1. 300 2nd St S and 333 1st St S (Vac-1623, Ward: 7), 300 2nd St S and 333 1st St S (Janelle Widmeier). This item was continued from the August 26, 2013 and September 16, 2013 meetings.
Staff report
A. Vacation: Application by The City of Minneapolis Department of Community Planning and Economic Development to vacate the remaining no outlet alley adjacent to the property of 300 2nd St S and 333 1st St S.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission continue the alley vacation to the to the Planning Commission meeting of December 2, 2013.
2. Fiant Dental (BZZ-6258, Ward: 10), 3225 Lyndale Ave S (Becca Farrar). This item was continued from the October 15, 2013 meeting.
Staff report
A. Nonconforming Use Change: Master Properties Minnesota, LLC, on behalf of Allegro Properties and Fiant Dental, has applied for a change of a non-conforming use to allow a dental clinic in place of the former offices within the existing building located on the property at 3225 Lyndale Ave S. The property is zoned R4 (Multiple-family) District.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the above findings and approve the application for a change of nonconforming use to allow for a dental clinic in place of the former offices within the existing building located on the property at 3225 Lyndale Ave subject to the following conditions:
  1. All site improvements shall be completed by October 15, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  2. All necessary building permits shall be attained.
  3. The proposed signage shall be modified to meet the requirements outlined in Section 543.250 of the Zoning Code. A separate permit shall be attained from the Zoning Office.
  4. All lighting shall be downcast, shielded and comply with Chapter 535. Staff shall review the details of the fixtures in the final review prior to permit issuance. 
  5. The site plan shall be modified as applicable to comply with Sections 531.110 and 541.360 of the Zoning Code, showing compliance with Chapter 530 requirements related to landscaping and screening of parking and loading areas. The ADA parking space shall be modified to comply with the applicable size requirements.
  6. The parking lot shall be resurfaced and restriped.
B. Nonconforming Use Expansion: Master Properties Minnesota, LLC, on behalf of Allegro Properties and Fiant Dental, has applied for an expansion of a non-conforming use to allow a new 90 square foot entrance vestibule on the west elevation of the building facing Lyndale Ave S.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the above findings and approve the application for an expansion of a nonconforming use to allow for the construction of an approximate 90 square foot entrance vestibule on the west elevation of the existing building facing Lyndale Ave S located on the property at 3225 Lyndale Avenue subject to the following conditions:
  1. All site improvements shall be completed by October 15, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  2. All necessary building permits shall be attained.
3. Seed Inc (BZZ-6270, Ward: 5), 1401, 1407, 1413, 1419 and 1427 8th Ave N (Mei-Ling Anderson).

A. Conditional Use Permit: Application by Seed, Inc. for a conditional use permit to allow a parking lot in the R4-Multiple-Family District located at 1401-1427 8th Ave N.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the conditional use permit application to construct an additional 98-space surface parking lot on the properties located at 1401 8th Ave N, 1407 8th Ave N, 1413 8th Ave N, 1419 8th Ave N, and 1427 8th Ave N, subject to the following conditions:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
B. Variance: Application by Seed, Inc. for a variance to increase the maximum allowed vehicle parking located at 1401-1427 8th Ave N.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the variance application to increase the maximum allowed parking requirements on the properties located at 1401 8th Ave N, 1407 8th Ave N, 1413 8th Ave N, 1419 8th Ave N, and 1427 8th Ave N.
C. Site Plan Review: Application by Seed, Inc. for a site plan review for property located at 1401-1427 8th Ave N.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow a 98-space surface parking lot on the properties located at 1401 8th Ave N, 1407 8th Ave N, 1413 8th Ave N, 1419 8th Ave N, and 1427 8th Ave N, subject to the following conditions:
  1. All site improvements shall be completed by October 28, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  2. CPED Staff review and approval of the final site, lighting and landscaping plans.
  3. As an alternative to installing series of shrubs along the fence on the south property line, the applicant shall install a hedge that is six feet in height and 95 percent opaque throughout the year.
  4. The applicant shall provide not less than one tree per 25 feet of parking lot frontage along Irving Avenue North, 8th Avenue North, and Humboldt Avenue North.
  5. All landscaping materials should comply with the plant material, installation, and maintenance standards in Section 530.200 and 530.210.
  6. All signs are expected to comply with Chapter 543 of the Zoning Code. All new signage requires a separate permit from CPED.
4. Walgreens (BZZ-6266, Ward: 5), 621 West Broadway (Kimberly Holien).

A. Site Plan Review: Application by John Kohler of Semper Development has submitted an application for site plan review for the construction of a two story building with 30,660 square feet of gross floor area at 621 West Broadway. The property is zoned C3S, Community Shopping Center district and is located in the WB, West Broadway overlay district. 
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission approve the site plan review application for a new two-story, 30,660 square foot building at 621 West Broadway, subject to the following conditions:
  1. All site improvements shall be completed by November 12, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  2. CPED Staff review and approval of the final site, elevation, floor plans, landscaping and lighting plans before building permits may be issued.
  3. No shelving, signage, merchandise, newspaper racks or other similar fixtures shall be placed in front of the required ground level transparent windows.
  4. A minimum of 226 shrubs shall be planted on site, in accordance with Section 530.160 of the zoning code. 
  5. All on-site dumpsters shall be screened in accordance with Section 535.80 or stored within the building. 
  6. A minimum of six short-term bicycle parking spaces be provided on-site or within the right-of-way adjacent to the site. 
5. Broadway Flats (BZZ-6259 and Vac-1610, Ward: 5), 2220 West Broadway and 2413, 2419, 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N (Hilary Dvorak).

