The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Jeremy Rupp of Concord Universal, LLC.

A.   Minor subdivision to allow for a party-wall split of an existing duplex. The purpose of this subdivision is to allow separate ownership of both sides of the duplex.

Recommended motion: Approve the application for a minor subdivision to allow for a party-wall split of an existing duplex in the R2B Two-Family District, subject to the following condition:

1.     The applicant shall provide evidence of proper filing of the covenants with requirements found in Section 598.240 (5).

2.    1041 24th Ave SE, Ward 1

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Joel Hussong.

A.   Expansion of non-conforming use.

Recommended motion: Approve, subject to the following conditions:

1.     All site improvements shall be completed by April 13, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     The exterior of the addition shall be stucco to match the existing structure in terms of materials and color. 

3.    Mill City High School, 810 7th St S and 815 6th St S, Ward 6

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Dan Collision.

A.   Conditional use permit application to allow a new charter high school within the existing First Covenant Church’s building.

Recommended motion: Approve, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     Bike racks that accommodates 24 bicycles.  Not less than 50 percent of the required bicycle parking shall meet the standards for short term bicycle parking (541.180 (b) (1).

3.     The two-foot high wood fence in the landscaped yard along the perimeter of the surface parking area for both 810 7th St S and 615 6th St S shall be replaced with a decorative metal fence ranging in height from three to six feet. In addition, the landscaped yards along the perimeter of the surface parking area for both parcels shall have plantings (a combination of existing and new) that form a screen that is three feet in height and not less than 60 percent opaque. All landscaped areas shall be in compliance with ground cover requirements outlined in section 530.180.

4.     The existing screening of the refuse and recycling shall be replaced with screening that is in compliance with Section 535.80 and have an exterior material compatible with the principal building.

5.     All site improvements shall be completed by April 13, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

4.    CenterPoint Energy and MeetMinneapolis Signage,501-05 Nicollet Mall, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by CenterPoint Energy.

A.   Conditional use permit for a dynamic signs.

Recommended motion: Approve the conditional use permit for dynamic signs, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.    Variance to allow for more than one dynamic sign.

Recommended motion: Approve the variance for five dynamic signs, subject to the following condition:

1.     Approval of the sign permit and master sign plan by the Department of Community Planning and Economic Development.

C.   Variance to increase the maximum height of dynamic signs.

Recommended motion: Approve the variance to increase the maximum height of dynamic signs from 14 feet to approximately 18.5 feet, subject to the following condition:

1.     Approval of the sign permit and master sign plan by the Department of Community Planning and Economic Development.

D.   Variance to increase the maximum area of dynamic signs.

Recommended motion: Approve the variance to increase the maximum area of dynamic signs from 32 square feet to approximately 240 square feet, for five dynamic signs subject to the following condition:

1.     Approval of the sign permit and master sign plan by the Department of Community Planning and Economic Development.

E.    Variance for the duration of message of dynamic signs.

Recommended motion: Approve the variance for the duration of message for dynamic signs, subject to the following condition:

1.     Approval of the sign permit and master sign plan by the Department of Community Planning and Economic Development.

F.    Variance to increase the maximum height of two wall signs.

Recommended motion: Approve the variance to increase the maximum height of two wall signs from 28 feet to approximately 40 and 37.5 feet, subject to the following condition:

1.     Approval of the sign permit and master sign plan by the Department of Community Planning and Economic Development.

5.    Dangerous Man Brewing Company Expansion,1300 2nd St NE (1304 2nd St NE), Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Sarah Bonvallet, on behalf of Dangerous Man Brewing Company.

A.   Amend the conditional use permit to expand the limited production and processing beer brewing facility in the C1 (Neighborhood Commercial) District.

Recommended motion: Approve, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The main entrance of the building shall open to a retail or office component equal to not less than 15% of the floor area of the use.

3.     The first floor of the building shall comply with the window requirements as required per section 530.120 of the Zoning Code. Windows shall allow views into and out of the building at eye level. Shelving, mechanical equipment or other similar fixtures shall not block views into and out of the building.

