1.   Land Purchase – 425 and 416 Portland Ave S, 521 4th St S, 520 5th St S, and a portion or all of 501 4th St S. (Staff: Beth Elliott)
Review for consistency with the Comprehensive Plan the purchase of 425 and 416 Portland Ave S, 521 4th St S, 520 5th St S, and a portion or all of 501 4th St S. for a park and potentially a portion for development.
Action: The City Planning Commission approved the staff recommendation.
2. Greenway Heights Tax Increment Financing (TIF) Plan and the related Modification No. 2 to the Lake and Bloomington Redevelopment Plan and Modification No. 1 to the East Phillips Commons, Phase 1 TIF Plan (Staff: Paul Mogush)
Review for consistency with the comprehensive plan.
Action: The City Planning Commission approved the staff recommendation.

A. Conditional Use Permit: Application by North Star Taxi Corporation for a conditional use permit to allow a taxicab service located at 3315 2nd St N.
Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow a taxicab service for the property located at 3315 2nd St N, subject to the following condition:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Site Plan Review: Application by North Star Taxi Corporation for a site plan review for property located at 3315 2nd St N.
Action: The City Planning Commission adopted the findings and approved the application for site plan review to allow a taxicab service for the property located at 3315 2nd St N, subject to the following conditions:
  1. Landscaping shall be provided on-site as required by section 530.160 of the zoning code, including at least 9 canopy trees and 44 shrubs.
  2. Landscaped yards not less than 7 feet wide with screening and trees shall be provided as required by section 530.170 of the zoning code adjacent to the east lot line along 2nd Street North.
  3. At least 3 trees shall be provided between the parking area and Washington Avenue North as required by section 530.170 of the zoning code.
  4. Any areas of the parking lot left unavailable for parking or vehicle circulation shall be landscaped as required by section 530.170 of the zoning code.
  5. All parking spaces shall be located within 50 feet from the center of an on-site canopy tree as required by section 530.170 of the zoning code.
  6. Except where curb cuts are located, asphalt in the 2nd Street North right-of-way between the street curb and front lot line shall be removed and replaced with sod or other plantings as allowed by the Public Works Department.
  7. Installation and maintenance of all landscape materials shall comply with the standards outlined in sections 530.200 and 530.210 of the zoning code.
  8. Six-inch by six-inch discontinuous concrete curbing shall be installed along the 2nd Street North parking lot frontage to allow retention of stormwater while preventing maneuvering in the right-of-way as required by sections 530.230 and 541.290 of the zoning code.
  9. The parking lot layouts shall comply with the minimum parking space and aisle dimensions and shall be clearly marked as required by sections 541.320 and 541.330 of the zoning code.
  10. Refuse containers shall be screened as required by section 535.80 of the zoning code.
  11. Department of Community Planning and Economic Development staff review and approval of the final site, landscaping, and floor plans.
  12. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by November 12, 2015, or the permit may be revoked for non-compliance.

A. Rezoning: Application by The Banyan Foundation for a petition to rezone the property located at 2529 13th Ave S and 1308 E 26th St from the R2B/Two-Family District to the OR2/High Density Office Residence District.
Action: The City Planning Commission recommended that the City Council adopt the findings and approve the rezoning of the properties located at 2529 13th Ave S and 1308 E 26th St from the R2B/Two-Family District to the OR2/High Density Office Residence District.

Action: The City Planning Commission adopted the findings and approved the variance to reduce the number of off-street parking spaces from 27 to 9 for the property at 2529 13th Ave S and 1308 26th St E to allow for a new community center subject to the following condition:
  1. A minimum of 41 bike parking spaces shall be provided: 11 short-term bike parking spaces and 30 long-term bike parking spaces.

Action: The City Planning Commission adopted the findings and approved the site plan review application for a new community center at 2529 13th Ave S and 1308 E 26th St E subject to the following conditions:
  1. CPED Staff review and approval of the final site, elevation, lighting and landscaping plans. 
  2. Per Section 541.380, required parking spaces, driveways, access aisles and landscaping shall not be used for the purpose of snow storage.
  3. All site improvements shall be completed by November 12, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  4. The first floor windows will be clear or lightly tinted glass with a visible light transmittance ratio of 0.6 or higher as required by section 530.120 of the zoning code.

Action: The City Planning Commission adopted the findings and approved the conditional use permit application to allow a building addition for a minor automobile repair use for property located at 2801 Central Ave NE, subject to the following conditions:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. The use shall comply with the Specific Development Standards as outlined in section 536.20 of the Zoning Code.

