Action: The City Planning Commission approved the staff recommendation and found the item consistent with the Minneapolis Plan.
2.     Land Sale – 5207 Girard Ave N (Staff: Jim Voll)
Review for consistency with the Comprehensive Plan the sale of 5207 Girard Ave N for construction of a new single-family home.

A. Variance: Application by Doran University II, LLC, for a variance to allow an increase in fence height for an existing decorative wrought iron fence from 4 feet to 6 feet in a required corner side yard setback (along 12th Ave SE) and front yard setback (along 5th St SE) for the property located at 406 12th Ave SE.
Action: The City Planning Commission adopted the findings and approved the application for a variance to allow an increase in fence height for an existing decorative aluminum fence from 4 feet to 6 feet in a required corner side yard setback (along 12th Ave SE) and front yard setback (along 5th St SE) for the property located at 406 12th Ave SE.

B. Site Plan Review: Application by Jay Althof, on behalf of Unison Comfort Technologies, for a site plan review for a principal parking facility containing 141 vehicle parking spaces located at 55 28th Ave N.
Action: The City Planning Commission adopted the findings and approved the site plan review application to allow principal parking facility containing 141 parking spaces at the property located at 55 28th Ave N, subject to the following conditions:
  1. All site improvements shall be completed by July 14, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.
  2. Approval of the final site, landscaping, and lighting plans by CPED.
  3. Fences shall be constructed, designed, and maintained per section 535.430 of the zoning code.
  4. The applicant shall work with CPED to increase the number of on-site deciduous trees to increase compliance with the 25-foot linear feet requirement for parking lot frontages as well as the requirement that all surface parking stalls be within 50 feet of an on-site deciduous tree.
  5. The applicant shall indicate the materials of all landscaped areas per section 530.180 of the zoning code.
  6. All signs are expected to comply with Chapter 543 of the zoning code. All new signage requires a separate permit from CPED.
  7. The applicant or property owner shall be responsible for maintaining and replacing landscape materials and trees in the public right-of-way according to section 530.210.

A. Site Plan Review: Application by Cermak Rhoades Architects, on behalf of NuWay, Inc., for a site plan review to allow for the conversion of an existing building most recently used as a commercial use into a 22-unit apartment building on the property located at 2118 Blaisdell Ave. The property is located in the OR2 (High Density Office Residence) District.
Action: The City Planning Commission continued the site plan review application to allow for the conversion of an existing structure into 22 apartment units in the building located at 2118 Blaisdell Ave, to the July 28, 2014, meeting.

A. Conditional Use Permit: Application by APPRO Development, on behalf of Robeli Enterprises, for a conditional use permit for the expansion of an existing minor automobile repair facility located at 5355 34th Ave S in the C1: Neighborhood Commercial District and the AP: Airport Overlay District.
Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow the expansion of an existing minor automobile repair facility at the property located at 5355 34th Ave S, subject to the following conditions:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

Action: The City Planning Commission adopted the findings and approved the application for a variance to increase the maximum size of a commercial use in the C1 District from 4,000 square feet to approximately 4,495 square feet at the property located at 5355 34th Ave S.

C. Site Plan Review: Application by APPRO Development, on behalf of Robeli Enterprises, for a site plan review for the expansion of an automobile services use located at 5355 34th Ave S.
Action: The City Planning Commission adopted the findings and approved the site plan review application to allow an addition to an existing minor automobile repair facility at the property located at 5355 34th Ave S, subject to the following conditions:
  1. Approval of the final site plan, landscaping plan, and elevations by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by July 14, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The proposed sign changes require a separate sign permit from CPED.
  4. Mechanical equipment shall be screened as required by section 535.70 of the zoning code.
  5. If the existing fence along the northern property line is ever removed, the applicant will provide on-site screening of the parking area that is at least six feet in height and 95 percent opaque.
  6. Landscape maintenance should incorporate environmentally sound management practices, as specified in section 530.210.
  7. Windows on the 54th St E and 34th Ave S elevations will be clear or lightly tinted glass with a visible light transmittance ratio of six-tenths (0.6) or higher as required by section 530.120 of the zoning code.

