The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Faith Tabernacle Gospel Fellowship International.

A.      Variance.

Recommended motion: Approve the petition to add the commemorative name of Dr Floyd R Beecham St to 4th St N between West Broadway and 21st Ave N.

2.       1500 W 56th St, Ward 13

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Heather Hansen.

A.      Variance.

Recommended motion: Approve the application for a variance to reduce the minimum lot width from 50 feet to 46.81 feet for both parcels.

B.      Minor Subdivision.

Recommended motion: Approve the application for a minor subdivision, subject to the following conditions:

1.    Staff will not release the minor subdivision resolution for recording until after the existing structure is removed.  The applicant has until December 3rd, 2020, to complete the demolition of the existing structure and record the resolution or the minor subdivision approval will expire.

2.    The applicant shall provide a shared driveway between the two properties with access to parking at the rear of the site or the proposed structures as shown in the development plan.

3.       Contractor Yard and Tow Company Parking, 4040 and 4050 ½ Washington Ave N, Ward 4

5.       Target Field 2019 Enhancements, 353 5th St N, Ward 3

A.      Variance.

Recommended motion: The variance of the plaza design standards to reduce the required landscaped area and seating has been withdrawn.

B.      Site plan review.

Recommended motion: Approve the site plan review for alterations of an existing regional sports facility and adjacent public plaza, subject to the following conditions of approval:

 1.       All site improvements shall be completed by December 3, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

 2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

 3.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

 4.       The applicant shall comply with the minimum seating and landscaped area as required by section 535.810 (6) and 535.810(8)b. of the zoning code.

6.       4553 and 4561 Minnehaha Ave, Ward 12

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Joshua Jansen.

A.      Conditional use permit.

Recommended motion: Approve the conditional use permit to increase the maximum allowed height from 3 stories and 42 feet to 5 stories and 57 feet., subject to the following conditions:

 1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

 2.       The building massing shall step down from five stories to one story closest to the north interior side property line as shown on the submitted elevations.

 3.       The fifth floor shall be stepped back on the north, west, and southwest sides as shown on the submitted elevations.

B.      Variance to increase the floor area ratio.

Recommended motion: Approve the variance to increase the maximum floor area ratio from 2.21 to 2.42, subject to the following condition:

1.    The fifth floor shall be stepped back on the north, west, and southwest sides as shown on the       submitted elevations.

C.      Variance to reduce the north interior side yard setback.

Recommended motion: Approve the variance to reduce the north interior side yard setback from 13 feet to 5 feet, subject to the following conditions:

1.    The building massing shall not exceed one story in height within ten feet of the north interior side   property line.

2.    The building shall not exceed three stories in height within thirty feet of the north interior side property line.

D.      Variance to increase the percentage of required parking spaces.

Recommended motion: Approve the variance to increase the percentage of required parking spaces that may be satisfied by providing compact spaces from 25 percent to 34 percent, subject to the following condition:

1.    The applicant shall provide not less than 47 long-term bicycle parking spaces as proposed. At least 20 bicycle parking spaces shall not be accessed through a vehicle parking space.

E.       Site plan review.

Recommended motion: Approve the site plan review for a new mixed-use building with 54 dwelling units and 1,977 square feet of commercial space, subject to the following conditions:

 1.       All site improvements shall be completed by December 3, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

 2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

 3.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

 4.       The elevation facing the surface parking lot shall provide not less than 20 percent windows on the first floor which shall include window area on the doors and garage door as shown in the submitted elevations.

 5.       The parking area shall be screened from the residence district to the north with screening that is at least ninety-five percent opaque to comply with section 530.160 of the zoning code.

 6.       The parking area shall be screened from the residence district across the alley with screening that is at least sixty percent opaque to better comply with section 530.160 of the zoning code.

 7.       The landscaped yards to the north of the parking area shall be at least seven feet in width and shall contain trees and shrubs to comply with section 530.160 of the zoning code.

 8.       Each proposed surface parking space shall be located within 50 feet of the center of an on-site deciduous tree.

 9.       The applicant shall explore providing discontinuous curbing to allow on-site stormwater retention in the landscaped areas adjacent to the surface parking lot.

10.   The submitted lighting plan shall be updated to include footcandles in order to demonstrate compliance with lighting standards in Chapter 535 and Chapter 541 of the zoning code.

7.       Hiawatha Ave Apartments, 4757 Hiawatha Ave, Ward 12

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by DJR Architecture.

