Review for consistency with the Comprehensive Plan the sale of 914 42nd Ave N, 3830 Colfax Ave N, 4111 Colfax Ave N, 3418 Girard Ave N, 3654 Girard Ave N, 3500 Humboldt Ave N, 2731 James Ave N, 3510 Knox Ave N, and 3543 Lyndale Ave N for the construction of single-family homes.

Recommended Action: Approve the staff reports – the items are consistent with The Minneapolis Plan.  The Commission further recommends that staff consider the following for the following sales: 4111 Colfax Ave N is a tax parcel with one lot (Lot 11) and a half-lot (south half of Lot 10). If possible the south half of Lot 10 should be combined with the north half of Lot 10, which is not owned by the City, to reinstate a standard sized lot.  914 - 42nd Ave N is a larger corner lot that should be considered for sale for a development that exceeds the minimum designstandards of the zoning code and recognizes the prominence of the site and the character of the block.

The City Planning Commission approved the staff recommendations for the above items.

Public Hearings

1. LifeSource (BZZ-6015 and Vac-1615, Ward: 3), 2225-2313 W River Rd N and 70 N 2nd Ave (Janelle Widmeier).

A. Conditional Use Permit: Application by Leonard, Street and Deinhard, on behalf of Upper Midwest Organ Procurement Organization, for a conditional use permit to increase the maximum height of a building located in the SH Shoreland Overlay District from 35 feet to 41 feet for the property located at 2225-2313 W River Rd N and 70 N 2nd Ave to allow a new 2-story, approximately 42,000 square foot nonresidential building.

Action: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to increase the maximum height of a building located in the SH Shoreland Overlay District from 35 feet to 41 feet for the property located at 2225-2313 West River Road N and 70 N 22nd Ave, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Site Plan Review: Application by Leonard, Street and Deinhard, on behalf of Upper Midwest Organ Procurement Organization, for a site plan review for the property located at 2225-2313 W River Rd N and 70 N 2nd Ave.

Action: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for site plan review to allow a new nonresidential building for the property located at 2225-2313 West River Road N and 70 N 22nd Ave, subject to the following conditions:

  1. Blank, uninterrupted walls that do not include windows, entries, recesses or projections, or other architectural elements on the north elevation shall not exceed 25 feet in length as required by section 530.120 of the zoning code.
  2. Screening that is 6-feet tall and not less than 95 percent opaque shall be provided on the north side of the parking area as required by section 530.170 of the zoning code.
  3. Decorative metal fencing, which can include vinyl coated chain link, shall be installed where fencing is proposed.
  4. The applicant is encouraged to provide additional bicycle parking for employees due to the site’s proximity to downtown and two bicycle routes and additional public bicycle parking.
  5. Department of Community Planning and Economic Development staff review and approval of the final building elevations, floor, site, landscape and lighting plans.
  6. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by July 15, 2015, or the permit may be revoked for non-compliance.
  7. Trees shall be planted along the north side of the property in consultation with the Public Works Department as a buffer to the adjacent townhomes.
  8. Public sidewalks and boulevard trees shall be added along West River Road North and 22nd Ave North.

C. Vacation: Application by Leonard, Street and Deinhard, on behalf of Upper Midwest Organ Procurement Organization, for a vacation of multiple drainage and utility easements for the property located at 2225-2313 W River Rd N and 70 N 2nd Ave.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the application for the vacation of multiple drainage and utility easements for the property located at 2225-2313 West River Road N and 70 N 22nd Ave, subject to the following conditions:

  1. An easement shall be reserved for Xcel, CenterPoint Energy, and Comcast.
  2. A new easement for City utilities shall be provided.

2. Washburn Center for Children (BZZ-6097, Ward: 5), 1104, 1118 and 1128 Glenwood Ave and 275 Dupont Ave N (Janelle Widmeier).

