Approval of Actions from the April 23, 2014 meeting
The Planning Commission approved the actions from the April 23, 2014 meeting.

Public Hearings
1. The Maryland Apartments (BZZ-6499, Ward: 7), 1346 LaSalle Ave (Hilary Dvorak).
A. Site Plan Review: Application by Mina Adsit, with Adsit Architecture & Planning, on behalf of Maryland Preservation LLC, for a site plan review to add an additional 15 dwelling units within the footprint of the existing building at 1346 LaSalle Ave.
Action: The City Planning Commission adopted the findings and approved the site plan review application to add an additional 15 dwelling units within the footprint of the existing building located at 1346 LaSalle Ave, subject to the following conditions:
  1. Approval of the final site plan, landscaping plan and elevations by the Department of Community Planning and Economic Development
  2. All site improvements shall be completed by May 5, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. Shrubs or perennials shall be planted in the former outdoor patio area in lieu of wood mulch.
Approved on consent 8-0.
2. Huss Center Expansion (BZZ-6498, Ward: 6), 2120 Park Ave and 2111 Oakland Ave (Hilary Dvorak).
A. Conditional Use Permit: Application by Hayley Carlson, with People Incorporated, for a conditional use permit to increase the number of beds at an existing community residential facility located at 2120 Park Ave and 2111 Oakland Ave. The conditional use permit is to allow up to 32 residents.
Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to increase the number of beds at an existing community residential facility to 32 located at 2120 Park Ave and 2111 Oakland Ave, subject to the following conditions:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. There shall be no more than 32 residents in the building.
  3. On-site services shall be for residents of the facility only, except where part of a regimen of scheduled post-residential treatment.
  4. The applicant shall provide evidence that there is enough room inside the building to provide bicycle parking for 8 bicycles in the “future workshop/storage" room.

3. Red Cricket Acupuncture (BZZ-6505, Ward: 11), 4816 Nicollet Ave S (Becca Farrar).
A. Nonconforming Use Change: Application by Adsit Architecture and Planning, on behalf of Red Cricket Acupuncture, for a change of a non-conforming use to allow an acupuncture clinic in place of the former office within the existing building located on the property at 4816 Nicollet Ave S. The property is zoned R1 (Single-family) District.
Action: The City Planning Commission adopted the findings and approved the change of a nonconforming use application for the property located at 4816 Nicollet Ave S subject to the following conditions of approval:
  1. All site improvements shall be completed by May 5, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  2. All necessary building permits shall be attained as applicable.
  3. A separate sign permit shall be attained from the Zoning Office to allow the face change-out for the existing nonconforming sign.
  4. Any new on-site lighting shall be downcast, shielded and comply with Chapter 535.
  5. The trash receptacles located on the property shall be screened as required by Section 535.80 of the Zoning Code.
  6. The existing air-conditioning unit located adjacent to Nicollet Ave shall be screened with additional landscaping.

4. Verizon Wireless – MINC True Light (BZZ-6506, Ward: 12), 4200 West River Parkway (Becca Farrar).
A. Conditional Use Permit: Application by Verizon Wireless, on behalf of Minnehaha Academy, for a conditional use permit to allow a new 60 foot tall, freestanding monopole communication tower on the property which is located in the R1 (Single-family) District, SH (Shoreland Overlay) District and MR (Mississippi River) Critical Overlay District for the property located at 4200 West River Parkway.
Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow a new 60 foot tall, freestanding monopole communication tower on the property located at 4200 West River Parkway, subject to the following conditions:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. The monopole shall be painted a dark brown color to better blend into its surroundings.
  3. All antennae shall be internally located.

B. Variance: Application by Verizon Wireless, on behalf of Minnehaha Academy, for a variance to allow a transformer/mechanical unit (associated with the monopole communication tower and equipment building) within the required front yard adjacent to 46th Ave S for the property located at 4200 West River Parkway.
Action: The City Planning Commission adopted the findings and approved the application for a variance to allow a transformer and equipment building (associated with the monopole communication tower) within the required front yard adjacent to 46th Avenue South on the property located at 4200 West River Parkway, subject to the following condition:
  1. The transformer shall be painted green.

