APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. A.      Commemorative street renaming.

Recommended Motion: Approve the petition to add the commemorative name of Richard Estes Way to Plymouth Ave N between Penn Ave N and Queen Ave N.

2.       Scherer Park Addition, 900 Sibley St NE, 901 Water St, 9 8th Ave NE, 1 8th Ave NE, and 15 8th Ave NE, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the vacation application by Karen Park Gallivan of Graco Inc and the plat application by Greg Soule.

A.      Preliminary and final plat.

Recommended Motion: Approve the application for a preliminary and final plat, subject to the following condition:

1.       Subject to the approval of the vacation application (VAC-1712) of 10th Ave NE.

B.      Vacation.

Recommended Motion: Approve the vacation of a portion of 10th Ave NE, between Sibley St NE and the Mississippi River.

3.       Ramsey St NE Vacation, Ward 3

 

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Karen Park Gallivan of Graco Inc.

A.      Vacation.

Recommended Motion: Continue the vacation of the vacate the southwesterly 37 feet of Ramsey St NE generally between 8th and 11th Aves NE to the February 11, 2019, City Planning Commission public hearing.

4.       Centerpoint Energy substation, 2406 McNair Ave N, Ward 5

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Border Foods, Inc.

A.      Conditional use permit.

Recommended Motion: Approve the conditional use permit for a 240-square foot addition to the existing fast-food restaurant, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Site plan review.

Recommended Motion: Approve the site plan review for a 240-square foot addition to the existing fast-food restaurant, subject to the following conditions:

1.       All site improvements shall be completed by January 14, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       Additional shrubs, perennials and native grasses shall be added to the landscape plan so the required landscaped areas are lush with plants; not rock mulch.

4.       An additional tree shall be located within the parking lot so every parking space is located within 50 feet of an on-site deciduous tree.

5.       The plant materials and the installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

6.       If it is determined that new mechanical equipment is required, it shall meet the screening requirements of Chapter 535, Regulations of General Applicability.

6.       USI Communications Exchange, 3651 Snelling Ave, Ward 12

A.      Conditional use permit.

Recommended Motion: Approve the conditional use permit to allow a communication exchange, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       The building walls shall include brick patterning to provide architectural interest as shown on the submitted elevations.

3.       The landscaping on site shall be as shown in the submitted landscaping plan.

B.      Site plan review.

Recommended Motion: Approve the site plan review for a new communications exchange, subject to the following conditions:

A.      Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit to allow an addition to a K-12 school, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Site plan review.

Recommended Motion: Approve the application for a 10,500 square foot addition to an existing elementary school, subject to the following conditions:

1.       All site improvements shall be completed by January 14, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.       The applicant shall plant not less than 75 shrubs on-site.

5.       The applicant shall provide a no parking sign to prevent parking in the unmarked area of the surface parking lot that is next to the sidewalk.

6.       The applicant is encouraged to explore options for narrowing the curb cut along 4th St SE.

7.       The applicant shall provide landscaping and screening that is at least 60 percent opaque in the areas immediately to the west and east of the curb cut to partially screen the parking lot from the street.

8.       The applicant shall provide landscaping and screening that is at least 60 percent opaque between the surface parking lot and Holmes Park immediately to the west.

9.       The final plans shall be revised to demonstrate how all building entrances and walkways will be lit to maintain a minimum acceptable level of security while not creating glare or excessive lighting of the site to comply with sections 530.130 and 530.260 of the zoning code.

10.   Approval of the sign permits by the Department of Community Planning and Economic Development.

11.   The existing transformer along 4th St SE shall be screened to comply with section 535.70 of the zoning code.

12.   The final plans shall contain additional detail to demonstrate that the proposed refuse enclosure will comply with section 535.80 of the zoning code.

8.       2924, 2928, 2932 Bryant Ave S, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Aron Johnson.

A.      Conditional use permit.

Recommended Motion: Approve the conditional use permit to increase the maximum height of a building in the C2 Neighborhood Corridor Commercial District from 4 stories or 56 feet, whichever is less, to 71 feet, 6 inches, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Variance.

Recommended Motion: Approve the variance to increase the maximum floor area ratio from 2.125 to 3.55, subject to the following conditions:

1.       The ground floor plans shall be revised to include a minimum 1,000 square foot commercial use facing Bryant Ave S.

2.       The applicant shall mitigate the blank walls on levels 3 through 6 of the north side of the building by adding recesses and projections, or by increasing the distance of these floors to the north property line in order to allow for window openings.

C.      Site plan review.

Recommended Motion: Approve the site plan review for a new, multiple-family dwelling with 91 dwelling units, subject to the following conditions:

1.       All site improvements shall be completed by January 14, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall obtain separate permits from CPED for any signage that is proposed.

4.       The applicant shall mitigate the blank walls on levels 3 through 6 of the north side of the building by adding recesses and projections, or by increasing the distance of these floors to the north property line in order to allow for window openings.

5.       The elevations shall be revised so that the overall number of material types per elevation, excluding color variations, shall be limited to no more than three exterior materials per elevation.

6.       The landscaping plan shall be revised to include no fewer than one (1) on-site canopy tree to meet the general landscaping requirements in section 530.160 of the zoning code.

7.       The applicant shall add bicycle racks to parking stalls that are adjacent to walls within the at-grade parking area.

9.       Linden Building, 4321 and 4353 Upton Ave S and 2720 44th St W, Ward 13

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by South Upton Properties Partnership.

