The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by the Minnesota Sports Facility Authority.

A.   Preliminary and final plat.

Recommended Motion: Approve the preliminary and final plat.

2.    Street Renaming, Chicago Ave and Kirby Puckett Place between S 3rd St and S 6th St, Wards 3, 6 and 7

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Minnesota Vikings Football, LLC.

A.   Street name change.

Recommended Motion: Approve the petition to change the name of Chicago Ave and Kirby Puckett Place, between S 3rd St and S 6th St, to Vikings Way.

3.    Ryder Truck Rental, Inc., 333-359 Hoover St NE, 332-346 Delano St NE, and 2524 Winter St NE, Ward 1

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Jim Reczek.

A.   Conditional use permit.

Recommended Motion: Approve the application for a truck sales, service, and rental business, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.   Site plan review.

Recommended Motion: Approve the application for a transportation use, subject to the following conditions:

1.     All site improvements shall be completed by March 14, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and exterior lighting plans before building permits may be issued.

3.     All signs shall comply with Chapter 543 of the Zoning Code. All existing signage shall be removed and all new signage shall require a separate permit from CPED.

4.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

5.     Should any ash trees be removed due to the onset or anticipation of disease, they shall be replaced by new deciduous trees in compliance with sections 530.200 and 530.210 of the zoning code, particularly in relation to the restriction on species that are susceptible to disease or are considered invasive species.

6.     The applicant shall provide a defined, well-lit walkway at least four feet in width in front of the south building entrance along the west side of the row of parking along the building wall.

7.     The applicant shall revise the final plans to provide a minimum of one small loading space.

8.     The final landscaping plan shall be revised to demonstrate compliance with the minimum screening requirements along the west parking lot frontage south of the Hoover St NE curb cut, per section 530.170 of the zoning code.

9.     The final plans shall be revised to show the location of the refuse and recycling containers.

10.  All new fencing material and gates shall be shown on the final site plan. In addition, the final site plan shall be revised to show the removal of all references to vinyl slats, barbed wire, and brackets.

4.    Ken and Norms Cooler Extension, 4801 Chicago Ave, Ward 11

A.   Conditional use permit.

Recommended Motion: Continue the application for a conditional use permit application until the March 28, 2016 city planning commission meeting.

5.    823, LLC - 823 15th Ave SE, Ward 2

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Craig Janssen.

A.   Variance.

Recommended Motion: Approve the application for a variance to reduce the minimum lot area requirement from 1,250 square feet of lot area per dwelling unit to 901.6 square feet of lot area per dwelling unit.

B.   Site plan review

Recommended Motion: Approve the application for site plan review, subject to the following conditions:

1.     All site improvements shall be completed by March 14, 2018 unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The first floor of the east and west elevations shall include windows for 20 percent of the elevation, per Section 530.120 of the zoning code. 

4.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

5.     Screening a minimum of six feet in height and 95 percent opaque shall be provided along the north side of the parking lot, in compliance with Section 530.170 of the zoning code.

6.     Screening a minimum of three feet in height and 60 percent opaque shall be provided in the landscaped yards on the west side of the parking lot, in compliance with Section 530.170 of the zoning code and the raingardens in this location shall include plantings. 

7.     A minimum of 12 bicycle parking spaces shall be accommodated within the bike storage room, in compliance with Section 551.1330 of the zoning code. 

6.    Walgreen’s, 2640-2650 Hennepin Ave S, Ward 7

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Marcie Weslock of Elan Lab.

A.   Site plan review.

Recommended Motion: Approve the application for site plan review, subject to the following conditions:

1.     CPED Staff review and approval of the final site plan, lighting plan, landscaping plan, and elevations before permits may be issued. 

2.     All site improvements shall be completed by March 14, 2018, unless extended by the Zoning Administrator, or permits may be revoked for noncompliance.

3.     All required ground floor windows shall have a visible light transmittance ratio of 0.6 or higher.

4.     The signage discouraging right-turns onto 27th Street W shall be retained on site.

5.     The lighting shall to be rearranged so as not to directly or indirectly cause illumination or glare in excess of one-half (1/2) footcandle measured at west property line, due to the adjacent residential uses, in compliance with Section 535.590 of the zoning code. 

6.     Clerestory windows shall be provided on the west elevation, opposite the receiving area, to reduce the length of the blank walls in compliance with Section 530.120 of the zoning code and provide an alternative to the minimum window requirements 

7.     No shelving, signage, merchandise, newspaper racks or other similar fixtures shall be placed in front of the required ground level transparent windows.

8.     The applicant shall not continue the wood fence along the west property line as it would create a maintenance issue for the adjacent garage and the fence itself. 

9.     The bike parking shall be relocated to a convenient and visible area within 50 feet of the principal entrance, in compliance with Section 541.180 of the zoning code, and landscaping shall be provided for the length of the landscaped yard between the north row of parking stalls and Hennepin Ave, in compliance with Section 530.170 of the zoning code. 

B.   Minor Subdivision.

Recommended Motion: Approve the application for a minor subdivision.

7.    Augsburg College Hagfors Center for Science, Business and Religion, 628 21st Ave S, 2015 S 7th St, 623 20th Ave S, 2011 S 6th St and 606 21st Ave S, Ward 2

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Augsburg College.

A.   Conditional use permit for a college expansion.

Recommended Motion: Approve the application for a college expansion, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The TDMP commitments shall be adhered to.

B.   Variance to allow parking between a front property (S 6th St) line and the building.

Recommended Motion: Approve the application for a variance to allow parking between a front property line (S 6th St) and the building, subject to the following conditions:

1.     The proposed parking lot shall be set back approximately 17 feet from the front property line along S 6th St.

2.     Dense landscaping including canopy trees, ornamental trees and shrubs shall be provided in the area between the parking lot and the property line.