B.    Variance to increase the gross floor area of the limited production and processing use.

Recommended motion: Approve the variance to further increase the limited production and processing use up to approximately 1,700 square feet.

6.    Calhoun Square, 3001 and 3003 Hennepin Ave and 1301 and 1409 W Lake St, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Stuart Ackerberg with Calhoun Square Endeavors LLC.

A.   Site plan review for modifications to the existing Calhoun Square building.

Recommended motion: Approve the site plan review application for building modifications to the existing Calhoun Square shopping center, subject to the following conditions:

1.     Approval of the final site plan, landscaping plan, elevations and lighting plan by the Department of Community Planning and Economic Development

2.     All site improvements shall be completed by April 13, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

7.    4609 28th Ave S, Ward 12

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Lora Grgich.

A.   Expansion of a nonconforming use.

Recommended motion: Deny the expansion of a nonconforming use to allow a third-story addition to a four-plex in the R2B Two-family District.

B.    Conditional use permit to increase the height of the building in the SH Shoreland Overlay District.

Recommended motion: Deny the conditional use permit to increase the height of the building in the SH Shoreland Overlay District from 2.5 stories or 35 feet to 3 stories or 35 feet.

C.   Variance to increase the floor area ratio of the building.

Recommended motion: Deny the variance to increase the floor area ratio of the building from .5 to .87.

D.   Variance to reduce the north interior side yard setback.

Recommended motion: Deny the variance to reduce the north interior side yard setback from 9 feet to 4.8 feet.

E.    Variance to reduce the south interior side yard setback.

Recommended motion: Deny the variance to reduce the south interior side yard setback from 9 feet to 4.9 feet.

8.    Depot Renaissance Expansion,300 Washington Ave S (225 3rd Ave S), Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by CSM Corporation.

A.   Site Plan Review to construct building additions.

Recommended motion: Approve the application for a single-story addition (6th floor) on top of the existing Depot Renaissance Hotel as well as to allow for an infill addition which results in additional guest rooms, a fitness center, a concierge lounge and pool, subject to the following conditions:

1.     All site improvements shall be completed by April 13, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.

2.     Approval of the final site, elevation, and landscaping plans by CPED.

3.     The site plan shall be modified to reflect the following modifications along 5th Ave S: reduce the northerly curb cut width from 19 feet to 16 feet; reduce the southerly curb cut width from 45 feet to 20 feet all while elevating the public sidewalk in this location so that it ties into and flows at one continuous grade along the street. 

4.     The proposal shall meet all applicable requirements and conditions as approved by the Heritage Preservation Commission per BZH-28550.

5.     No alterations or modifications are approved to the Milwaukee Road Depot building or Freight House.

9.    The Lock Up Self Storage, 701 7th St N and 618 7th Ave N, Ward 5

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Beck Law Office, on behalf of Lock Up Minneapolis 701, LLC.

A.   Conditional use permit to allow an 11-space surface parking lot in the DP Overlay District.

Recommended motion: Approve the conditional use permit, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.    Variance to reduce the minimum off-street parking requirement.

Recommended motion: Approve the variance for a reduction in the off-street parking requirement from 23 spaces to 11 spaces.

C.   Variance to reduce the minimum off-street loading requirement.

Recommended motion: Approve the variance for a reduction in the off-street loading requirement from 3 large spaces to 3 small spaces.

D.   Site plan review for a new self-service storage building.

Recommended motion: Approve the site plan review application for a new 4-story, approximately 95,640 square foot self-service storage facility, subject to the following conditions:

1.     CPED Staff review and approval of the final site, elevation, lighting and landscaping plans before building permits may be issued.

2.     All site improvements shall be completed by April 13, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

3.     The office space and retail/café space shall each have a separate principal entrance facing the public street.

4.     In the interim period until a tenant is located for the retail/café space, the area must meet window requirements and allow clear views into and out of the space.  Stacking and storage of materials in front of the windows shall not be permitted.