A. Conditional Use Permit: Application by Cresa, on behalf of Washburn Center for Children, for a conditional use permit to increase the maximum number of stories from 4 to 5 for the property located at 1104, 1118, and 1128 Glenwood Ave and 275 Dupont Ave N to allow a new 3-floor, approximately 54,400 square foot building. (Based on the zoning code’s definition of story, any story above the first floor exceeding 14 feet in height is considered 2 stories. The second and third floors are proposed to be 15 feet; therefore, the proposed building is considered to have 5 stories).

Action: The conditional use permit application to increase the maximum height has been withdrawn.

B. Variance: Application by Cresa, on behalf of Washburn Center for Children, for a variance of the PO Pedestrian Oriented Overlay District building placement standard to allow the first floor of the building to be setback more than 8 feet from Glenwood Ave and Dupont Ave N for the property located at 1104, 1118, and 1128 Glenwood Ave and 275 Dupont Ave N.

Action: The City Planning Commission adopted the findings and approved the variance of the PO Pedestrian Oriented Overlay District building placement standard to allow the first floor of the building to be set back more than 8 feet from Glenwood Avenue and Dupont Ave N located at the property of 1104, 1118, and 1128 Glenwood Avenue and 275 Dupont Ave N, subject to the following condition:

  1. The first floor setbacks shall be as shown on the plans.

C. Variance: Application by Cresa, on behalf of Washburn Center for Children, for a variance of the PO Pedestrian Oriented Overlay District standard to allow a parking area with more than 60 feet of street frontage adjacent to Glenwood Ave for the property located at 1104, 1118, and 1128 Glenwood Ave and 275 Dupont Ave N.

Action: The City Planning Commission adopted the findings and approved the variance of the PO Pedestrian Oriented Overlay District standard to allow a parking area with more than 60 feet of street frontage adjacent to Glenwood Ave located at the property of 1104, 1118, and 1128 Glenwood Ave and 275 Dupont Ave N, subject to the following condition:

  1. The bus lane width shall be reduced to 12 feet. The area not needed for maneuvering of buses shall be landscaped and shall include stormwater-retention features.

D. Action: The City Planning Commission adopted the findings and approved the variance of the PO overlay district standard limiting driveway to 20 feet of street frontage to allow a 28 foot wide driveway on Glenwood Avenue located at the property of 1104, 1118, and 1128 Glenwood Ave and 275 Dupont Ave N.

E. Variance: Application by Cresa, on behalf of Washburn Center for Children, for a variance to increase the maximum height of a wall sign from 28 feet to 49 feet for the property located at 1104, 1118, and 1128 Glenwood Ave and 275 Dupont Ave N.

Action: The City Planning Commission adopted the findings and approved the variance to increase the maximum height of a wall sign from 28 feet to 49 feet located at the property of 1104, 1118, and 1128 Glenwood Ave and 275 Dupont Ave N.

F. Site Plan Review: Application by Cresa, on behalf of Washburn Center for Children, for a site plan review for the property located at 1104, 1118, and 1128 Glenwood Ave and 275 Dupont Ave N.

Action: The City Planning Commission adopted the findings and approved the application for site plan review for a new nonresidential building located at the property of 1104, 1118, and 1128 Glenwood Ave and 275 Dupont Ave N, subject to the following conditions:

  1. Additional architectural elements shall be provided on the second floor of the north elevation, the third floor of the west elevation and the first floor of the west elevation as required by section 530.120 of the zoning code to prevent blank, uninterrupted walls exceeding 25 feet in length that do not include architectural elements.
  2. Windows shall be provided on the second floor of the north elevation as required by section 530.120 of the zoning code.
  3. The applicant is encouraged to provide awnings over the entrances to provide additional shelter as recommended in the PO Pedestrian Oriented Overlay District standards.
  4. The applicant shall explore and consider other fence material options, such as decorative perforated metal, for the children’s play area.
  5. At least 34 deciduous canopy trees shall be provided on-site as required by section 530.160 of the zoning code.
  6. At least 3 canopy trees shall be provided in the landscaped yard adjacent to Glenwood Ave as required by section 530.170 of the zoning code.
  7. All surface parking spaces shall be located within 50 feet of a deciduous tree as required by section 530.170 of the zoning code.
  8. Fencing materials shall comply with Article VI, Chapter 535 Regulations of General Applicability of the zoning code.
  9. Department of Community Planning and Economic Development staff review and approval of the final elevations, floor, site, lighting and landscape plans.
  10. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by July 15, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

