Review for consistency with the Comprehensive Plan the sale of 3627 Emerson Ave N, 4101 James Ave N, 3427 Logan Ave N, 4133 Colfax Ave N, 3707 Fremont Ave N, and 3322 Fremont Ave N for the construction of single-family homes.
Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

Review for consistency with the Comprehensive Plan the sale of 4155 Irving Ave N and 3510 Colfax Ave N for the construction of single-family homes.
Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.
The City Planning Commission approved the staff recommendations for the above items.

Public Hearings

1. Dwell – Bigos Calhoun Greenway Expansion (BZZ-PL-265, Ward: 13), 3140 Chowen Ave S and 3129 Ewing Ave S (Becca Farrar).
A. Plat: Application by Bigos-Calhoun Greenway, LLC for a final plat and the drainage utility variance for the properties located at 3140 Chowen Ave S and 3129 Ewing Ave S.   
Action: The City Planning Commission adopted the findings and approved the final plat application and the drainage and utility variance for the properties located at 3140 Chowen Ave S and 3129 Ewing Ave S.
Approved on consent 9-0.
2. Diggity Dog Daycare (BZZ-6150, Ward: 12), 4225 Hiawatha Ave (Kimberly Holien).
A. Conditional Use Permit: Application by Joseph Schwagerl for a conditional use permit to allow an animal shelter (dog daycare) in the existing building at 4225 Hiawatha Ave, in the I1, Light Industrial District and IL, Industrial Living Overlay District.  
Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow an animal shelter (dog daycare) at the property located at 4225 Hiawatha Ave, subject to the following conditions: 
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.    
  2. Dogs shall not be left unattended in any outdoor areas adjacent to the site. Barking dogs shall be returned indoors immediately.
  3. Three additional shrubs shall be required between the parking area and Hiawatha Avenue and five additional shrubs shall be required between the parking area and 42nd Street E in accordance with the previously approved site plan. Said shrubs shall be a minimum of three feet in height. 
  4. Wood mulch shall be provided in the landscaped areas. 
  5.  The spaces within the off-street parking area shall be restriped, in compliance with Section 541.320 of the zoning code.

3. Olu’s Home Inc (BZZ-6137, Ward: 5), 1315 12th Ave N (Janelle Widmeier).
A. Rezoning: Application by Gloria Freeman, on behalf of Olu’s Home, Inc., for a rezoning of the property of 1315 12th Ave N from R4 Multiple-family District to OR2 High Density Office Residence District to allow use of the existing building for offices, a child care center and a development achievement center. 
Action: The City Planning Commission recommended that the City Council adopt the findings and approve the petition to rezone the property of 1315 12th Ave N from R4 to OR2.
Approved on consent 9-0.
4. Hyatt Place (BZZ-6161, Ward: 7), 425 7th St S (Aaron Hanauer).
A. Conditional Use Permit: Application by Rick Fox of Crosstown Sign for a conditional use permit to allow three wall signs to exceed the maximum height allowed for buildings that exceeds 6 stories or 84 feet in a downtown district located at 425 7th St S.
Action: The City Planning Commission adopted the findings and approved the application to allow wall signs to exceed the maximum height allowed for buildings that exceeds 6 stories or 84 feet in a downtown district. 
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building/sign permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.
  2. All former hotel signs shall be removed prior to the installation of new hotel signs.
Approved on consent 9-0.
B. Variance: Application by Rick Fox of Crosstown Sign for a variance to increase the number of wall signs permitted (from two to three) for an individual building use when the building exceeds six stories or 84 feet in a downtown district located at 425 7th St S.
Action: The City Planning Commission adopted the findings and approved the application for a variance to increase the number of wall signs permitted (from two to three) for an individual building use when the building exceeds six stories or 84 feet in a downtown district for the property at 425 7th St S.
Approved on consent 9-0.
C. Variance: Application by Rick Fox of Crosstown Sign for a variance to increase the number of wall signs permitted (from one to two) for a building wall when the building exceeds six stories or 84 feet in a downtown district located at 425 7th St S.
Action: The City Planning Commission adopted the findings and approved the application for a variance to increase the number of wall signs permitted (from one to two) for a building wall when the building exceeds six stories or 84 feet in a downtown district for the property at 425 7th St S.

D. Variance: Application by Rick Fox of Crosstown Sign for a variance to increase the maximum size of a wall sign from 120 square feet to approximately 156 square feet for property located at 425 7th St S.
Action: The application for a variance to increase the maximum size of a wall sign from 120 square feet to approximately 156 square feet has been withdrawn.