B. Site Plan Review: Application by Olmedo Alvarado for a site plan review for property located at 2801 Central Ave NE.
Action: The City Planning Commission adopted the findings and approved the site plan review application for the property located at 2801 Central Ave NE, subject to the following conditions:
  1. CPED staff review and approval of the site plan, lighting plan, landscaping plan, and elevations before permits may be issued.
  2. All site improvements shall be completed by November 12, 2014, unless extended by the Zoning Administrator, or permits may be revoked for noncompliance.
  3. The proposed addition shall be completed by November 12, 2015, unless extended by the Zoning Administrator, or permits may be revoked for noncompliance.

A. Rezoning: Application by Shree Investments LLC to rezone the property located at 1936 Fremont Ave S from the R2B Two-family District to the R3 Multiple-family District to legalize a third dwelling unit.
Action: The City Planning Commission continued the rezoning petition to change the zoning classification of the property located at 1936 Fremont Ave S from the R2B Two-family District to the R3 Multiple-family District to the December 2, 2013 meeting.

5. 2535 Aldrich Ave S (BZZ-6081, Ward: 10), 2535 Aldrich Ave S (Kimberly Holien).
A. Rezoning: Application by Paul Halvorson for a rezoning from R2B, Two-family district to the R3, Multiple-family district to legalize a third dwelling unit in the residential structure at 2535 Aldrich Ave S.
Action: Notwithstanding staff recommendation, the City Planning Commission recommends that the City Council approve the application for rezoning from the R2B (Two-family) District to the R3 (Multiple-family) District for the property at 2535 Aldrich Ave S. 
  1. There is R3 zoning on this block.
  2. There is commercial zoning on the other side of the block, which makes this the mix of zoning and zoning densities that the urban neighborhood designation describes.
  3. Policy 1.8 in the comprehensive plan supports this:  Preserve the stability and diversity of the city's neighborhoods while allowing for increased density in order to attract and retain long-term residents and businesses.
  4. The rezoning promotes affordable housing and recognizes population projections that suggest the City will accommodate over 100,000 additional residents by 2040.
  5. The rezoning would create more diversity in available housing types in this area.

B. Variance: Application by Paul Halvorson for a variance to reduce the minimum lot area requirement in the R3 district from 5,000 square feet to 4,756 square feet for the property located at 2535 Aldrich Ave S.
Action: Notwithstanding staff recommendation, the City Planning Commission approved the application for the variance to reduce the minimum lot area requirement from 5,000 square feet to 4,756 square feet for the property at 2535 Aldrich Ave S, based on the following findings:
  1. With the approval of the rezoning, the variance is reasonable and in keeping with the spirit and intent of the ordinance and the comprehensive plan.

A. Conditional Use Permit: Application by Karen Gjerstad on behalf of Roman Gadaskin, for a conditional use permit to allow an amendment to a planned unit development to allow for a six-unit apartment building in the existing structure at 1206 5th St SE and a three-unit apartment building in the existing structure at 1212 5th St SE.
Action: The City Planning Commission adopted the findings and approved the conditional use permit application to allow an amendment to a planned unit development at 1209 4th St SE, 1206 & 1212 5th St SE subject to the following conditions:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. As required by section 527.120 of the zoning code, the development includes the following amenities from Table 527-1, Amenities: conservation of the built environment (Frey Mansion and Hoy House), decorative fencing completed along 5th Street Southeast, enhanced landscaping, enhanced exterior lighting, and a recycling storage area.

Action: The City Planning Commission adopted the findings and approved the variance application to reduce the number of off-street parking spaces from 12 spaces to 7 spaces for Phase II of the planned unit development for the properties located at 1206 and 1212 5th St SE.

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow for the rehabilitation of the Frey Mansion and the Hoy House at 1206 and 1212 5th St SE subject to the following conditions:
  1. CPED Staff review and approval of the final site, elevation, lighting and landscaping plans. Per Section 541.380, required parking spaces, driveways, access aisles and landscaping shall not be used for the purpose of snow storage.
  2. All site improvements shall be completed by November 12, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. All parking spaces and aisles shall be clearly marked on the pavement, using paint or other marking devices approved by the city engineer. The markings shall conform to the approved parking plan and be maintained in a clearly legible condition.
  4. All units shall meet the requirements of maximum occupancy standards of the district, as required by section 547.50 of the zoning code.
  5. The applicant shall work with staff to incorporate enhanced landscaping between parking spaces and 5th St SE to create a visual buffer.