3. Longfellow Market (BZZ-6070 and Vac-1591, Ward: 12), 3801, 3803, 3805 and 3815 E Lake St and 3013 38th Ave S (Becca Farrar).

A. Rezoning: Application by Mularoni & Co Architecture, LLC, on behalf of Joel Ahlstrom and Longfellow Market, LLC, for a petition to rezone 3801 and 3803 E Lake St from the C1 (Neighborhood Commercial) District to the C2 (Neighborhood Corridor Commercial) District in order to unify the underlying zoning for the properties located at 3801, 3803, 3805 & 3815 E Lake St and 3013 38th Ave S.

Action: The City Planning Commission recommended that the City Council adopt the findings and approvethe rezoning petition to change the zoning classification of the properties located at 3801 and 3803 E Lake St from the C1 (Neighborhood Commercial) District to the C2 (Neighborhood Corridor Commercial) District in order to unify the underlying zoning for the properties.

Rezoning: Application by Mularoni & Co Architecture, LLC, on behalf of Joel Ahlstrom and Longfellow Market, LLC, for a petition to add the TP (Transitional Parking) Overlay District to the property located at 3013 38th Ave S. The underlying R1A (Single-family) District would be maintained on the property for the properties located at 3801, 3803, 3805 & 3815 E Lake St and 3013 38th Ave S.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the rezoning petition to add the Transitional Parking (TP) Overlay District to the property located at 3013 38th Ave S. The underlying R1A (Single-family) District would be maintained on the property.

Conditional Use Permit: Application by Mularoni & Co Architecture, LLC, on behalf of Joel Ahlstrom and Longfellow Market, LLC, for a conditional use permit to allow an off-street parking lot in the TP Overlay District for the properties located at 3801, 3803, 3805 & 3815 E Lake St and 3013 38th Ave S.

Action: The City Planning Commission adopted the findings and approved the conditional use permit application to allow an off-street parking lot in the TP Overlay District on the properties located at 3801, 3803, 3805 & 3815 E Lake St and 3013 38th Ave S subject to the following conditions of approval:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. The final plans shall be in compliance with Section 530.170 of the Zoning Code.
  3. The proposal will incorporate all requirements as established as part of the existing Lake Street Streetscape design subject to the review and approval of Public Works. 
  4. The amount of bicycle parking shall be increased.  A total of 60-70 spaces are encouraged on site.
  5. The stucco wall shall be constructed at the time of demolition of the existing home; before work on the parking lot begins.

Action: The City Planning Commission adopted the findings and approvedthe variance application of the Transitional Parking (TP) Overlay District standards regarding the requirement that the parking lot be closed with a secured gate or other appropriate mechanism between the hours of 10:00 p.m. and 6:00 a.m. for the properties located at 3801, 3803, 3805 & 3815 E Lake St and 3013 38th Ave S.

Action: The City Planning Commission adopted the findings and approvedthe variance application to allow off-street parking in a required front yard setback along 38th Ave S for the properties located at 3801, 3803, 3805 & 3815 E Lake St and 3013 38th Ave S subject to the following condition of approval:

  1. The final plan shall incorporate a 16-foot wide landscaped yard and a combined 6 foot tall and 3 foot tall stucco wall consistent with the proposed plan along the south property line.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the alley vacation application (Vacation File 1591) subject to the provision of an easement to Centurylink and Xcel Energy over the entire described area.