E. Variance: Application by Rick Fox of Crosstown Sign for a variance to increase the maximum height of a projecting sign from 28 feet to 31 feet to allow for a new projecting sign facing S 7th St for property located at 425 7th St S.
Action: The City Planning Commission adopted the findings and denied the application for a variance to increase the maximum height of a projecting sign from 28 feet to 31 feet for the property at 425 7th St S.

5. Urban Homeworks (BZZ-5887, Ward: 3 and 5), 2015 Emerson Ave N (2009 Emerson Ave N) (Becca Farrar).
A. Rezoning: Application by Urban Homeworks, Inc. for a petition to rezone the property located at 2015 Emerson Ave N from the R5 (Multiple-family) District to the C1 (Neighborhood Commercial) District. The parcel is currently split-zoned.
Action: The City Planning Commission recommended that the City Council adopt the findings and approve the rezoning petition to change the zoning classification of the property located at 2015 Emerson Ave N (2009 Emerson Ave N) from the R5 (Multiple-family) District to the C1 (Neighborhood Commercial) District.

B. Conditional Use Permit: Application by Urban Homeworks, Inc. for a conditional use permit to legalize an existing contractor’s office located at 2015 Emerson Ave N.
Action: The City Planning Commission adopted the findings and approved the conditional use permit application to legalize an existing contractor’s office on the property the property located at 2015 Emerson Ave N (2009 Emerson Ave N) subject to the following conditions:
  1.  The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.   
  2. The final plans shall be in compliance with Section 530.170 of the Zoning Code, along the north and west property lines.
  3. All applicable building permits shall be attained to legalize the use of the building.
  4. Any changes to the site plan as a result of Preliminary Development Review may result in another public hearing by the City Planning Commission if the Zoning Administrator deems such changes significant under sections 525.360 and 530.100 of the Zoning Code.
  5. The final plans for the attached garage shall be modified to adhere to the required 7 foot setback requirement along the north property line.

6. Betty Danger’s Country Club (BZZ-6158, Ward: 1), 2519 Marshall St NE (Becca Farrar).
A. Conditional Use Permit: Application by Smart Associates, on behalf of Too Fast To Die, LLC, and Leslie Bock, for a conditional use permit to increase the maximum permitted height of a ferris wheel or revolving patio that is accessory to the proposed restaurant, from 4 stories or 56 feet to approximately 60 feet for the property located at 2519 Marshall St NE.
Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow an increase in height for a ferris wheel/revolving patio from 4 stories or 56 feet to approximately 60 feet for property located at 2519 Marshall St NE subject to the following conditions:
  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. No music or flashing lights shall be associated with the ferris wheel/revolving patio.

B. Variance: Application by Smart Associates, on behalf of Too Fast To Die, LLC, and Leslie Bock, for a variance of the enclosed building requirement for the property located at 2519 Marshall St NE.
Action: The City Planning Commission adopted the findings and approved the application for a variance of the enclosed building requirement to allow a ferris wheel/revolving patio and outdoor miniature golf course on the property located at 2519 Marshall St NE subject to the following condition:
  1. No music or flashing lights shall be associated with the outdoor features that include the ferris/wheel revolving patio and outdoor miniature golf course.

C. Site Plan Review: Application by Smart Associates, on behalf of Too Fast To Die, LLC, and Leslie Bock, for a site plan review to allow the construction of a new single-story, 6,328 square foot restaurant on the property. The property is zoned C2 (Neighborhood Corridor Commercial) District with the MR (Mississippi River Critical Area) Overlay District for the property located at 2519 Marshall St NE.
Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a new single-story, approximately 6,328 square foot restaurant on the property located at 2519 Marshall St NE subject to the following conditions of approval:
  1. Staff review and approval of the final site, elevation, lighting and landscaping plans before building permits may be issued.  
  2. All site improvements shall be completed by August 12, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. A lighting plan shall be provided in compliance with Chapters 535 and 541 of the Zoning Code.
  4. A detail of all proposed fencing shall be provided in the final submittal.
  5. All signs require separate permits from the Zoning Office and must comply with Chapter 543 of the Zoning Code.
  6.  The north elevation of the proposed structure facing the on-site parking lot shall be modified to meet the 30% window requirement as outlined in Section 530.120 of the Zoning Code.
  7. The north, south and east elevations shall be modified to comply with the blank wall provision outlined in Section 530.120 of the Zoning Code.
  8. The final elevations shall include the applicable material calculations for each elevation of the building. Cement board materials shall not exceed more than 30% coverage on any single elevation of the proposed building.
  9.  The final landscaping plan shall be modified to comply the following standards as outlined in Section 530.160 and 530.170 of the Zoning Code including: the 20% landscaping requirement, the applicable landscaping and screening provisions along the west property line as well as the 25-foot linear tree provision.
  10. The final landscape plan shall identify the types and sizes of all proposed and existing landscaping on the premises.
  11. A 4-foot wide walkway shall be installed along the north side of the building to allow for pedestrians to safely access their vehicles.
  12. Compliance with all applicable specific development standards as outlined in Chapter 536 of the Zoning Code.
  13. Any changes to the site plan as a result of Preliminary Development Review may result in another public hearing by the City Planning Commission if the Zoning Administrator deems such changes significant under sections 525.360 and 530.100 of the Zoning Code.