A. Conditional Use Permit: Application by Rick Collins, VP of Development with Ryan Companies US, Inc., for a conditional use permit for a planned unit development that includes approximately 1.5 million square feet of office space, approximately 20,000 square feet of commercial space, 203 dwelling units and a principal parking facility for the properties located at 627, 701, 713 and 719 3rd St S, 500, 501, 521, 628, 700, 716 and 728 4th St S, 301, 329, 416 and 425 Portland Ave, 520 5th St S and 350 Park Ave.
Action: The City Planning Commission adopted the findings and approved the conditional use permit application for a planned unit development that includes approximately 1.5 million square feet of office space, approximately 20,000 square feet of commercial space, 203 dwelling units and a principal parking facility located at 627, 701, 713 and 719 3rd St S, 500, 501, 521, 628, 700, 716 and 728 4th St S, 301, 329, 416 and 425 Portland Ave, 520 5th St S and 350 Park Ave subject to the following conditions:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. The commercial, residential, office or hotel uses shall be included along Chicago Ave as part of the initial construction of the above ground parking garage.
  3. The skyway over 5th Ave S shall be designed so as to not require a support column in the public sidewalk. If this is not feasible for structural reasons, the support column shall be designed so the sidewalk has a minimum unobstructed width of eight feet.
  4. As required by section 527.120 of the zoning code, the development shall comply with the standards for some combination of the following amenities from Table 527-1, Amenities totaling a minimum of 20 points: Leadership in Energy and Environmental Design (LEED), plaza, energy efficiency, living wall system, shared vehicle, enhanced landscaping, enhanced storm water management and a recycling storage area.
  5. The applicant shall submit the LEED checklist and documentation, approved by a LEED Accredited Professional (LEED-AP), that shows that the project will comply with LEED Platinum certification requirements prior to building permits being issued.
  6. The applicant shall submit documentation, including a letter signed by the owner or a licensed design professional, which shows that the building systems are designed to operate efficiently and exceed the Minnesota State Energy Code by at least 40 percent of the annual energy costs.
  7. The living wall system shall be composed of panels that total a minimum of 60 percent of the wall area (13,860 square feet) of the north elevation of the above ground parking garage.
  8. A portion of the plantings used in conjunction with the living wall system on the above ground parking garage shall provide greenery year round, if possible, subject to staff review and approval.
  9. The areas where the future phases of the PUD will be located, including the north side of the mixed-use buildings and the south side of the above ground parking garage, shall be seeded and/or sodded.
  10. The land that will be developed as a public park shall be seeded and/or sodded in high quality organic soil of a depth of no less than six inches.
  11. There shall be no signs located on the non-primary building walls of the mixed-use buildings facing S 3rd St.
  12. The amenity, as applied near the corner of 4th St and 5th Ave, shall be a use regularly open to the public.

Action: The City Planning Commission adopted the findings and approved the site plan review application for a planned unit development located at 627, 701, 713 and 719 3rd St S, 500, 501, 521, 628, 700, 716 and 728 4th St S, 301, 329, 416 and 425 Portland Ave, 520 5th St S and 350 Park Ave subject to the following conditions:
  1. Approval of the final site, landscaping, elevation and lighting plans by the Department of Community Planning and Economic Development.
  2. All lighting shall comply with the regulations of Chapter 535, Regulations of General Applicability and Chapter 541, Off-Street Parking and Loading.
  3. All site improvements shall be completed by November 12, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  4. There is mechanical equipment shown between the mixed-use buildings and 5th Ave S, Portland Ave and Park Ave. There may also be mechanical equipment located between the stand-alone residential building and 5th Ave S. If the mechanical equipment is not located below ground, the mechanical equipment shall be screened with decorative fencing or landscaping.
  5. There shall be stairs and entry stoops leading to at least three of the ground floor residential units within the stand-alone residential building facing 5th Ave S.
  6. The building footprints shall be located where shown on the submitted plans.
  7. There shall be no blank walls over 25 feet in length on the stand-alone residential building.
  8.  The sidewalk on 5th St, adjacent to the “stand-alone residential building,” shall be a minimum of 20 feet in width.

The purpose of the amendment is to comprehensively review and amend the Zoning Code for the purpose of improving customer service, implementing numerous technical changes and ensuring more effective alignment with policy objectives.
Action: The City Planning Commission recommended that the City Council adopt the findings and approve the zoning code text amendment to Chapters 520, 521, 525, 527, 530, 535, 537, 541, 543, 546, 547, 548, 549, 550 and 551. The City Planning Commission further recommends that Chapters 529, 531, 536 and 544 be returned to author.

A. Text Amendment: Amending Title 22, Chapter 598 of the Minneapolis Code of Ordinances relating to Land Subdivision: Land Subdivision Regulations.
The purpose of the amendment is to streamline and simplify subdivision and platting regulations.
Action: The City Planning Commission recommends that the City Council adopt the findings and approve the text amendment to Chapter 598, Land Subdivision.  
Aye: Brown, Cohen, Huynh, Kronzer, Schiff, Slack and Wielinski
Absent: Gagnon (excused) and Luepke-Pier (excused)