7. Mill City Quarter Phase I (BZZ-6616, Ward: 3), 300 2nd St S (Janelle Widmeier). 
A. Site Plan Review: Application by BKV Group, Inc., on behalf of Mill City Quarter, LLC, has applied for a site plan review to allow a 6-story mixed use building with 150 dwelling units and ground floor retail for the property located at 300 2nd Ave S.
Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a new 6-story, mixed use building with ground floor retail and 150 dwelling units for the property located at 300 2nd St S, subject to the following conditions:
  1. Along 3rd Ave, the applicant is encouraged to increase the setback of the first floor building wall and explore other ways to improve the pedestrian environment.
  2. The applicant shall provide additional cast stone on the north elevation, consistent with the approvals granted by the Heritage Preservation Commission.
  3. Required nonresidential windows shall not be blocked by fixtures in the area between 4 and 7 feet above the adjacent grade and the visible light transmittance of the windows shall be 0.6 or greater as required by section 530.120 of the zoning code. 
  4. To create continuity in the screen wall adjacent to the woonerf, staff encourages the applicant to use the same green screen design for the transformer screening.
  5. Department of Community Planning and Economic Development staff review and approval of the final building elevations, floor, site, lighting and landscape plans.
  6. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by July 14, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow an amendment for an accessory parking lot located in the DP Downtown Parking Overlay District for the property located at 101 3rd Ave S, subject to the following condition:

Action: The City Planning Commission adopted the findings and approved the application for a variance of the DP Downtown Parking Overlay District standards to allow up to 80 parking spaces for the property located at 101 3rd Ave S.

C. Site Plan Review: Application by BKV Group, Inc., on behalf of Mill Place, Inc., for a site plan review for the property located at 101 3rd Ave S.
Action: The City Planning Commission adopted the findings and approved the site plan review application to allow an accessory parking lot for the property located at 101 3rd Ave S, subject to the following conditions:
  1. The applicant shall explore opportunities to locate all parking spaces within 50 feet of a tree and provide a minimum width of 7 feet for tree islands as required by section 530.170 of the zoning code.
  2. Accessible parking shall be provided as required by the Minnesota State Building Code.
  3. Maneuvering shall occur on-site as required by section 541.290 of the zoning code.
  4. The applicant shall work with Department of Community Planning and Economic Development staff to provide appropriate screening for the refuse storage containers and the transformer. 
  5. Department of Community Planning and Economic Development staff review and approval of the final site, lighting and landscape plans.

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a new 6-story, 66-unit residential building with ground floor commercial space at the properties located at 1227 4th St SE and 425 13th Ave SE, subject to the following conditions:
  1. Approval of the final site plan, landscaping plan, elevations and lighting plan by the Department of Community Planning and Economic Development.

  3. The applicant shall either construct raised planters, grade the land differently or plant landscape materials that will make the residential windows appear lower to the ground along 13th Ave SE.
  4. Not less than 104 of the 115 required bicycle parking spaces for the residential portion of the building shall be located within the building.
  5. At least three bicycle parking spaces shall be provided on site for the commercial portion of the development.
  6. To better screen the transformer/generator, additional landscape materials shall be located along the north property line.
  7. A side light equal in size and height to the door along 13th Ave SE shall be added next to the door and they shall be centered to align with the bank of windows above.

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a new, mixed-use building with 20 residential dwelling units and approximately 6,155 square feet of commercial space at the properties located at 4250 and 4264 Upton Ave S, subject to the following conditions:
  1. Approval of the final site, elevation, landscaping, and lighting plans by CPED.
  2. All site improvements shall be completed by July 14, 2016, unless extended by the zoning administrator, or the permit may be revoked for non-compliance.
  3. All signs are expected to comply with Chapter 541 of the Zoning Code. All new signage requires a separate permit from CPED.
  4. Landscape materials that reach a minimum height of five feet shall be used to screen the transformer from the public sidewalk along Upton Ave S.

13. Marcy Holmes Master Plan and Dinkytown Business District Plan (Ward: 3), (Haila Maze).
A. Master Plan: Consider the adoption of the Marcy-Holmes Neighborhood Master Plan and Dinkytown Business District Plan documents.
Action: The City Planning Commission recommended that the City Council approve the Marcy-Holmes Neighborhood Master Plan and Dinkytown Business District Plan document and amend the policy guidance for the area into the City’s comprehensive plan. The comprehensive plan amendment is subject to final review and approval by the Metropolitan Council.