7. 2827 Williams Ave SE (BZZ-6066, Ward: 2), 2827 Williams Ave SE and 2828 University Ave SE (Shanna Sether).
A. Rezoning: Application by David Barnhart for a rezoning petition to change the zoning classification of 2827 Williams Ave SE from R4 Multiple-Family District to C2 Neighborhood Corridor Commercial District and PO Pedestrian Oriented Overlay District to allow for the expansion of an accessory parking lot serving the office building at 2828 University Ave SE.
Action: Notwithstanding staff recommendation, the City Planning Commission recommended that the City Council approve the application for the rezoning petition to change the zoning classification of 2827 Williams Ave SE from R4 Multiple-Family District to C2 Neighborhood Corridor Commercial District and PO Pedestrian Oriented Overlay District to allow for the expansion of an accessory parking lot serving the commercial and office building at 2828 University Ave SE, based on the following findings:
  1. Policy 1.5.2, facilitating the redevelopment of underutilized commercial areas by evaluating possible land use changes.
  2. Leasing and retention of businesses by approving the land use change.
  3. Policy 1.1.5, ensuring land use regulations continue to promote development that is compatible with nearby properties. 
  4. The project is in the public interest.
  5. The approval of the rezoning will enhance the use of commercial space along the corridor.

8. Minnesota Multi-purpose Stadium (Ward: 7), 401 Chicago Ave, 701, 713, 719 and 811 3rd St S, 700, 716 and 728 4th St S and 300 and 309 9th Ave S (Hilary Dvorak).
A. The Stadium Implementation Committee has forwarded a recommendation to the City of Minneapolis to approve a request by the Minnesota Sports Facilities Authority to construct the Minnesota Multi-Purpose Stadium, a 1,500,000 square foot, 65,500 seat stadium, with expansion up to 73,000, for use by the Minnesota Vikings and other civic and community uses, and stadium related infrastructure, subject to conditions and mitigation measures, on property located at 401 Chicago Ave, 701, 713, 719 and 811 3rd St S, 700, 716 and 728 4th St S and 300 and 309 9th Ave S.
The City Planning Commission will review the recommendation of the Stadium Implementation Committee and make an advisory recommendation to the City Council. 
Action: The City Planning Commission recommends that the City Council approve the recommendation of the Stadium Implementation Committee, with the following additional recommendation:
  1. Following completion of the improvements referenced in the action of the Stadium Implementation Committee, subsequent changes will be subject to the City’s zoning ordinance and all applicable City regulations.
  2. Condition to be added as 5G in the Implementation Committee action: Delegate final review and approval of the parking garage designs to the City of Minneapolis Community Planning and Economic Development Director and the Public Works Director.

9. Minnesota Multi-purpose Stadium (Vac-1619 and Vac-1622, Ward: 7), 401 Chicago Ave (Hilary Dvorak).
A. Vacation: Vacation (Vac 1619) 5th St S, lying northwesterly of 6th St S and lying between Chicago Ave and 11th Ave S.
Action: The City Planning Commission continued indefinitely the application to vacate 5th Street South lying northeasterly of 6th Street South and lying between Chicago Avenue and 11th Avenue South subject to the retention of an easement in favor of CenterPoint Energy, MCI Communications Services Inc., Comcast, County of Hennepin, Xcel Energy, CenturyLink and the City of Minneapolis.
Approved on consent 8-0.

B. Vacation: Vacation (Vac 1622) Parts of 4th St S, adjoining the east side of the Metrodome parcel.

Action: The City Planning Commission continued indefinitely the application to vacate parts of 4th Street South adjoining the East side of the Metrodome parcel subject to the retention of an easement in favor of MCI Communications Services Inc.
