A. Rezoning: Application by BKV Group Inc, on behalf of PRG Inc, for a petition to rezone the properties of 2840 and 2844 16th Ave S from R2B Two-family District to R5 Multiple-family District to allow a 4-story multiple family dwelling with 42 units.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the petition to rezone the property of 2840-2844 16th Ave S from R2B Two-family District to R5 Multiple-family District.

D. Site Plan Review: Application by BKV Group Inc, on behalf of PRG Inc, for a site plan review for the properties located at 2839-2845 Bloomington Ave and 2840-2844 16th Ave S.

Action: The City Planning Commission adopted the findings and approved the application for site plan review for a new multiple-family dwelling with 42 units for the property located at 2839-2845 Bloomington Ave and 2840-2844 16th Ave S, subject to the following conditions:

  1. Department of Community Planning and Economic Development staff review and approval of the final elevations, floor, site, lighting and landscape plans.
  2. The applicant shall submit a lighting plan for the Department of Community Planning and Economic Development staff review and approval.
  3. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by July 19, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  4. The applicant is encouraged to provide a walkway between the east-facing patio of the ground floor unit and the 16th Ave public sidewalk.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the application for the alley vacation for the property located at 2839-2845 Bloomington Ave and 2840-2844 16th Ave S, subject to the following conditions:

  1. An easement shall be reserved for Comcast.
  2. A new alley turnaround shall be dedicated in the final plat. The final plat shall be recorded with Hennepin County.

A. Rezoning: Application by Rochelle Barrett, on behalf of Basim Sabri, International Bazaar on Lake, LLC, and Miller Block, LLC, for a petition to rezone the properties located at 301 & 311 E Lake St from the C1 (Neighborhood Commercial) district to the C2 (Neighborhood Corridor Commercial) district in order to allow additional commercial uses within the existing buildings on the premises.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the rezoning petition to change the zoning classification of the properties located at 301 and 311 East Lake Street from the C1 district to the C2 district.

3. Driven Donkey (BZZ-6072, Ward: 3), 1401 Marshall St NE (Aaron Hanauer).

A. Nonconforming Use Change: Application by Tyrone Folliard, on behalf of Encaustic LLC, has submitted a change of nonconforming use application to allow for an office, retail, and food production facility at 1401 Marshall St NE in the R3/Multiple Family District and the MR/Mississippi River Critical Area Overlay District.

Action: The City Planning Commission adopted the findings and approved the change of nonconforming to allow a food and beverage production facility, office and taste/community room in the R3-Residential District located at 1401 Marshall St NE, subject to the following conditions:

  1. CPED Planning staff review and approval of the final site, landscaping, floor plans and elevations. 
  2. All site/parking lot improvements shall be completed by June 11, 2015, unless extended by the Zoning Administrator, or the permit shall be revoked for non-compliance.
  3. The applicant shall provide a minimum of 14 bike parking spaces to qualify for the bicycle incentive.
  4. The proposed trees and shrubs shall meet plant material standards outlined in section 530.200 of the Minneapolis zoning code. The landscaped yard to the north of the driveway along Marshall Ave shall be screened to be in compliance with section 530.170 (b) (2).
  5. The applicant shall remove the two curb cuts along 14th Ave NE, subject to the Department of Public Works approval.
  6. The applicant shall work with the Department of Public works to add three additional boulevard trees along 14th Ave NE. In addition, the applicant will work with staff to incorporate additional street trees on Marshall St NE.

4. Mississippi Watershed Management Organization Headquarters (BZZ-6069, Ward: 1), 2522 Marshall St NE (Kimberly Holien).

A. Conditional Use Permit: Application by The Mississippi Watershed Management Organization for a conditional use permit to allow development including a walkway and retaining wall in the FP, Floodplain Overlay district for property at 2522 Marshall St NE. 

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit for a fill and development in the Floodplain for the property located at 2522 Marshall St NE, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Variance: Application by The Mississippi Watershed Management Organization for a variance to allowdevelopment including a parking lot, walkways, retaining walls and seating within 40 feet of the top of asteep slope in the SH, Shoreland Overlay district for property at 2522 Marshall St NE. 

Action: The City Planning Commission adopted the findings and approved the application for a variance to allow development within 40 feet of the top of a steep slope for the property located at 2522 Marshall St NE.

5. 3800 46th St E (BZZ-6037, Ward: 12), 3800 46th St E (Aaron Hanauer).

A. Nonconforming Use Change: Application by Charles Fagerhaugh for a change of nonconforming use to allow for a warehouse to store tires and rims at 3800 46th St E in the OR2/High Density Office Residence District, the AP/Airport Overlay District, and the PO/Pedestrian Oriented Overlay District.

