The Planning Commission approved the actions from the June 9, 2014 meeting.

1.     Seward Friendship Co-op Redevelopment Plan (Staff: Paul Mogush)

Review for consistency with the comprehensive plan the establishment of the Seward Friendship Co-op Redevelopment Plan.

Action: The City Planning Commission approved the staff recommendation and found the item consistent with the Minneapolis Plan.

2.     Public Land Sale - 3800 Clinton Ave  (Staff: Paul Mogush)

Review for consistency with the comprehensive plan the sale of 3800 Clinton Ave for development of a grocery store.

Action: The City Planning Commission approved the staff recommendation and found the item consistent with the Minneapolis Plan.

3.     Public Land Sale - 3735 22nd Ave S  (Staff: Paul Mogush)

Review for consistency with the comprehensive plan the sale of 3735 22nd Ave S for development of a single family home.

Action: The City Planning Commission approved the staff recommendation and found the item consistent with the Minneapolis Plan.

4.     Public Land Sale - 2447 16th Ave S Land Sale (Staff: Paul Mogush)

Review for consistency with the comprehensive plan the sale of 2447 16th Ave S for use as a community garden.

Action: The City Planning Commission approved the staff recommendation and found the item consistent with the Minneapolis Plan.

5.     Public Land Sale – 3029 Clinton Ave (Staff: Paul Mogush)

Review for consistency with the comprehensive plan the sale of 3029 Clinton Ave for use as a single family home.

Action: The City Planning Commission approved the staff recommendation and found the item consistent with the Minneapolis Plan.

6.     Public Land Sale – 3532 Chicago Ave (Staff: Paul Mogush)

Review for consistency with the comprehensive plan the sale of 3532 Chicago Ave for use as a single family home.

Action: The City Planning Commission approved the staff recommendation and found the item consistent with the Minneapolis Plan.

7.     Public Land Sale – 3545 Columbus Ave (Staff: Paul Mogush)

Review for consistency with the comprehensive plan the sale of 3545 Columbus Ave for use as a single family home.

Action: The City Planning Commission approved the staff recommendation and found the item consistent with the Minneapolis Plan.

Public Hearings

1. 222 (RLS-72, Ward: 3), 222 Hennepin Ave (Becca Farrar).

A. Registered Land Survey: Application by Ryan Companies US, Inc., for a Registered Land Survey (RLS) for the property located at 222 Hennepin Ave.  The purpose of the RLS is to separate the property both vertically as well as horizontally into independent tracts for the Whole Foods Market and the 222 Hennepin Apartments. 

Action: The City Planning Commission adopted the findings and approved the Registered Land Survey application for the property located at 222 Hennepin Ave.

2. DC Group Expansion (Vac-1632, Ward: 5) (Becca Farrar).

A. Vacation: Application by West River Road Investments, LLC, to vacate part of Lot 20, Block 37, Bassett, Moore & Case’s Addition in order to allow for the construction of an office/warehouse addition on the property located at 1977 West River Road.  The block is bounded by West Broadway, 1st Street North and West River Road.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the Vacation File, 1632.

3. Elan Uptown East (BZZ-6571, Ward: 10), 2825 and 2837 Dupont Ave S (Hilary Dvorak).

A. Conditional Use Permit: Application by Carol Lansing with Faegre Baker Daniels, on behalf of Greystar Development, LLC, for a conditional use permit to amend the previously approved Planned Unit Development to allow for signage for the properties located at 2825 and 2837 Dupont Ave S.

Action: The City Planning Commission continued the application for a conditional use permit to amend the previously approved Planned Unit Development to allow for signage for the properties located at 2825 and 2837 Dupont Ave S to the July 14, 2014, City Planning Commission meeting.

4.   5336 Lyndale Ave S (BZZ-6579, Ward: 13), (Mei-Ling Anderson).

A. Variance: Application by Bill Graham for a variance to reduce the north interior side yard setback from 9 feet to 4 feet for the property located at 5336 Lyndale Ave S.

Action: The City Planning Commission adopted the findings and approved the application for a variance to reduce the north interior side yard setback from the required 9 feet to four feet at the property located at 5336 Lyndale Ave S.

B. Variance: Application by Bill Graham for a variance to reduce the south interior side yard setback from 9 feet to 3.5 feet for the property located at 5336 Lyndale Ave S.

