Approval of Actions from the February 4, 2013 meeting

The Planning Commission approved the actions from the February 4, 2013 meeting.

Approval of Agenda

Committee of the Whole Consent Agenda – February 7, 2013

 1. Land Sale – 2803 Polk St NE (Staff: Haila Maze)

Review for consistency with the Comprehensive Plan the sale of 2803 Polk St NE for the development of a single family home.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

The City Planning Commission approved the staff recommendation for the above consent item.

Public Hearings

1.   Grain Belt Terraces (PL-272, Ward: 3), 1215-1219 Marshall St NE (Janelle Widmeier).

A. Plat: Application by Collin Kaas with Kaas Wilson Architects for a final plat for property located at 1215-1219 Marshall St NE.

Action: The City Planning Commission adopted the findings and approved the final plat for the property located at 1215-1219 Marshall St NE.

2. New Star Taxi (BZZ-5914, Ward: 9) 1300-14 Lake St E (Shanna Sether).

A. Conditional Use Permit: Application by Dana Paucar of New Star Taxi, on behalf of New York Plaza, LLC, has submitted an application for a conditional use permit to allow for a taxi service in an existing building for the property located at 1300 E Lake St in the C4 General Commercial District.

Action: The City Planning Commission adopted the findings and approved the conditional use permit to allow a taxicab service located at 1300-14 Lake Street East in the C4 General Commercial District, subject to the following conditions:

  1. The Community Planning and Economic Development staff shall review and approve the final floor plans.
  2. All site improvements shall be completed by June 1, 2013, unless extended by the Zoning Administrator or the permit may be revoked for non-compliance.
  3. There shall be no parking of commercial vehicles outdoors, overnight.
  4. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two year of approval.

3. Loving and Caring Child Care (BZZ-5905, Wards: 8 and 9) 3751 and 3801 17th Ave S (Aaron Hanauer).

A. Conditional Use Permit: Application by Ikram Mohamed for a conditional use permit application to allow for a day care facility in an existing building in the R2B zoning district at 3751 17th Ave S. The lot at 3801 17th Ave S (zoned R4) would provide off-street parking.

Action: The City Planning Commission adopted the findings and approved the conditional use permit for a child care center at 3751 17th Ave S and 3801 17th Ave S, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. Approval of the final site, landscaping and refuse storage enclosure plans by the Department of Community Planning and Economic Development.
  3. All site improvements shall be completed by February 19, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  4. The applicant shall work with City of Minneapolis Public Works Department to review the two proposed drop-off spaces on 17th Ave S. If on-street, drop-off spots are approved on 17th Avenue, current signs shall be changed to recognize these spaces dedicated for drop off during the time the childcare facility is open as well as during religious service. 
  5. The applicant shall install landscaping and screening consistent with Section 530.170 of the zoning code within the 17th Ave S landscaped yard (south of the curb cut) and within the 38th Street East right-of-way.
  6. The applicant shall install a minimum of eight (8) bicycle parking spaces. The bicycle parking shall be located to the side of the building outside of all required yards or in the right-of-way if approved by Public Works.
  7. The applicant shall work with the Minneapolis Park and Recreational Board to install three additional trees within the 38th Street East right-of-way. 
  8. The parking lot at 3801 17th Ave S shall be in compliance with parking space and aisle size requirements of section 541.330 of the zoning code.
  9. Unless an alternative is proposed by the applicant and approved by staff, wheel stops shall be installed in the parking lot at 3801 17th Avenue South the length of the parking lot along the eastern property line (alley) as shown on the approved site plan.

4. 718-720 Central Ave NE and 119 ½ 7th St SE (BZZ-5920, Ward: 3) 718-720 Central Ave NE and 119 ½ 7th St SE (Becca Farrar).

A. Conditional Use Permit: Application by DMM Associates, LLC, has submitted a Conditional Use Permit (CUP) in the Industrial Living Overlay District (ILOD) to allow one dwelling unit within the existing multi-tenant structure located on the properties at 718-720 Central Ave NE and 119 ½ 7th St SE. The property is zoned I1 (Limited Industrial) District and is located in the ILOD and University Area (UA) Overlay District.

Action: The City Planning Commission adopted the findings and approved the conditional use permit application in the Industrial Living Overlay District (ILOD) to allow one dwelling unit within the existing multi-tenant structure on the properties located at 718-720 Central Ave NE and 119½ 7th St SE subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. Compliance with Sections 551.370(1), 551.380 and 535.85 of the Zoning Code, in addition to compliance with all applicable building code requirements.

