Call to Order

Approval of Actions from the April 7, 2014 meeting

The Planning Commission approved the actions from the April 7, 2014 meeting.

Approval of Agenda

Committee of the Whole Consent Agenda – April 10, 2014

1.   Public Land Sale – 3217 29th Ave S (Staff: Paul Mogush)

Review for consistency with the comprehensive plan the sale of 3217 29th Ave S for development of a single-family home.

Action: The City Planning Commission approved the staff recommendation and found the item consistent with the Minneapolis Plan.

Public Hearings

1.  LaRive Condominium (Vac-1630, Ward: 3), 110 Bank St (Janelle Widmeier).

A. Vacation: Application by Faegre Baker Daniels LLP, on behalf of La Rive Condominium Association, has filed an application to vacate part of a utility easement at the property of 110 Bank St to allow ground level mechanical equipment additions.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the vacation of part of the utility easement located at 110 Bank St.

Approved on consent 5-0.

2.  Krause Liquor Store (BZZ-6425, Ward: 3), 80 Broadway St NE (Janelle Widmeier). This item was continued from the March 3 and March 24, 2014 meetings.

A. Conditional Use Permit: Application by DJR Architecture, on behalf of Steve Krause, for a conditional use permit to allow a liquor store located at 80 Broadway St NE.

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow a liquor store for the property located at 80 Broadway St NE, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Site Plan Review: Application by DJR Architecture, on behalf of Steve Krause, for a site plan review to allow a new 1-story, approximately 7,700 square foot building located at 80 Broadway St NE.

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a new 1-story, approximately 7,500 square foot building for the property located at 80 Broadway St NE, subject to the following conditions:

  1. Not less than 30 percent of the Broadway St NE building elevation shall be windows that comply with the standards of section 530.120(b) of the zoning code.
  2. Not less than 25 percent of the parking lot building elevation shall be windows that comply with the standards of section 530.120(b) of the zoning code.
  3. At least 4 boulevard trees shall be planted in the Broadway St right-of-way, at least 2 boulevard trees shall be planted in the Marshall St right-of-way, and at least 3 boulevard trees shall be planted in the 11th Ave right-of-way.
  4. Not less than 6 canopy trees shall be provided in the required landscaped yards between the parking area and Marshall St and 11th Ave as required by section 530.170 of the zoning code.
  5. Department of Community Planning and Economic Development staff review and approval of the final building elevations, floor, fixture, site, lighting and landscape plans.
  6. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by April 23, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  7. The applicant shall work with staff to enhance the Broadway entrance of the building through building architecture and landscaping.
  8. The applicant shall provide and maintain a minimum of 15 bicycle parking stalls on site or adjacent to the site in the public right of way.

3.  555 Addition (BZZ-6494, Ward: 12), 3965 Minnehaha Ave (Hilary Dvorak).

A. Site Plan Review: Application by Jonathan Wood with Pollock Construction, on behalf of Thomas Rief and 555 Studios, for a site plan review for an approximate 1,800 square foot addition to an existing commercial building which will add one dwelling unit to the property located at 3965 Minnehaha Ave.

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow an approximate 1,800 square foot addition to an existing commercial building which will add one dwelling unit to the property located at 3965 Minnehaha Ave, subject to the following conditions:

  1. Approval of the final site plan, landscaping plan and elevations by the Department of Community Planning and Economic Development
  2. All site improvements shall be completed by April 23, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. Clearstory windows shall be installed on the first floor of the building facing the east property line to break up the long blank wall as required by section 530.120 of the zoning code.
  4. There shall be at least 1 tree and 5 shrubs provided on the site as required by section 530.160 of the zoning code.
  5. At least three bicycle parking spaces shall be provided on site.
  6. The refuse and recycling containers shall be enclosed as required by section 535.80 of the zoning code.
  7. The mechanical equipment shall be screened as required by section 535.70 of the zoning code.

4.  Metro Taxi and Limo (BZZ-6469, Ward: 12), 3520 43rd St E (Shanna Sether).

A. Conditional Use Permit: Application by Javad Feghahati of Metro Taxi & Limo, Inc, for a conditional use permit to allow for a new taxi service (fleet maintenance and office only) located at 3520 43rd St E in the I1 Light Industrial District and IL Industrial Living Overlay District.

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow a new taxi service (fleet maintenance and office only) for the property located at 3520 43rd St E in the I1 Light Industrial District and IL Industrial Living Overlay District, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Action: The City Planning Commission adopted the findings and approved the application for a variance of the specific development standards to allow for a new taxicab service to be located less than three hundred (300) feet from a residence or office residence district for the property located at 3520 43rd St E in the I1 Light Industrial District and IL Industrial Living Overlay District, subject to the following condition:

  1. The applicant shall provide landscaping and screening of the parking lot along the north and south property line.

C. Site Plan Review: Application by Javad Feghahati of Metro Taxi & Limo, Inc, for a site plan review for the property located at 3520 43rd St E in the I1 Light Industrial District and IL Industrial Living Overlay District.