Action: The City Planning Commission adopted the findings and approved the application for a variance to reduce the south interior side yard setback from the required 9 feet to 3.5 feet at the property located at 5336 Lyndale Ave S.

C. Site Plan Review: Application by Bill Graham for a site plan review for a new three-story, approximately 14,163 square foot building with four residential units located at 5336 Lyndale Ave S.

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a three-story, mixed-use building with four dwelling units at the property located at 5336 Lyndale Ave S, subject to the following conditions:

  1. Approval of the final site plan, landscaping plan, and elevations by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 23, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. All signs require a separate sign permit from CPED.
  4. The applicant shall work with CPED staff to provide additional ground-level windows and one awning over the building entrance on the north elevation of the building.
  5. The applicant shall be required to submit a landscape plan that demonstrates compliance with sections 530.180, 530.200, and 530.210 of the zoning code.
  6. The applicant shall be required to submit a lighting plan that demonstrates compliance with section 535.90 of the zoning code.
  7. The applicant shall provide no fewer than three short-term bicycle parking spots for the commercial uses and two long-term bike spots for the residential uses.
  8. Mechanical equipment shall be screened as required by section 535.70 of the zoning code.
  9. Refuse storage shall be screened as required by section 535.80 of the zoning code.
  10.  Vehicles may not be parked in the paved drive area between the garage and west property line.
  11. The proposed chain link fence shall be vinyl-coated and its location shall be articulated on the final site plan.
  12. The applicant shall work with the Department of Public Works to provide on-site retention and filtration of stormwater.

5. Karmel West (BZZ-6417, Ward: 10), 312 Lake St W (Brad Ellis). This item was continued from the June 9, 2014 meeting.

A. Site Plan Review: Application by Basim Sabri, on behalf of Karmel West, LLC, has applied for a site plan review to construct a 42 foot by 75 foot second story addition above a portion of the building located at 312 Lake St W in the I2 Medium Industrial District and C2 Neighborhood Corridor Commercial District. 

Action: The City Planning Commission continued the site plan review application for a 3,150 square foot addition an existing mixed-use building located at 312 Lake St W to the July 28, 2014 meeting.

6. Blaisdell Apartments (BZZ-6553, Ward: 10), 2118 Blaisdell Ave (Becca Farrar). This item was continued from the June 9, 2014 meeting.

A. Site Plan Review: Application by Cermak Rhoades Architects, on behalf of NuWay, Inc., for  a site plan review to allow for the conversion of an existing building most recently used as a commercial use into a 22-unit apartment building on the property located at 2118 Blaisdell Ave.  The property is located in the OR2 (High Density Office Residence) District.

Action: The City Planning Commission continued the site plan review application to allow for the conversion of an existing structure into 22 apartment units in the building located at 2118 Blaisdell Ave, to the July 14, 2014, meeting.

7. Corner Apartments (BZZ-6580, Ward: 3), 24 University Ave NE (Hilary Dvorak).

A. Conditional Use Permit: Application by Gretchen Camp with BKV Group, Inc., on behalf of Corner Apartments, LLC, for a conditional use permit to amend an existing Planned Unit Development to add a 57-unit multiple-family residential building located at 24 University Ave NE (Tract G) (corner of 1st Ave NE and 2nd St NE).

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to amend an existing Planned Unit Development to add a 57-unit multiple-family residential building at the property located at 24 University Ave NE (Tract G), subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. As required by section 527.120 of the zoning code, the development shall comply with the standards for some combination of the following amenities from Table 527-1, Amenities and those proposed by the applicant totaling a minimum of 10 points: pedestrian improvements, reflective roofing, recycling storage area and facade improvement to the adjacent parking garage.
  3. At least 75 percent or more of the total roof surface shall have a Solar Reflectance Index (SRI) equal to or greater than the values as required by the US Green Building Council (USGBC) for low-sloped and steep-sloped roofs.

B. Site Plan Review: Application by Gretchen Camp with BKV Group, Inc., on behalf of Corner Apartments, LLC, for a site plan review for the property located at 24 University Ave NE (Tract G) (corner of 1st Ave NE and 2nd St NE).