A.      Conditional use permit.

Recommended motion: Approve the conditional use permit to increase the maximum height in the SH Shoreland Overlay District from 2 ½ stories, not to exceed 35 feet, to 5 stories, not to exceed 70 feet to the top of the roof deck and 85 feet to the top of the stair and elevator tower, subject to the following condition:

1.          The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Variance.

Recommended motion: Approve the variance of the PO Pedestrian Oriented Overlay District Standards  to allow portions of the building to be set back more than 8 feet from the property lines adjacent to Hiawatha Ave and Nawadaha Blvd, subject to the following condition of approval: 

1.          CPED staff shall review and approve the final site plan and the building location shall not significantly change from the proposed site plan provided in the attached staff report.

C.      Site plan review.

Recommended motion: Approve the site plan review for a new 85-unit, multiple-family dwelling, subject to the following conditions:

1.       All site improvements shall be completed by December 3, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.       The applicant shall provide sufficient detail, such as windows, entries, recesses or projections, or other architectural elements to avoid blank walls exceeding 25 feet on the building elevations.

5.       The applicant shall revise the exterior materials and provide no more than three consistent materials on all four sides of the building and meet the standards set in Table 1. Percentage of Exterior Materials per Elevation.

6.       At least sixty (60) percent of the ground floor facing Hiawatha Ave shall contain active functions.

7.       All mechanical equipment be shown on the site plan and screened as required by section 535.70 of the zoning code.

8.       44th at Harriet, 2614 ½, 2616, 2616 ½, 2620 W 44th St, Ward 13

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Evan Jacobsen.

A.      Conditional use permit.

Recommended motion: Approve the conditional use permit to increase the maximum height of a new building in the SH Shoreland Overlay District from 2.5 stories or 35 feet, whichever is less, to 3 stories / 42 feet, subject to the following condition:

1.    The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Variance to reduce the minimum lot area.

Recommended motion: Approve the variance to reduce the minimum lot area per dwelling unit from 1,041 square feet to 751 square feet.

C.      Variance to reduce the front yard setback.

Recommended motion: Approve the variance to reduce the minimum front yard requirement adjacent to W 44th St from 29 feet to between 20 and 22 feet to allow the building wall, and to 12 feet to allow a canopy, subject to the following condition:

1.    The proposed canopy shall be reduced to four feet in depth.

D.      Variance to reduce the east side yard setback.

Recommended motion: Approve the variance to reduce the minimum side yard requirement adjacent to the east property line from 9 feet to 4 feet to allow two ground floor patios.

E.       Variance to decrease the front yard setback.

Recommended motion: Approve the variance to reduce the minimum rear yard requirement adjacent to the north property line from 9 feet to 4 feet to allow the building wall.

F.       Site plan review.

Recommended motion: Approve the site plan review for a new, multiple-family dwelling with 36 units, subject to the following conditions:

1.       All site improvements shall be completed by December 3, 2020, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall obtain separate permits for any signage.

4.       No fewer than 11 canopy trees, 42 shrubs, and a total of 11,000 square feet of landscaped area shall be provided on-site, as proposed.

5.       Brick shall be the primary exterior material on all elevations, as proposed.

6.       All mechanical equipment shall be screened per the requirements of Chapter 535 of the zoning code.

9.       2325 E 38th St, 3812 24th Ave S, Ward 12

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Yellow Tree Corp.

A.      Rezoning.

Recommended motion: Approve the petition to rezone the existing R1A portion of 2325 38th St and the entirety of 3812 24th Ave S from the R1A to the R5 district.

B.      Rezoning.

Recommended motion: Approve the petition to rezone both properties to add the Split Zoning Overlay District.

C.      Conditional use permit.

Recommended motion: Approve the conditional use permit to increase the maximum height of the building from 2.5 stories, 35 feet to 4 stories, 47 feet, subject to the following condition:

1.          The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

D.      Variance to reduce the minimum parking requirement.

Recommended motion: Approve the variance to reduce the minimum parking requirement for nonresidential uses from 4 spaces to 0 spaces, subject to the following condition:

                1.      The applicant shall install an additional 4 short-term bicycle parking spots either onsite or in the public right of way.

E.       Variance to increase the maximum floor area ratio.

Recommended motion: Approve the variance to increase the maximum floor area ratio from 2.38 to 2.46.