5. Broadway Resource Recovery Proposed Building Replacement (BZZ-6482, Ward: 5), 111 22nd Ave N (Aaron Hanauer).
A. Conditional Use Permit: Application by Foth Infrastructure & Environment, LLC, on behalf of Broadway Resource Recovery, LLC, for a conditional use permit to allow for the construction of an 11,800 sq. ft. building (replacing a 7,989 sq. ft. building) at 111 22nd Ave N in the I2/Medium Industrial District and the Mississippi River Critical Area Overlay District.
Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow for an expansion of a recycling facility at 111 22nd Ave N, subject to the following condition:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Site Plan Review: Application by Foth Infrastructure & Environment, LLC, on behalf of Broadway Resource Recovery, LLC, for a site plan review for property located at 111 22nd Ave N in the I2/Medium Industrial District and the Mississippi River Critical Area Overlay District.
Action: The City Planning Commission adopted the findings and approved the site plan review application to allow for an expansion of a recycling facility at 111 22nd Ave N, subject to the following conditions:
  1. The landscaping plan shall be improved to eliminate all weeds and replace them with turf grass, native grasses or other perennial flowering plants, vines, mulch, shrubs or trees as required by Section 530.180 of the zoning code.
  2. The first 100 feet of the eastern property line measured from 22nd Ave. N. shall have additional shrubs that are a minimum of three feet in height and not less than 60 percent opaque or a minimum of 10 Ivory Silk Lilac trees or similar tree. The applicant is also encouraged to work with staff to implement a revised landscaping plan for the south side of the site facing West Broadway that goes above the standards of the zoning code to provide an amenity along West Broadway.
  3. Parking spaces shall be painted as shown on site plan.
  4. If the bare, chain-link fence is removed along the perimeter of the property it shall be replaced with black vinyl coated chain-link fencing or decorative wrought-iron type fencing.
  5. Department of Community Planning and Economic Development staff review and approval of the final building elevations, floor, site, lighting and landscape plans.
  6. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by May 5, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

6. 16Twenty (BZZ-6500, Ward: 10), 1618-20 West Lake St and 2915 James Ave S (Hilary Dvorak).
A. Conditional Use Permit: Application by Brent Nelson, with Peterssen/Keller architecture, on behalf of Daniel Oberpriller with CPM Development LLC, for a conditional use permit to increase the height of the building located in the SH Shoreland Overly District from the permitted 2.5 stories/35 feet to 3 stories/46 feet and in the C1 zoning district from 3 stories/42 feet to 3 stories/46 feet for the properties located at 1618-20 West Lake St and 2915 James Ave S.
Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to increase the height of the building located in the SH Shoreland Overly District from the permitted 2.5 stories/35 feet to 3 stories/46 feet and in the C1 zoning district from 3 stories/42 feet to 3 stories/46 feet at the properties located at 1618-20 W Lake St and 2915 James Ave S, subject to the following condition:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

Action: The City Planning Commission adopted the findings and approved the application for a variance to reduce the off-street loading requirement from 1 small space to 0 spaces at the properties located at 1618-20 W Lake St and 2915 James Ave S.

E. Site Plan Review: Application by Brent Nelson, with Peterssen/Keller architecture, on behalf of Daniel Oberpriller with CPM Development LLC, for a site plan review for a new 28,284 square foot, mixed-use building for the properties located at 1618-20 West Lake St and 2915 James Ave S.
Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a new 28,284 square foot, mixed-use building at the properties located at 1618-20 W Lake St and 2915 James Ave S, subject to the following conditions:
  1. Approval of the final site plan, landscaping plan and elevations by the Department of Community Planning and Economic Development
  2. All site improvements shall be completed by May 5, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The building shall be designed so as to not have any walls over 25 feet in length and void of windows, entries, recesses or projections, or other architectural elements as required by section 530.120 of the zoning code.
  4. No concrete block shall be used as an exterior material on the building.
  5. There shall be at least 2 shrubs planted on the site as required by section 530.160 of the zoning code.
  6. The 2 planting areas on the site shall be densely planted with a variety of plant materials to provide seasonal interest.
  7. There shall be 2 bicycle parking spaces provided within the parking garage for the office uses within the building as required by section 541.180 of the zoning code.
  8. The screen wall around the mechanical equipment shall be located on the north side of the equipment so as to screen it from the adjacent residential building to the north as required by section 535.70 of the zoning code.