5. The Broadway (BZZ-5913, Ward: 1) 945 Broadway St NE; 1120 Tyler St NE; 1121 Central Ave NE (Aly Pennucci).

A. Rezoning: Application by Melissa Gorman, on behalf of First & First, LLC,has submitted a rezoning petition to change the zoning classification for the properties located at 945 Broadway St NE, 1120 Tyler St NE and 1121 Central Ave NE, to add the IL Industrial Living Overlay District to the I2 Medium Industrial District to allow for more flexibility in uses at this location.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the rezoning petition to add the IL Industrial Living Overlay District to the existing I2 Medium Industrial District for the properties located at 945 Broadway St NE, 1120 Tyler St NE, and 1121 Central Ave NE.

6. 2700 Hennepin Ave (BZZ-5908, Ward: 10), 2700 Hennepin Ave (Becca Farrar). This item was continued from the February 4, 2013 meeting.

A. Variance: Application by Nolan Properties Group, LLC, for a variance of the front yard setback requirement along Hennepin Ave to allow a parking stall located at 2700 Hennepin Ave.

Action: The City Planning Commission adopted the findings and denied the application for a variance of the front yard setback requirement along the east property line adjacent to Hennepin Ave to allow a parking stall on the property located at 2700 Hennepin Ave.

B. Site Plan Review: Application by Nolan Properties Group, LLC, for a site plan review for a single-story, approximately 6,000 square foot multi-tenant retail development that includes a drive-through facility. The property is zoned C2 (Neighborhood Corridor Commercial) District and is located in the SH (Shoreland) Overlay District located at 2700 Hennepin Ave.

Action: The City Planning Commission adopted the findings and approved the site plan review application to allow a new single-story, approximately 6,236 square foot multi-tenant retail development with a drive-through facility on the property located at 2700 Hennepin Ave subject to the following conditions of approval:

  1. Staff review and approval of the final site, elevation, lighting and landscaping plans before building permits may be issued.  
  2. All site improvements shall be completed by February 19, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. The lighting plan shall be modified to comply with Chapters 535 and 541 of the Zoning Code.
  4. No shelving, signage, merchandise, newspaper racks or other mechanisms shall be placed in front of the required ground level transparent windows.
  5. A detail of the privacy fence shall be provided in the final submittal. No board on board cedar fencing shall be permitted. The extent of the fencing shall be clearly delineated on the site plan in order to verify that it does not affect sight lines or encroach into required yards.
  6. All signs require separate permits from the Zoning Office and must comply with Chapter 543 of the Zoning Code.
  7. The south elevation of the proposed structure facing the on-site parking lot shall be modified to meet the 30% window requirement per Section 530.120 of the Zoning Code.
  8. The south elevation of the building is to be brought into compliance with the blank wall provision outlined in Section 530.120 of the Zoning Code.
  9. The final landscaping plan shall be modified to comply with all standards as outlined in Section 530.160 and 530.170 of the Zoning Code including but not limited to the 20% landscaping requirement, the minimum quantity requirement for canopy trees, the applicable landscaping and screening provisions as well as the 25-foot linear tree provision.
  10. Compliance with all applicable specific development standards as outlined in Chapter 536 of the Zoning Code.
  11. A “No Left Turn” sign shall be installed at the drive aisle along 27th Street.
  12. A stop sign and painted stop bar at the drive-thru exit shall be added for safety.

7. Zoning Code Text Amendment (Wards: 6 and 7) (Aly Pennucci).

A. Text Amendment: Amending Title 20 of the Minneapolis Code of Ordinances related to the Zoning Code, as follows:

Amending Chapter 551 related to the Zoning Code: Overlay Districts

The purpose of the amendment is to revise the regulations related to parking lots in the Nicollet Franklin area Pedestrian Oriented Overlay District.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the zoning code text amendment, amending chapter 551.

8. Above the Falls Master Plan Update (Wards: 1, 3, 4 and 5) (Haila Maze).

A. Master Plan: Considering adoption of the Above the Falls Master Plan Update documents.

Action: The City Planning Commission continued the Above the Falls Plan Update document to the March 25, 2013 City Planning Commission meeting. Commissioners request that staff schedule a discussion at Committee of the Whole as well as consult with the City Attorney’s Office regarding issues raised at the public hearing.
