1.     Land Sale – 3354 Penn Ave N (Staff: Jim Voll)

Review for consistency with the Comprehensive Plan the sale of 3354 Penn Ave N for construction of a new day-care building.

Recommended Motion: Approve the staff report - the item consistent with the Minneapolis Plan.

2.     Broadway Flats TIF Plan – 2220 West Broadway, 2512 Queen Ave N, and 2413-2511 Penn Av N (Staff: Jim Voll)

Review land use for consistency with the comprehensive plan for the Broadway Flats TIF Plan.

Recommended Motion: Approve the staff report - the item consistent with the Minneapolis Plan.

3.     Modification No. 1 to the 50th and France Tax Increment Finance Plan (Staff: Brian Schaffer)

Review for consistency with the comprehensive plan the Modification to the 50th and France Tax Increment Finance Plan.

Recommended Motion: Approve the staff report - the item consistent with the Minneapolis Plan.

Introduction to the Public Hearing

1. Vacation-1602 (Ward: 6) (Janelle Widmeier).

Staff report

A. Vacation: Application by Seward Commons to vacate excess street right-of-way in the vicinity of Snelling Ave and 22nd St E, where 22nd St E was recently reconstructed and connected to Cedar Ave.  Once vacated, the land is proposed to be incorporated into a future redevelopment site.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the vacation, subject to the retention of easements by Xcel Energy.

2. Minnesota Sports Facilities Authority vacations (Vac-1619 and Vac-1622, Ward: 3) (Hilary Dvorak).

Staff report

A. Vacation: Application by Steve Maki with the Minnesota Sports Facilities Authority to vacate 5th Street South, lying northwesterly of 6th Street South and lying between Chicago Avenue and 11th Avenue South. Vacation (Vac 1619).

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission continue indefinitely the application to vacate 5th Street South lying northeasterly of 6th Street South and lying between Chicago Avenue and 11th Avenue South.

B. Vacation: Application by Steve Maki with the Minnesota Sports Facilities Authority to vacate parts of 4th Street South, adjoining the East side of the Metrodome parcel. Vacation (Vac 1622).

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission continue indefinitely the application to vacate parts of 4th Street South adjoining the East side of the Metrodome parcel.

3. CART Ambulance (BZZ-6857, Ward: 2), 2501 Minnehaha Ave (Becca Farrar).

Staff report

A. Conditional Use Permit: Application by 2501 Minnehaha Property LLC, for a conditional use permit to allow an ambulance service within the existing building located at 2501 Minnehaha Ave.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow an ambulance service within the existing building on the property located at 2501 Minnehaha Ave, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Site Plan Review: Application by 2501 Minnehaha Property LLC, for a site plan review to allow a transportation use (ambulance service) to operate on the property located at 2501 Minnehaha Ave. The property is zoned I2 (Medium Industrial).

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow a transportation use (ambulance service) on the property located at 2501 Minnehaha Ave subject to the following conditions:

  1. All site improvements shall be completed by October 27, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.
  2. Approval of the final site, landscaping, and lighting plans by CPED.
  3. The site plan shall be modified so that the curb cut along E 25th St is shifted to the east to align with the parking lot, and correspondingly the landscaping extended along E 25th St to correspond with the reconfigured curb cut while still allowing access to the overhead door located on that building elevation. 
  4. The landscape plan along Minnehaha Ave shall be improved and enhanced to include columnar landscaping adjacent to the building near the driveway as well as additional landscaping in the southernmost landscape area abutting the subject property to the south.
  5. The landscape plan along E 25th St shall be improved and enhanced to include a wider variety and quantity of plantings. Further, the hedge shall meet the minimum screening height of 3 feet when planted.
  6. All parking spaces shall be located within 50 feet of an on-site deciduous tree.

