The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Riverdale Ventures, LLC.

A.   Final plat.

Recommended Motion: Approve the Final Plat.

2.    Vacation, Ward 7

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Dennis Morris of the City of Minneapolis.

A.   Vacation.

Recommended Motion: Approve the vacation of the subject properties for highway purposes, subject to easements by Xcel Energy. 

3.    Church of St. Joan of Arc Addition, 4537 3rd Ave S, Ward 8

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Church of St. Joan of Arc.

A.   Variance to reduce the minimum front yard requirement adjacent to 3rd Ave S to allow a walkway and patio.

Recommended Motion: Approve the application for a variance to reduce the minimum front yard requirement adjacent to 3rd Ave S from 20 feet to 0 feet to allow a patio/courtyard.

B.    Variance to reduce the minimum interior side yard requirement adjacent to the south lot line to allow a walkway.

Recommended Motion: Approve the application for a variance to reduce the minimum interior side yard requirement adjacent to the south lot line from 7 feet to 0 feet to allow a 5 foot wide walkway.

C.   Site plan review.

Recommended Motion: Approve the application for an approximately 1,800 square foot addition to a place of assembly, subject to the following conditions:

1.     All site improvements shall be completed by October 17, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.    2124 Marshall St NE, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by James Rosenberg.

A.   Conditional use permit.

Recommended Motion: Approve the conditional use permit to allow a dock to be located in the FP Floodplain Overlay District, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The applicant shall demonstrate that all necessary permits have been obtained from the Minnesota Department of Natural Resources.

5.    The Lofts on East Lake, 1405 E Lake St, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Monty Realty.

A.   Site plan review.

Recommended Motion: Approve the application for a mixed-use addition to an existing commercial building, subject to the following conditions:

1.     All site improvements shall be completed by October 17, 2018 unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.     The applicant shall install landscaping and screening along Lake Street in accordance with section 530.170 including installing at least 2 canopy trees in the required landscaped yard where possible based on existing utilities.  In addition the applicant shall install landscaping and screening along the rear property line adjacent to the residential lot that meets the 6 foot height and 95 percent opacity requirement per section 530.170 of the zoning code.

5.     The final lighting plan shall conform to the standards of Chapter 535, Regulations of General Applicability.

6.     Roof top mechanical equipment shall be screened as required by Chapter 535, Regulations of General Applicability.

7.     The applicant shall provide a minimum of 12 short term bicycle parking spaces as required by chapter 541, Off Street Parking and Loading.  Bicycle parking shall not block any required pedestrian walkways. 

6.    Karmel West, 312 W Lake St, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Scott Nelson of DJR Architecture.

A.   Variance to reduce the front yard setback.

Recommended Motion: Approve the application for a variance to reduce the front yard setback from 17 feet to 0 feet for an existing building for the first 25 feet of the shared interior property line along Pleasant Ave as a result of a minor subdivision.

B.    Variance to reduce the northern interior side yard setback.

Recommended Motion: Approve the application to reduce the northern interior side yard setback from nine feet to 0 feet along Pleasant Ave for the proposed vestibule addition and existing building as a result of a subdivision.

1.     The proposed pedestrian walkway shall meet all building code requirements, shall only be used as a pedestrian access, and all exterior signage shall comply with Chapter 543-On-Premises Signs.

C.   Site plan review.

Recommended Motion: Approve the site plan review application to build a second-story addition along W Lake St and first-story vestibule along Pleasant Ave S, subject to the following conditions:

1.     All site improvements shall be completed by October 17, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The applicant shall paint the existing stucco on the first floor and the concrete block color(s) to complement the existing brick.

4.     A minimum of 21 bike parking spaces shall be installed onsite or in the public right-of-way with the permission of the city engineer and that all bike parking spaces meet either the short-term or long-term bicycle parking standards outlined in Section 541-180-Bicycle Parking

5.     All new mechanical equipment is subject to the screening requirements of Chapter 535 and district requirements. In addition, the existing duct work that extends beyond the western property line shall be rerouted within the building to the roof as proposed by the applicant.

6.     Existing and proposed lighting are required to comply with Chapter 535 and Chapter 541 of the zoning code.

7.     The applicant shall provide documentation of the successfully recorded shared parking agreements.

7.    Rana Village, 312 W Lake St and 2900 Pleasant Ave, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Scott Nelson of DJR Architecture.

A.   Rezoning.

Recommended Motion: Approve the application for a petition to rezone the properties located at 2900 Pleasant Ave and a portion of 312 W Lake St from the I2/Medium Industrial District to the R5/Multiple-Family District and the TP/Transitional Parking Overlay District.

B.    Conditional use permit to increase the maximum permitted building height.

Recommended Motion: Approve the application to increase the maximum height in the R5 District from 4 stories or 56 feet to 5 stories or 55 feet, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C.   Conditional use permit to allow for enclosed parking.

Recommended Motion: Approve the application to allow for enclosed parking in the TP/Transitional Parking Overlay District, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The parking serving adjacent commercial uses shall be restricted to the parking of passenger vehicles; and shall be closed with a secured gate or other appropriate mechanism between the hours of 10:00 p.m. and 6:00 a.m.