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the rezoning of the properties located at 2413 and 2419 Penn Ave N from the OR2, High Density Office Residence District to the C3A, Community Activity Center District.
B. Rezoning: Application by Dean Rose with Rose Development, LLC to rezone the properties located at 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N from the R5, Multiple-family District to the C3A, Community Activity Center District.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the rezoning of the properties located at 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N from the R5, Multiple-family District to the C3A, Community Activity Center District.
C. Conditional Use Permit: Application by Dean Rose with Rose Development, LLC for a conditional use permit for a liquor store located at 2220 West Broadway and 2413, 2419, 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the conditional use permit application for a liquor store located at 2220 West Broadway and 2413, 2419, 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N subject to the following conditions:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. A fixture plan for the liquor store shall be reviewed and approved before building permits are issued.
D. Variance: Application by Dean Rose with Rose Development, LLC for a variances of the PO Pedestrian Oriented Overlay District to allow the building to be setback greater than 8 feet, to allow more than 60 feet of parking lot frontage and to allow the driveway width to exceed 20 feet for the properties located at 2220 West Broadway and 2413, 2419, 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the variance application of the PO Pedestrian Oriented Overlay District to allow the building to be setback greater than 8 feet, to allow more than 60 feet of parking lot frontage and to allow the driveway width to exceed 20 feet for the property located 2220 West Broadway and 2413, 2419, 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N.
E. Site Plan Review: Application by Dean Rose with Rose Development, LLC for a site plan review for a new mixed-use building with 103 dwelling units and approximately 17,000 square feet of ground floor commercial space located at 2220 West Broadway and 2413, 2419, 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application for a new mixed-use building with 103 dwelling units and approximately 17,000 square feet of ground floor commercial space located 2220 West Broadway and 2413, 2419, 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N subject to the following conditions:
  1. Approval of the final site, landscaping, elevation and lighting plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by October 28, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. At least 20 percent of the site not occupied by the building shall be landscaped per Section 530.160 of the zoning code.
  4. The minimum tree and shrub requirement shall be met on site per Section 530.160 of the zoning code.
  5. A 7-foot wide landscaped yard shall be provided where the parking or loading facility is fronting along a public street, public sidewalk or public pathway per Section 530.170 of the zoning code.
  6. A minimum of 2 trees shall be planted on either side of the driveway along West Broadway per Section 530.170 of the zoning code.
  7. Plant materials that grow to a height of at least 6 feet and not less than 95 percent opaque shall be provided between the interior property line and the parking lot per Section 530.170 of the zoning code.
  8. At least 96 of the parking spaces within the development shall be designated for residents.
F. Plat: Application by Dean Rose with Rose Development, LLC for a preliminary plat for property located at 2220 West Broadway and 2413, 2419, 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the preliminary plat application for the property located 2220 West Broadway and 2413, 2419, 2423, 2425, 2503, 2507 and 2511 Penn Ave N and a portion of 2512 Queen Ave N.
G. Vacation: Application by Dean Rose with Rose Development, LLC for a vacation of the entire 12-foot wide allow located within Block 1, Wenz Addition to Minneapolis.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the vacation application of the entire 12-foot wide allow located within Block 1, Wenz Addition to Minneapolis, subject to the retention of easements in favor of Xcel Energy and CenturyLink.
6. Church of St. Anne (BZZ-6260, Ward: 5), 2508, 2512, 2516, 2520, 2524, 2526 and 2538 Queen Ave N, 2215, 2219 and 2223 26th Ave N and 2527 Penn Ave N (Hilary Dvorak).

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the rezoning petition to change the zoning classification of the properties located at 2215, 2219 and 2223 26th Ave N and 2527 Penn Ave N from the R4, Multiple-family District to the R5, Multiple-family District.

D. A. Text Amendment: Amending Title 20 of the Minneapolis Code of Ordinances as follows:
Amending Chapter 520 related to Zoning Code:  Introductory Provisions
Amending Chapter 548 related to Zoning Code:  Commercial Districts
The purpose of the amendment is to recognize board and care home facilities, nursing home facilities, and assisted living facilities as allowed uses in additional commercial zoning districts.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the zoning code text amendment, amending Chapters 520 and 548.
9.  Zoning Code Text Amendment (Ward: All), (Brad Carter).

A. Text Amendment: Amending Title 22 of the Minneapolis Code of Ordinances as follows:
Amending Chapter 598 related to Land Subdivision Regulations:  Article IV. Subdivision Approval and Article V. Parkland Dedication
The purpose of the amendment is to revise the parkland dedication ordinance to conform to recently adopted state law.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the land subdivision regulations text amendment. The Department of Community Planning and Economic Development further recommends that the City Planning Commission refer this text amendment to City Council Committee of the Whole.
