units shall be screened to comply with section 535.70 of the zoning code.

8.       The proposed refuse and recycling enclosure shall comply with section 535.80 of the zoning code.

4.       3634 Central Ave NE, Ward 1

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Sham Hassan.

A.      Conditional use permit.

Recommended Motion: Approve the conditional use permit to allow a minor automobile repair, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Site plan review.

Recommended Motion: Approve the site plan review for the establishment of a new automobile use, subject to the following conditions:

1.       All site improvements shall be completed by July 22, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       All signs shall comply with Chapter 543 of the zoning code. All signage requires a separate permit from CPED.

4.       The landscaped yard adjacent to the alley shall be 7 feet and screened to a height of three feet.

5.       Greenway 31, 3818, 3822, and 3826 W 31st St, Ward 13

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by At Home Apartments.

A.      Variance to reduce the front yard setback.

Recommended Motion: Approve the variance to reduce the front yard setback along W 31st St from the required 15 feet to 10 feet for an awning and to seven feet for a 128-square foot patio.

B.      Variance to reduce the corner side yard setback.

Recommended Motion: Approve the variance to reduce the corner side yard setback along France Ave S from the required 15 feet to six feet for the building and to zero feet for a 60-square foot patio.

C.      Variance to reduce the rear yard setback.

Recommended Motion: Approve the variance to reduce the rear yard setback along the public alley from the required 15 feet to 13 feet for the building and to five feet for a transformer.

D.      Site plan review.

Recommended Motion: Approve the site plan review for a 49-unit residential building, subject to the following conditions:

1.       All site improvements shall be completed by July 22, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall submit the tax parcel division, combination, or lot line adjustment request form to CPED and submit proof of the filing with Hennepin County.

4.       A two-and-a-half-foot deep awning shall be located over each of these entrances to the ground floor units along W 31st St and France Ave S.

5.       The applicant shall submit a separate sign permit application for any signage that is proposed.

6.       The final lighting plan shall conform to the standards of Chapter 535, Regulations of General Applicability.

6.       Lutheran Church of the Good Shepherd, 4800 Ewing Ave S, Ward 13

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Lutheran Church of the Good Shepherd.

A.      Conditional use permit.

Recommended Motion: Approve the conditional use permit to allow a preschool in the R2B Two Family District and the R1A Single Family District, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       Approval of the final site plan by the Department of Community Planning and Economic Development.

3.       All site improvements shall be completed by July 22, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.

B.      Variance.

Recommended Motion: Approve the variance to reduce the required front yard setback adjacent to Ewing Ave S from 29.9 feet to 2.5 feet for recreational playground equipment, subject to the following conditions:

1.       Approval of the final site plan by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by July 22, 2021, unless extended by the Zoning Administrator.

7.       Webber Mart – Bodega Smokes, 1701 44th Ave N, Ward 4

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Kevin Aldwaik.

A.      Rezoning.

Recommended Motion: Deny the application to rezone the property from C1 Neighborhood Commercial District to the C2 Neighborhood Corridor Commercial District.