5.     The outdoor space adjacent to Oak Lake Ave shall be reduced in size to approximately 900 square feet and shall be landscaped with built in planters that are maintained year-round regardless of whether there is an occupant of the retail/café space.

6.     The south elevation of the structure adjacent to 7th Ave N shall meet the 30% window requirement per Section 530.120 of the Zoning Code.  Display windows do not count towards the 30% window requirement.

7.     The building shall be modified to comply with the 10% window requirement on all elevations, floors 2-4, as applicable per Section 530.120 of the Zoning Code.

8.     A minimum of a two inch reveal between the panels proposed on the exterior building walls shall be provided so that the building complies with the blank wall provision per Section 530.120 of the Zoning Code. 

9.     All landscaping and screening requirements shall be incorporated into the final plans adjacent to 7th St N and 7th Ave N as applicable per Section 530.170 of the Zoning Code.

10.  The final landscape plan shall be modified to comply with the 20% landscape requirement by removing asphalt and incorporating landscaping adjacent to the north property line in the area of the previously vacated alley.

11.  The final landscape plan shall be modified to incorporate the required quantities, to comply with the proximity of parking spaces to on-site deciduous trees and to include a combination of deciduous and evergreen shrubs on the property in order to provide a mix of plantings as required by Section 530.160 and 530.170 of the Zoning Code.

12.  A well-lit walkway at least 4 feet shall connect the building and the adjacent public sidewalks to all on-site parking as required by Section 530.130 of the Zoning Code. 

13.  All roof-top mechanical units shall be screened in compliance with Section 535.70 of the Zoning Code.

14.  The lighting plan shall be modified to eliminate spillover onto adjacent properties. All lighting will need to be downcast and shielded to avoid undue glare. All lighting shall comply with Chapters 535 and 541.

15.  Should a retail tenant/café tenant be secured in the building, the development shall comply with the bicycle parking provisions as required in Section 541.180 of the Zoning Code.

10.  North Loop Green PUD/T3 – Second Phase of the Planned Unit Development,316 3rd Ave N, Ward 3

Recommended motion: Continue the conditional use permit to amend a planned unit development (BZZ-5484) to allow for Phase II - a new office building to the April 27, 2015, City Planning Commission meeting.

B.    Conditional use permit for a surface parking lot in the DP Downtown Parking Overlay District.

Recommended motion: Continue the conditional use permit for a surface parking lot in the DP Downtown Parking Overlay District to the April 27, 2015, City Planning Commission meeting.

C.   Variance to increase the Floor Area Ratio of the building.

Recommended motion: Continue the variance to increase the Floor Area Ratio of the building from 4.8 to 5.32 to the April 27, 2015, City Planning Commission meeting.

D.   Site plan review for a new office building.

Recommended motion: Continue the site plan review for a new office building to the April 27, 2015, City Planning Commission meeting.

E.    Preliminary and final plat.

Recommended motion: Continue the preliminary and final plat to the April 27, 2015, City Planning Commission meeting.

11.  Brickhouse Lofts, 150 26th Ave SE, Ward 2

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Maxwell Ventures, LLC.

A.   Conditional use permit for a planned unit development.

B.    Variance to the minimum ground floor window requirements of the PO, Pedestrian Oriented Overlay district.

C.   Site plan review to construct a three story (two floor) addition above each existing building and establish 315 dwelling units.

12.  Zoning Code Text Amendment, Citywide

The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt staff findings for the zoning code text amendment.

A.   Amending Title 20 of the Minneapolis Code of Ordinances as follows:

Amending Chapter 546 related to Zoning Code:  Residence Districts

Amending Chapter 547 related to Zoning Code:  Office Residence Districts

 

The purpose of the amendment is to revise regulations related to the calculation of floor area of single- and two-family dwellings. 

Recommended motion: Approve the zoning code text amendment, amending Chapter 546, Residence Districts, and Chapter 547, Office Residence Districts.