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a 57-unit multiple-family residential building at the property located at 24 University Ave NE (Tract G), subject to the following conditions:

  1. Approval of the final site plan, elevations, floor plan, landscaping plan and lighting plan by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 23, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. There shall be at least five shrubs provided on the site as required by Section 530.120 of the zoning code.
  4. The mechanical equipment shall be screened as required by section 535.70 of the zoning code.

8.  2622 W Lake St (BZZ-6576, Ward: 7), (Hilary Dvorak).

A. Conditional Use Permit: Application by David Graham, with ESG, on behalf of Greystar, for a conditional use permit to increase the height of the building located at 2622 W Lake St in the SH Shoreland Overlay District from the permitted 2.5 stories/35 feet to 8 stories.

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to increase the height of the building located in the SH Shoreland Overlay District from the permitted 2.5 stories/35 feet to 8 stories/100 feet at the property located at 2622 W Lake St, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

Action: The City Planning Commission adopted the findings and approved the application for a variance to reduce the required 15-foot front yard setback along W Lake St to allow for staircases, ground level patios, trellises and other similar features at the property located at 2622 W Lake St.

C. Variance: Application by David Graham, with ESG, on behalf of Greystar, for a variance to reduce the required 15-foot corner side yard setback along Thomas Ave S to allow for staircases, ground level patios, trellises and other similar features for the property located at 2622 W Lake St.

Action: The City Planning Commission adopted the findings and approved the application for a variance to reduce the required 15-foot corner side yard setback along Thomas Ave S to allow for staircases, ground level patios, trellises and other similar features and an electrical transformer at the property located at 2622 W Lake St.

F. Site Plan Review: Application by David Graham, with ESG, on behalf of Greystar, for a site plan review for a new 8-story, 90-unit residential building located at 2622 W Lake St.

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a new 8-story, 90-unit residential building at the property located at 2622 W Lake St, subject to the following conditions:

  1. Approval of the final site plan, landscaping plan and elevations by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by June 23, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The applicant shall work with the City’s Public Arts Administrator to ensure that there is room in the right-of-way to accommodate and protect the artistic vintage bus transit bench.

A. Conditional Use Permit: Application by Aaron Roseth of ESG Architects, Inc., on behalf of Pork’s West Lake Drive-In, for a conditional use permit to increase the maximum height of a principal structure from 2.5 stories, 35 feet, to 6 stories, approximately 75 feet located at 3118 Lake St W in the C3A Community Activity Center District and SH Shoreland Overlay District.

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to increase the maximum height of a principal structure from 2.5 stories, 35 feet, to 6 stories, approximately 75 feet, to allow for a new six-story, mixed-use building located at 3118 Lake St W in the C3A Community Activity Center District and SH Shoreland Overlay District , subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

Action: The City Planning Commission adopted the findings and approved the application for a variance to reduce the west interior side yard setback from 15 feet to approximately 14 feet, measured to the structure and to approximately 8 feet, measured to the balconies to allow for a new six-story, mixed-use building located at 3118 Lake St W in the C3A Community Activity Center District and SH Shoreland Overlay District.

C. Variance: Application by Aaron Roseth of ESG Architects, Inc., on behalf of Pork’s West Lake Drive-In, for a variance to eliminate one small loading space required for the proposed residential use located at 3118 Lake St W.

Action: The City Planning Commission adopted the findings and approved the application for a variance to reduce the off-street loading requirement from one small loading space to zero for the proposed residential use to allow for a new six-story, mixed-use building located at 3118 Lake St W in the C3A Community Activity Center District and SH Shoreland Overlay District.

D. Site Plan Review: Application by Aaron Roseth of ESG Architects, Inc., on behalf of Pork’s West Lake Drive-In, for a site plan review for the property located at 3118 Lake St W.

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow for a new six-story, mixed-use building located at 3118 Lake St W in the C3A Community Activity Center District and SH Shoreland Overlay District, subject to the following conditions:

  1. Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.
  2.  All site improvements shall be completed by June 23, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The applicant shall provide architectural detail or recesses in the proposed building wall or additional landscaping materials, such as a living wall system, to avoid blank, uninterrupted walls, not exceeding twenty-five (25) feet in length.
  4. The applicant shall provide 3-foot hedge, not less than 60% opaque along the east property line to screen the parking area from the adjacent residential use.
  5. The applicant shall continue to work with staff to ensure the ramp is ADA accessible, safe and inviting.
