APPROVAL OF ACTIONS FROM THE AUGUST 1, 2016, MEETING

APPROVAL OF AGENDA

PUBLIC HEARINGS

1.    412 E 48th St and 412 ½ E 48th St, Ward 8

Staff report by Lisa Steiner, BZZ-7819 and MS-247.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Icon Homes LLC.

A.   Variance to reduce the minimum lot width of both parcels.

Recommended Motion: Approve the application for a variance of the minimum lot width requirement for both parcels from 40 feet to 36.44 feet for Parcel A and 38.54 feet for Parcel B.

B.    Variance to reduce the minimum lot area of both parcels.

Recommended Motion: Approve the application for a variance of the minimum lot area requirement from 5,000 square feet to 4,716 square feet for Parcel A and 4,975 square feet for Parcel B.

C.   Minor Subdivision.

Recommended Motion: Approve the application for a minor subdivision to adjust the common lot line.

2.    Phillips Community Center Aquatics Facility, 2323 11th Ave S, Ward 6

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by the Minneapolis Park and Recreation Board.

A.   Site plan review amendment.

Recommended Motion: Approve the application for an approximately 9,500 square foot addition, subject to the following conditions:

1.     All site improvements shall be completed by August 15, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     There shall be at least 149 square feet of windows facing 11th Ave S, 370 square feet of windows facing E 24th St and 149 square feet of windows facing 13th Ave S.

4.     There shall be no other wall signs for the Phillips Community Center Aquatics Facility attached to the building besides the proposed sign over the new canopy located near the existing entrance on the west side of the building.

5.     The transformer shall be wrapped. The design of the wrap shall be reviewed and approved by CPED.

6.     Perennial grasses shall be planted around the transformer for additional screening.

7.     All mechanical equipment shall be screened as required by the standards of Chapter 535, Regulations of General Applicability.

3.    Lake Plaza, 419 Lake St E, Ward 9

This item was continued from the August 1, 2016 meeting.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Brian Houwman.

A.   Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit amendment for an existing shopping center, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.    Site plan review.

Recommended Motion: Approve the application for a site plan review to allow for the construction of a building addition and new parking ramp, subject to the following conditions:

1.     All site improvements shall be completed by August 15, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The applicant shall remove obstructions on the interior of the tenant spaces so as not to block views into and out of the building in the area between four (4) and seven (7) feet above the adjacent grade Lake St E and 5th Ave S to ensure natural surveillance of the site, per section 530.120 of the zoning code.

4.     The applicant shall provide a material or color on all three exposed sides of the exterior of the parking ramp to ensure compatibility with the existing shopping center and add a decorative, perforated metal screen between the floors to disguise the sloped floors and block headlights and parking ramp lighting impacts from the adjacent residential uses to the south and east.

5.     The applicant shall provide a minimum landscaped area of 656.8 square feet, 3 canopy trees and 15 shrubs as required by Chapter 530 Site Plan Review.

6.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.    Central Ave NE Pedestrian Oriented Overlay District Rezoning Study, Central Ave NE between 27th and 18th Aves, Ward 1

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings.

A.   Rezoning Study.

Recommended Motion: Approve the zoning map amendment for the rezoning of parcels in the attached exhibits of the staff report. Staff further recommends that the City Planning Commission adopt the findings and approve the zoning code text amendment, amending Chapter 551.

5.    Zoning Code Text Amendment, All Wards

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings.

A.   Text Amendment: Amending Title 20 of the Minneapolis Code of Ordinances as follows:

      Chapter 520 related to the Zoning Code: Introductory Provisions

The purpose of the amendment is to opt out of Minnesota Statute 462.3593, which authorizes the regulation and permitting of temporary family health care dwelling units.

Recommended Motion: Approve the text amendment.

6.    Zoning Code Text Amendment, All Wards

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings.

A.   Text Amendment: Amending Title 20 of the Minneapolis Code of Ordinances as follows:

Amending Chapter 525: Administration and Enforcement

Amending Chapter 535: Regulations of General Applicability

Amending Chapter 549: Downtown Districts

The purpose of the amendment is to add standards to the zoning code for skyways.

Recommended Motion: Approve the zoning code text amendment.