D.   Variance to increase the maximum allowable floor area ratio of the building.

Recommended Motion: Approve the application for a variance to increase the maximum allowable floor area ratio from 2.4 to 2.47.

1.     The pedestrian promenade shall be installed as shown on the proposed plans. To ensure that the proposal retains this proposed east-west promenade connection shown in the submitted plans, staff recommends a condition of approval that gates shall not be incorporated in the design in accordance with applicable policies of the comprehensive plan and small area plan.

E.    Variance to reduce the northern interior side yard setback for the building.

Recommended Motion: Return the application for a variance to reduce the northern interior side yard setback for the building from 13 feet to 12 feet.

F.    Variance to reduce the southern interior side yard setbacks.

Recommended Motion: Approve the application for a for a variance to reduce the southern interior side yard from 5 feet to 0 feet for a transformer near Pleasant Ave, 13 feet to 5 feet for the new building near Pleasant Ave, and 13 feet to 0 feet for the new building near Grand Ave, subject to the following condition:

1.     An artistic wrap shall be installed over the transformer and generator. The applicant shall submit details of the artistic wrap prior to installation.

G.   Variance to allow a patio exceeding 100 square feet in the front yard along Pleasant Ave.

Recommended Motion: Approve the application for a variance to allow a patio 130 square feet in the front yard along Pleasant Ave, subject to the following condition:

1.     The landscape plan shall be installed as proposed around the ground level patio.

H.   Variance to allow a walkway to exceed six feet in width in the required north interior side yard.

Recommended Motion: Approve the application for a 13 foot wide walkway in the required north interior side yard, subject to the following condition:

1.     Pedestrian lamp posts along the promenade shall be installed as submitted in the application and gates along Grand Ave and Pleasant Ave shall not be incorporated in the design of the promenade.

I.     Variance to allow for a reduction in the drive aisle width and to allow for maneuvering within the public alley.

Recommended Motion: Approve the application for a variance to allow for a reduction in the drive aisle width and to allow for maneuvering within the public alley, subject to the following condition:

1.     A series of bollards shall be installed along the eastern side of the building in order to protect it from being damaged by maneuvering vehicles.

J.     Site plan review.

Recommended Motion: Approve the application for allow for a five-story, apartment building with 120 units., subject to the following conditions:

1.     All site improvements shall be completed by November 18, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The heating, ventilation and air conditioning screens on the outside walls shall be painted to match the surrounding wall finish to help reduce their visibility.

4.     A lighting plan shall be submitted prior to building permit issuance.

5.     Details of the proposed fence shall be submitted prior to preliminary development review approval.

6.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

K.   Minor subdivision to add a portion of the property at 312 W Lake St to the property at 2900 Pleasant Ave.

Recommended Motion: Approve the application for a minor subdivision to add a portion of the property at 312 W Lake St to the property at 2900 Pleasant Ave.

8.    Theatre Garage Marquee Apartments, 2004, 2008, 2012, 2014 and 2018 Lyndale Ave S, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Elizabeth Liebhard.

A.   Rezoning.

Recommended Motion: Approve the application for a rezoning of the properties located at 2008, 2012, 2014, and 2018 Lyndale Ave S from the C1 District to the C2 District.

B.    Conditional use permit.

Recommended Motion: Approve the application for an increase in maximum height from 4 stories or 56 feet to 6 stories or 69 feet, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C.   Variance to increase the maximum floor area ratio.

Recommended Motion: Approve the application for a variance of the maximum floor area ratio from 2.38 to 3.00.

D.   Variance to reduce the required rear yard setback.

Recommended Motion: Approve the application for a variance of the required rear yard from 15 feet to 3 feet, subject to the following conditions:

1.     The parking garage walls shall be screened with year-round landscaping, as shown on the submitted plans. 

E.    Variance to reduce the required south interior side yard setback.

Recommended Motion: Approve the application for a variance of the required side yard from 15 feet to 3 feet.

F.    Site plan review.

Recommended Motion: Approve the application for a six-story, mixed-use building with 113 dwelling units and approximately 8,000 sq. ft. of commercial space, subject to the following conditions:

1.     All site improvements shall be completed by November 18, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The metal mesh for growing vines shall be installed as shown on the south and west elevations. The proposed shrubs shall be incorporated in final plans to ensure that the west elevation is adequately screened year-round. 

4.     Non-residential ground floor windows shall have clear or lightly tinted glass with a visible light transmittance ratio of six-tenths (0.6) or higher.

5.     All new signs are required to meet the requirements of Chapter 543 of the zoning code and separate approvals shall be obtained from CPED.

6.     The proposed chain link fence in the southwest corner of the site shall be vinyl-coated. A decorative fence is encouraged.

9.    Zoning Code Text Amendment, All Wards

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for amendments to Title 20 of the Minneapolis Code of Ordinances.

A.   Zoning Map Amendment

Recommended motion: Approve the amendment to the boundaries of the floodplain district, amending Chapter 521, to reflect the boundaries established in the new Flood Insurance Rate Map panels.

B.    Text Amendment

Recommended motion: Approve the amendments to sections of Chapter 551 relating to the Floodplain Overlay District.