A.      Conditional use permit to increase the maximum height of the building.

Recommended Motion: Approve the conditional use permit to increase the maximum allowed height in the SH Shoreland Overlay District from 2.5 stories, 35 feet to 3 stories and 39 feet measured to the top of the parapet and 45 feet measured to the top of the rooftop mechanical equipment, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Variance to reduce the minimum front yard requirement.

Recommended Motion: Approve the variance to reduce the minimum front yard requirement adjacent to 44th St from 6 feet to 0 feet to allow the building.

C.      Variance to reduce the minimum interior side yard requirement.

Recommended Motion: Approve the variance to reduce the minimum interior side yard requirement adjacent to the east lot line from 5 feet to 4 feet to allow curbing for the parking lot.

D.      Variance to reduce the minimum parking requirement.

Recommended Motion: Approve the variance to reduce the minimum vehicle parking requirement from 11 to 6 spaces, subject to the following condition:

1.       At least 31 bicycle parking spaces shall be provided, including 15 long-term spaces and 16 short-term spaces, and on-site shower facilities shall be provided for bike commuters.

E.       Variance of the PO Pedestrian Oriented Overlay District standard.

Recommended Motion: Approve the variance of the PO Pedestrian Oriented Overlay District standards requiring the first floor of the building to be not more than 8 feet from the lot line adjacent to a street to allow a 10-foot setback for recessed entrances adjacent to Upton Ave S.

F.       Site plan review.

Recommended Motion: Approve the site plan review for a new approximately 17,000 square foot multi-tenant commercial building, subject to the following conditions:

1.       All site improvements shall be completed by January 14, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued. Final plans shall also include fence and screening details for the trash enclosure to ensure compliance with sections 535.80, 548.180, and 551.175 of the zoning code.

3.       Mechanical equipment shall be screened as required by section 535.70 of the zoning code.

10.   Lydia Apartments, 1914 and 1920 LaSalle Ave, Ward 7

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Beacon Interfaith Housing Collaborative.

A.      Conditional use permit.

Recommended Motion: Approve the amendment to the conditional use permit to expand the existing 40-bed supportive housing use by an additional 40 units, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Conditional use permit to increase the maximum permitted height of the building.

Recommended Motion: Approve the conditional use permit to increase the maximum permitted height of the building from 4 stories/56 feet to 6 stories/67 feet, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C.      Variance.

Recommended Motion: Approve the variance to reduce the front yard setback along LaSalle Ave from 15 feet to one foot.

D.      Site plan review.

Recommended Motion: Approve the site plan review for an approximate 24,000 square foot addition to the existing building, subject to the following conditions:

1.       All site improvements shall be completed by January 14, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The two columns of windows on the upper floors of the building facing the north property line shall be carried down to the first floor to eliminate the blank wall.

4.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

5.       The final lighting plan shall conform to the standards of Chapter 535, Regulations of General Applicability.

6.       There shall be at least eight canopy trees planted on the site.

7.       A deciduous tree shall be planted in the raingarden located in the middle of the parking lot that is accessed from LaSalle Ave so all parking spaces area located within 50 feet of a deciduous tree.

11.   901 Winter St NE, Ward 3

A.      Rezoning.

Recommended Motion: Deny the petition to rezone the property from the R2B Two-Family District to the R4 Multiple-Family District.

A.      Variance to reduce the minimum front yard requirement.

Recommended Motion: Deny the variance to reduce the minimum front yard requirement adjacent to Fillmore Street NE from 15 feet to 3 feet to allow three ground floor patios.

B.      Variance to reduce the minimum lot area per dwelling unit.

Recommended Motion: Deny the variance to reduce the minimum lot area requirement from 1,085 square feet to 1,031 square feet per dwelling unit.

C.      Site plan review.

Recommended Motion: Deny the site plan review for a three-story multiple-family building with 20 dwelling units.

12.   The Archive, 102-120 1st St N, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Curt Gunsbury.

A.      Conditional use permit.

Recommended Motion: Approve the conditional use permit to increase the height of a building from six stories/84 feet to seven stories/92 feet, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Variance to reduce the minimum number of off-street loading spaces.

Recommended Motion: Approve the variance to reduce the minimum number of off-street loading spaces from one small loading space to zero spaces, subject to the following condition:

1.       Building management shall monitor loading activity and help reduce the idle time of trucks in the public alley.

C.      Variance of Chapter 543 standards for a roof sign.

Recommended motion: Approve the variance to allow a roof sign on a building that is greater than six (6) stories and eighty-four (84) feet in height., subject to the following condition:

1.       Between sunrise and sunset the maximum luminance shall be five thousand (5,000) nits and between sunset and sunrise the maximum luminance shall be five hundred (500) nits.

D.      Variance of Chapter 543 standards for maximum allowed signage

Recommended motion: Approve the variance to increase the maximum allowed signage on a primary building wall from 220 square feet to 412 square feet.

E.       Site Plan Review.

Recommended motion: Approve the site plan review to allow for a new mixed-use building with ground floor commercial space and 198 dwelling units, subject to the following conditions:

1.       All site improvements shall be completed by January 14, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The first floor windows shall be clear or lightly tinted glass with a visible light transmittance ratio of six-tenths (0.6) or higher.

4.       All mechanical equipment, including the transformer along Azine Way, shall be screened in compliance with Section 535.70- Screening of mechanical equipment.