F.       Variance to reduce the minimum front yard requirement.

Recommended motion: Approve the variance to reduce the minimum front yard along 24th Ave S from 22 feet to 8 feet subject to the following conditions:

1.       The applicant shall reduce the size of the proposed walkway to no more than 6 feet to comply with chapter 535 of the code.  Other proposed paved areas may be replaced with pervious pavers.

2.       The applicant shall move the proposed transformer at least 25 feet from the adjacent residential property.

G.      Variance to reduce the minimum interior side yard.

Recommended motion: Approve the variance to reduce the minimum interior side yard along the south property line from 11 feet to 5 feet.

H.      Variance to reduce the minimum rear yard.

Recommended motion: Approve the variance to reduce the minimum rear yard along the alley from 11 feet to 5 feet.

I.        Variance to increase the maximum lot coverage.

Recommended motion: Approve the variance to increase the maximum lot coverage from 70% to 77%.

J.        Site Plan Review.

Recommended motion: Approve the site plan review for a new four story mixed use building with 63 dwelling units and 4,000 square feet of commercial space, subject to the following conditions:

1.       All site improvements shall be completed by January 18, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The project shall utilize one color of brick for all proposed exterior brick.

4.       The applicant shall provide a photometric lighting plan that demonstrates compliance with chapters 530 and 535 of the zoning code.

10.   1202 4th St SE, 1206 4th St SE, 1208 4th St SE, 1214 4th St SE, and 316 12th Ave SE, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Struan Robertson.

A.      Rezoning.

Recommended motion: Approve the petition to rezone the properties located at 1202 4th St SE, 1206 4th St SE, 1208 4th St SE, 1214 4th St SE, 316 12th Ave SE from the R5 District to the OR3 District, retaining the University Area Overlay District.

B.      Variance to reduce the minimum parking requirement.

Recommended motion: Approve the variance to reduce the minimum vehicle parking requirement from 137 spaces to 67 spaces.

C.      Variance to reduce the minimum loading requirement.

Recommended motion: Approve the variance to reduce the minimum loading requirement from 1 small space to 0 spaces.

D.      Variance to reduce the minimum front yard requirement.

Recommended motion: Approve the variance to reduce the minimum front yard requirement along 4th St SE from 15 feet to 6 feet.

E.       Variance to reduce the minimum corner side yard requirement.

Recommended motion: Approve the variance to reduce the minimum corner side yard along 12th Ave SE from 15 feet to 2 feet.

F.       Variance to reduce the minimum rear yard requirement.

Recommended motion: Approve the variance to reduce the minimum rear yard requirement along the south property line from 15 feet to 10 feet.

G.      Variance to reduce the minimum interior side yard requirement.

Recommended motion: Approve the variance to reduce the minimum interior side yard requirement along the east property line from 15 feet to 12 feet.

H.      Variance to reduce the increase the maximum lot coverage requirement.

Recommended motion: Approve the variance to increase the maximum lot coverage from 70% to 80%.

I.        Variance to allow mechanical equipment in a required yard.

Recommended motion: Return the variance to allow mechanical equipment in the required rear yard.

J.        Site plan review.

Recommended motion: Approve the site plan review for a new six story 114-unit residential building, subject to the following conditions:

1.       All site improvements shall be completed by February 1, 2021, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       All proposed on-premises signs shall comply with the requirements of chapter 543 of the zoning code.

4.       All onsite mechanical equipment shall meet the minimum screening requirements of chapter 535 of the zoning code.

5.       The applicant shall provide a final photometric lighting plan that demonstrates compliance with chapter 530 and 535 of the zoning code.

6.       The applicant shall provide pedestrian-scale lighting along 4th St SE and 12th Ave SE elevations, either attached to the building face or bollard-style.

7.       The applicant shall meet the minimum window requirement for the ground floor elevation along 12th Ave SE.

11.   CHDC Workforce Housing, 810 7th St S, 827 6th St S, and 618 9th Ave S, Ward 6

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by First Covenant Church Minneapolis/Community Housing Development Corporation.

A.      Preliminary/Final Registered Land Survey.

Recommended motion: Approve the application for a preliminary and final registered land survey, subject to the following condition:

1.       This RLS creates tracts that, if separately redeveloped, would not meet the requirements of the zoning and subdivision ordinances for lot area and width and the prohibition against lots with more than five sides at ground level. Approval of this RLS does not constitute approval for the separate redevelopment of any tract if such tract does not comply with applicable zoning and subdivision ordinances.