4. Goodin Company Parking Lot (BZZ-6811, Ward: 5), 2715 Pacific St (Becca Farrar).

Staff report

A. Conditional Use Permit: Application by Goodin Company for a conditional use permit to allow a principal parking facility for 48 vehicles and an outdoor storage area on the property located at 2715 Pacific St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow a 48 space principal parking facility on the property located at 2715 Pacific St, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Site Plan Review: Application by Goodin Company for a site plan review to allow a principal parking facility and an outdoor storage area on the property that will be used by Goodin Company, a wholesale plumbing and heating distributorship located on the property at 2700 2nd St N. The property is zoned I2 (Medium Industrial) District and is located in the MR (Mississippi River) Critical Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow for the establishment of a 48 space principal parking facility and outdoor storage area on the property located at 2715 Pacific St subject to the following conditions:

  1. All site improvements shall be completed by October 27, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.
  2. Approval of the final site, landscaping, and lighting plans by CPED.
  3. The site/landscape plan shall be modified to comply with the 20% landscaping requirement.
  4. The site/landscape plan shall be modified to include 20 deciduous trees, 12 coniferous trees and a total of 169 shrubs. 
  5. All areas not identified as parking or for outdoor storage shall be landscaped as required.

5. Eureka Recycling (BZZ-6837, Ward: 1), 454 Coolidge St NE (Becca Farrar).

Staff report

A. Conditional Use Permit: Application by Barbeau Architects, Inc., on behalf of KLJS Limited Partnership and Eureka Recycling, to amend the conditional use permit to expand the existing recycling facility located at 454 Coolidge St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow for an expansion of a recycling facility at the property located at 454 Coolidge St NE, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Site Plan Review: Application by Barbeau Architects, Inc., on behalf of KLJS Limited Partnership and Eureka Recycling, for a site plan review to allow for an approximate two-story, 9,800 square foot addition to the existing recycling facility located at 454 Coolidge St NE in order to allow additional enclosed area for the tipping floor.  The property is zoned I2 (Medium Industrial) District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow for a 9,800 square foot addition to the existing recycling facility on the property located at 454 Coolidge St NE, subject to the following conditions:

  1. Approval of the final site, landscaping, elevation and lighting plans by the Department of Community Planning and Economic Development
  2. All site improvements shall be completed by October 27, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. No parking shall be permitted on areas not paved and designated for parking.  No parking shall be permitted in the required landscaped areas adjacent to Kennedy St NE.
  4. The site shall be in compliance with the approved site/landscape plan, BZZ-1401.

6. The Encore (BZZ-6843, Ward: 3), 935 2nd St S (Hilary Dvorak).

Staff report

A. Conditional Use Permit: Application by Tony Kuechle with Sherman Associates for a conditional use permit to amend an existing Planned Unit Development to construct a new 12-story, approximately 176 657 square foot, 122-unit residential building located at 935 2nd St S. The property is zoned C3A Community Activity Center District and is located in the DP Downtown Parking Overlay District and the DH Downtown Height Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to amend an existing Planned Unit Development to construct a new 12-story, approximately 176,657 square foot, 124-unit residential building at the property located at 935 2nd St S, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. As required by section 527.120 of the zoning code, the development shall comply with the standards for some combination of the following amenities from Table 527-1, Amenities and those proposed by the applicant totaling a minimum of 15 points: underground parking, outdoor open space, decorative fencing, enhanced exterior lighting, pet exercise area and recycling storage area.
  3. There shall be a minimum of two visitor parking spaces designated on site.
  4. There shall be a minimum of one bicycle parking space per dwelling unit provided within the building.

B. Variance: Application by Tony Kuechle with Sherman Associates for a variance to increase the floor area ratio (FAR) of the building located at 935 2nd St S from the permitted 4.8 to 5.62.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to increase the floor area ratio (FAR) of the building from 4.8 to 5.62 located at 935 2nd St S.

C. Site Plan Review: Application by Tony Kuechle with Sherman Associates for a site plan review for the property located at 935 2nd St S.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow a new 12-story, approximately 176,657 square foot, 124-unit residential building at the property located at 935 2nd St S, subject to the following conditions:

  1. Approval of the final site plan, elevations, floor plan, landscaping plan and lighting plan by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by October 27, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The applicant shall work with the utility company to try and locate the transformer along 10th Ave S to the south side of the building and then screen it with landscaping.
  4. The applicant shall design the east side of the twelfth floor and the south side of the first floor so as to not have any expanse of wall that is over 25 feet in length and blank.
  5. No less than six canopy trees or 12 ornamental trees shall be provided on the site.