Action: The City Planning Commission adopted the findings and approved the change of nonconforming use from a major automobile repair facility to a warehouse in the OR2/High Density Office Residence District for the property at 3800 46th St E, subject to the following conditions:

  1. CPED Planning staff review and approval of the final site, floor plans and elevations.
  2. Necessary permits and approvals shall be obtained for the change of occupancy.
  3. Storage of tires, rims, and refuse outside is prohibited.
  4. All site improvements shall be completed by June 10, 2015, unless extended by the zoning administrator, or the change of nonconforming use may be revoked for non-compliance.
  5. At least 1,256 square feet (10 percent of the net lot area) of the subject property shall be landscaped and at least three deciduous canopy trees and 13 shrubs shall be provided as required by section 530.160 of the zoning code. The applicant is encouraged to plant native grasses and perennials in addition to the required trees and shrubs.
  6. The parking spaces at the south end of the lot that do not meet zoning code requirements shall be removed. Five parking spaces shall be provided that meet all size and spacing requirements outlined in chapter 541 of the zoning code.
  7. Fence slats shall be removed.

A. Conditional Use Permit: Application by Anderson-Johnson Association, Inc., on behalf of Minneapolis School District No. 1, for a conditional use permit to increase the maximum allowed height of light poles from 35 feet to 70 feet and 80 feet to allow 4 new poles for the property located at 4800 Abbott Ave S.

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Action: The City Planning Commission recommended that the City Council adopt the findings and approve the application for rezoning from the OR2, High Density Office Residence district, to the C2, Neighborhood Corridor Commercial district for the property located at 4705 Cedar Ave S and 4700 Longfellow Ave.

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit for an off-sale liquor store for the property located at 4705 Cedar Ave S and 4700 Longfellow Ave, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.   
  2. No shelving, signage, merchandise, newspaper racks or other similar fixtures shall be placed in front of the required ground level transparent windows.
  3. Plantings proposed between the parking area and Cedar Ave S and between the parking area and 47th Street E shall be a minimum of three feet in height and 60 percent opaque.

A. Conditional Use Permit: Application by J Al Willig with Greater Minneapolis Crisis Nursery for a conditional use permit for a child care center for the properties located at 4536, 4540, 4544, 4554 and 4556 4th Ave S and 328 E 46th St.

Action: The City Planning Commission adopted the findings and approved the conditional use permit application for a child care center located at 4536, 4540, 4544, 4554 and 4556 4th Ave S and 328 E 46th St subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. Two of the on-site parking spaces shall be designated for short term drop off.
  3. The site shall be brought into compliance with the approved landscaping plan from 2003.

Action: The City Planning Commission adopted the findings and approved the variance to reduce the off-street parking requirement from 38 spaces to 13 spaces for a child care center for the property located at 4536, 4540, 4544, 4554 and 4556 4th Ave S and 328 E 46th St subject to the following condition:

  1. There shall be a minimum of three bike parking spaces provided on site.

A. Rezoning: Application by Carol Lansing, on behalf of NHH Properties II, LLC, for a rezoning from I1, Light Industrial to C3A, Community Activity Center district, retaining the PO and UA Overlay districts for the property located at 315 27th Ave SE.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the application for rezoning from the I1, Light Industrial district to the C3A, Community Activity Center district for the property located at 315 27th Ave SE.

B. Conditional Use Permit: Application by Carol Lansing, on behalf of NHH Properties II, LLC, for a conditional use permit for a K-12 school in the C3A district at 315 27th Ave SE.

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit for a K-12 school for the property located at 315 27th Ave SE, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.    
  2. No shelving, signage, merchandise, newspaper racks or other similar fixtures shall be placed in front of the required ground level transparent windows.
  3. The proposed vinyl siding shall be replaced with Hardiboard, fiber cement, metal panel or an alternate durable material. 
  4. Should the parking requirement exceed the amount of parking available on site once the school reaches peak enrollment, a variance to the minimum vehicle parking requirement would be required at that time. 
  5. Canopy encroachments into the public right-of-way shall require encroachment permits from Public Works. 
  6. The applicant shall plant additional boulevard trees along 27th Ave.
  7. Community Planning and Economic Development staff will work with the applicant to ensure the landscaping done by students is completed in a way that enhances the public realm and is completed by June 10, 2015.

10. 4 Marq (BZZ-6074, Ward: 7), 400 Marquette Ave (Becca Farrar).