Action: The City Planning Commission adopted the findings and approved the site plan review application for a new taxicab service t for the property located at 3520 43rd St E in the I1 Light Industrial District and IL Industrial Living Overlay District, subject to the following conditions:

  1. Approval of the final site, landscape and floor plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by February 3, 2016, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The applicant shall remove the window coverings on the front elevation of the building facing Dight Ave.
  4. At least 380 square feet of landscaped area shall be provided on-site and at least 1 deciduous canopy trees and 5 shrubs shall be provided as required by section 530.160 of the zoning code. The applicant is encouraged to plant native grasses and perennials in addition to the required trees and shrubs.
  5. The applicant shall provide a landscaped yard of at least 6 feet along the north property line, 4 feet along the south property and reestablish the landscaped boulevard along the public sidewalk, south of the parking area.
  6. The applicant shall provide screening, not less than 6 feet high and 95% opaque, along the north property line when the existing fence along the north property line is in need of repair or replacement.
  7. The applicant shall replace the existing fence with a 3-foot high screen, not less than 60% opaque along the south property line to screen the parking area along 43rd St E, when the existing fence is in need of repair or replacement.
  8. The existing, abandoned roof sign, including all supporting brackets, frames or other structural elements of the abandoned sign shall be removed per section 543.170 of the zoning code.
  9. All proposed signage will require review for compliance with Chapter 543 On-Premise Signs and shall receive a sign permit.

5.  Village Market (BZZ-6475 and Vac-1614, Ward: 6), 912 E 24th St, 2301 Elliot Ave S, 2218-20 10th Ave S, 1000 E 24th St and 2321 10th Ave S (Hilary Dvorak).

A. Rezoning: Application by Scott Nelson, DJR Architecture, Inc., on behalf of Omar Sabri and Eagle Management, for a rezoning to add the TP Transitional Parking Overlay District to 2218 10th Ave S.

Action: The City Planning Commission continued the rezoning petition to add the TP Transitional Parking Overlay District to 2218 10th Ave S to the May 19, 2014, City Planning Commission meeting.

Approved on consent 5-0.

B. Conditional Use Permit: Application by Scott Nelson, DJR Architecture, Inc., on behalf of Omar Sabri and Eagle Management, for a conditional use permit for a parking lot in the TP Transitional Parking Overlay District for properties located at 912 E 24th St, 2301 Elliot Ave S, 2218-20 10th Ave S, 1000 E 24th St and 2321 10th Ave S.

Action: The City Planning Commission continued the application for a conditional use permit to allow a parking lot in the TP Transitional Parking Overlay District to the May 19, 2014, City Planning Commission meeting.

Approved on consent 5-0.

C. Nonconforming Use Expansion: Application by Scott Nelson, DJR Architecture, Inc., on behalf of Omar Sabri and Eagle Management, for an expansion of a non-conforming use to add approximately 12,000 square feet of floor area to an existing shopping center in the I1 Light Industrial zoning district for properties located at 912 E 24th St, 2301 Elliot Ave S, 2218-20 10th Ave S, 1000 E 24th St and 2321 10th Ave S.

Action: The City Planning Commission continued the expansion of a nonconforming use application to add approximately 12,000 square feet of floor area to an existing shopping center in the I1 Light Industrial zoning district to the May 19, 2014, City Planning Commission meeting.

D. Site Plan Review: Application by Scott Nelson, DJR Architecture, Inc., on behalf of Omar Sabri and Eagle Management, for a site plan review for properties located at 912 E 24th St, 2301 Elliot Ave S, 2218-20 10th Ave S, 1000 E 24th St and 2321 10th Ave S.

Action: The City Planning Commission continued the site plan review application for a 12,000 square addition to an existing shopping center to the May 19, 2014, City Planning Commission meeting.

Approved on consent 5-0.

E. Vacation: Application by Scott Nelson, DJR Architecture, Inc., on behalf of Omar Sabri and Eagle Management, for an Alley Vacation 1614 – vacating and replacing the alley in Block 2, Chicago Ave 2nd Addition, bounded by Elliot Ave, 10th Ave S, E 24th St and E 22nd S.

Action: The City Planning Commission continued the vacation application vacating the public alley in Block 2, Chicago Ave 2nd Addition, bounded by Elliot Ave, 10th Ave S, E 24th St and E 22nd St to the May 19, 2014, City Planning Commission meeting.

Approved on consent 5-0.

6.  Encaustic/Chowgirls (BZZ-6492, Ward: 3), 1401 Marshall St NE (Aaron Hanauer).

A. Rezoning: Application by Tyrone Folliard, on behalf of Encaustic LLC, for a petition to rezone the property located at 1401 Marshall St NE from the R3/Multiple Family District to the C1/Neighborhood Commercial District.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the rezoning of the properties located at 1401 Marshall St NE from the R3/Multiple Family District to the C1/Neighborhood Commercial District.

Approved on consent 5-0.

B. Nonconforming Use Expansion: Application by Tyrone Folliard, on behalf of Encaustic LLC, for an expansion of a nonconforming use for the property located at 1401 Marshall St NE.

Action: The City Planning Commission adopted the findings and approved the expansion of a nonconforming use located at 1401 Marshall St NE, subject to the following conditions:

  1. All deliveries taking place in the loading area along 14th Ave NE shall take place in the building. Delivery vehicles shall not be allowed to be parked on the 14th Ave NE sidewalk at any time. The loading door along 14th Ave NE if changed shall retain the same level of clear glazing as currently exists.
  2. If the applicant does not rebuild the portion of the building that was torn down in October 2013, the applicant shall landscape and screen the parking area along 14th Ave NE to be in compliance with Section 530.170.
  3. An accessory reception/meeting hall shall meet the liquor licensing requirements outlined in Chapter 537 Accessory Uses and Structures.