C.   Variance to reduce the required front yard setbacks along 21st Ave S.

Recommended Motion: Approve the application for to reduce the required front yard setbacks along 21st Ave S for the skyway from 15 feet to zero feet on both the proposed development property and the existing library, subject to the following conditions:

1.     To help minimize the visual impact of the skyway it shall be constructed of clear or lightly-tinted glass.

2.     The applicant is encouraged to design the skyway using bird-safe design.

D.   Site plan review.

Recommended Motion: Approve the application for a new 4-story, 136,000 square foot building with classrooms, laboratories and offices, subject to the following conditions:

1.     All site improvements shall be completed by March 14, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     All mechanical equipment shall be screened per the requirements of Chapter 535, Regulations of General Applicability.

4.     The exterior lighting fixture details shall be provided to ensure that the overall height of the lights are in conformance with the standards of Chapter 535, Regulations of General Applicability.

5.     In the parking lot located south of vacated S 8th St between 20th Ave S and vacated 21st Ave S, shrubs or perennials shall be planted in the green space located between the north side of the sidewalk and the curb line of the former public street (South 8th Street) to help screen the parking area from the residential uses to the north. The landscaping shall be at least three-feet in height and at least 60 percent opaque.

6.     In the parking lot located south of vacated S 8th St between 20th Ave S and vacated 21st Ave S, a three-foot screen consisting of landscaping that is at least 60 percent opaque shall be provided along 20th Avenue South to help screen the parking lot from the public street.

7.     In the parking lot located south of vacated S 8th St between 20th Ave S and vacated 21st Ave S, shrubs or perennials shall be planted along 21st Ave S to help screen the parking area from the residential uses to the east. The landscaping shall be at least three-feet in height and at least 60 percent opaque.

E.    Preliminary and final plat (PL-301).

Recommended Motion: Approve the preliminary and final plat.

F.    Vacation of retained easements in vacated 7th St S between 20th and 21st Aves S (Vac-1655).

Recommended Motion: Approve the vacation of the retained easements in vacated S 7th St between 20th and 21st Aves S subject to the retention of easements for CenterPoint Energy, Comcast and Xcel Energy.

8.    Kraus Anderson Block Redevelopment, 501, 507, 515 and 523 S 8th St, 502 and 518 S 9th St and 811 5th Ave S, Ward 7

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Kraus-Anderson.

A.   Conditional use permit for a planned unit development.

Recommended Motion: Approve the application for a Planned Unit Development, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     As required by section 527.120 of the zoning code, the development shall comply with the standards for underground parking, decorative or pervious surfaces for on-site parking and loading areas, drives, driveways and walkways, pedestrian improvements, a recycling storage area, and the minimum standards for LEED Silver Certification for the office building from Table 527-1, Amenities totaling a minimum of 20 points.

B.   Site plan review.

Recommended Motion: Approve the application for a planned unit development including a 306-unit residential building, a 161-room hotel with a restaurant, a 12,000 square-foot brewery, a 13,000 square-foot event center, a 103,000 square-foot office building for Kraus-Anderson and 520 underground parking spaces, subject to the following conditions:

1.     All site improvements shall be completed by March 14, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     All mechanical equipment shall be screened per the requirements of Chapter 535, Regulations of General Applicability.

4.     The final lighting plan shall conform to the standards of Chapter 535, Regulations of General Applicability.

C.   Registered land survey.

Recommended Motion: Approve the Registered Land Survey, subject to the following conditions:

1.     The Reciprocal Easement Agreement shall be recorded with Hennepin County.

2.     This RLS creates tracts that, if separately redeveloped, would not meet the requirements of the zoning and subdivision ordinance for lot frontage on a public street. Approval of this RLS does not constitute approval for the separate redevelopment of any tract if such tract does not comply with applicable subdivision ordinances.

9.    116 East Hennepin Redevelopment, 112 E Hennepin Ave, Ward 3

This item was continued from the February 22, 2016 meeting.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Schafer Richardson.

A.   Conditional use permit to increase the maximum permitted height.

Recommended Motion: Approve the application for an increase in maximum height from 4 stories or 56 feet to 6 stories, 75 feet, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.   Variance to increase the maximum floor area ratio.

Recommended Motion: Approve the application for a variance to increase the maximum floor area ratio from 3.78 to 4.51.

C.   Variance to reduce the required interior side yard.

 Recommended Motion: Approve the application for a variance to reduce the required interior side yard from 15 feet to 5 feet on floors 2 through 6.

D.   Variance of the PO Pedestrian Oriented Overlay District standards.

Recommended Motion: Return the application to reduce the minimum window requirement below 40 percent along Lourdes Place.

E.    Variance of the non-residential minimum parking requirement.

Recommended Motion: Approve the application for a variance of the minimum nonresidential parking requirement from 8 spaces to 0 spaces, subject to the following condition:

1.     At least 16 bicycle parking spaces shall be provided for the nonresidential uses. Bicycle parking in the public right-of-way will require an encroachment permit from Public Works.

F.    Variance to increase the percentage of allowable compact parking spaces.

Recommended Motion: Approve the application for a variance of the percentage of required parking spaces that may be satisfied by providing compact spaces.

G.   Site plan review.

Recommended Motion: Approve the application for a site plan review, subject to the following conditions:

1.     All site improvements shall be completed by March 14, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The first floor of the southeast façade shall be designed with inset brick as shown on the submitted elevations to provide visual interest and mitigate the blank wall.

4.     At least 83 square feet of glass area, as shown on the submitted plans, shall be incorporated in the new construction portion of the Lourdes Place façade. This may be accommodated in windows, garage doors, and pedestrian doors.