A. Variance: Application by UrbanWorks Architecture, LLC, on behalf of Mortenson Development, Inc., and L.S.T. Properties, LLP, for a variance of the interior side yard setback requirement along the public alley adjacent to the south property line from 15 feet to approximately 0 feet for residential uses located at 400 Marquette Ave.

Action: The City Planning Commission adopted the findings and approved the application to allow a variance of the interior side yard setbacks along the south property line to approximately 0 feet at the closest point to the building wall on the property located at 400 Marquette Ave.

B. Site Plan Review: Application by UrbanWorks Architecture, LLC, on behalf of Mortenson Development, Inc., and L.S.T. Properties, LLP, for a site plan review application for a new 30-story, 302 foot tall mixed-use development that includes 262 market-rate apartments, 217 above-grade parking spaces and approximately 4,000 square feet of ground level retail along S 4th St. The property is located in the B4-2 (Downtown Business) District, and the DP (Downtown Parking) Overlay District at 400 Marquette Ave.

Action: The City Planning Commission adopted the findings and approved the application for site plan review to allow a new 30-story, 302 foot tall mixed-use development that includes 262 market-rate apartments, 217 above-grade parking spaces and approximately 4,000 square feet of ground level retail along S 4th St on the property located at 400 Marquette Ave subject to the following conditions:

  1. All site improvements shall be completed by June 10, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  2. CPED Staff review and approval of the final site, elevation, landscaping and lighting plans before building permits may be issued.
  3. The applicant is encouraged to provide additional short-term and/or long-term bicycle parking for the commercial component of the development.
  4. The development shall comply with the floor area ratio premiums for street level retails uses and for mixed-use residential and the applicable standards outlined in Section 549.220 of the Zoning Code.
  5. The applicant shall work with staff, in consultation with Public Works and Metro Transit, to integrate and incorporate the bus shelter/shelter type amenities into the building along 4th St S.  
  6. The applicant shall work with staff, in consultation with Public Works, in the event that the existing bus shelter along 4th St S is not reinstalled, to plant street trees along 4th St S.

11. 15th Ave Student Housing (BZZ-6080, Ward: 2 and 3), 700, 702, 704, 706, 710, 712, and 714 14th Ave SE, 1409, 1411, 1413, 1415, 1417, and 1419 7th St SE, 701, 709, 715, and 717 15th Ave SE (Becca Farrar).

A. Rezoning: Application by Faegre Baker Daniels, LLP, on behalf of CPM Development, LLC, for a petition to rezone the parcels at 700, 702, 704, 706, 710, 712, and 714 14th Ave SE, 1409, 1411, 1413, 1415, 1417, and 1419 7th St SE, 701, 709, 715, and 717 15th Ave SE from the R5 (Multiple-family) District to the R6 (Multiple-family) District. The UA (University Area) Overlay District would be maintained.

Action: The City Planning Commission continued the rezoning petition to change the zoning classifications of the properties located at 700, 702, 704, 706, 710, 712, and 714 14th Ave SE, 1409, 1411, 1413, 1415, 1417, and 1419 7th St SE, 701, 709, 715, and 717 15th Ave SE from the R5 District to the R6 District to the June 24, 2013, Planning Commission meeting.

B. Variance: Application by Faegre Baker Daniels, LLP, on behalf of CPM Development, LLC, for a variance to reduce the front yard setback along the west property line adjacent to 14th Ave SE from 15 feet to 7 feet, 11 inches for the building and to allow various yard encroachments for the properties located at 700, 702, 704, 706, 710, 712, and 714 14th Ave SE, 1409, 1411, 1413, 1415, 1417, and 1419 7th St SE, 701, 709, 715, and 717 15th Ave SE.

Action: The City Planning Commission continued the application for a variance to reduce the front yard setback along the west property line adjacent to 14th Ave SE from 15 feet to 7 feet, 11 inches for the building and to allow various yard encroachments for the properties located at 700, 702, 704, 706, 710, 712, and 714 14th Ave SE, 1409, 1411, 1413, 1415, 1417, and 1419 7th St SE, 701, 709, 715, and 717 15th Ave SE to the June 24, 2013, Planning Commission meeting.

C. D. Variance: Application by Faegre Baker Daniels, LLP, on behalf of CPM Development, LLC, for a variance to reduce the corner side yard setback along the south property line adjacent to 7th St SE from 15 feet to 5 feet, 4 inches for the building and to allow various yard encroachments for the properties located at 700, 702, 704, 706, 710, 712, and 714 14th Ave SE, 1409, 1411, 1413, 1415, 1417, and 1419 7th St SE, 701, 709, 715, and 717 15th Ave SE.
