Call to Order

Approval of Actions from the January 22, 2013 meeting

The Planning Commission approved the actions from the January 22, 2013 meeting.

Approval of Agenda

Committee of the Whole Consent Agenda – January 24, 2013

None. The next Committee of the Whole meeting is February 7, 2013.

Public Hearings

1. 2505-09 5th Ave S (BZZ-5903, Ward: 6), 2505-09 5th Ave S (Aly Pennucci).

A. Conditional Use Permit: Application by Hamdi Nur for a conditional use permit to establish a childcare center within an existing building at 2505-09 5th Ave S, in the R4 Multiple-family Residence District.

Action: The City Planning Commission adopted the findings and approved the conditional use permit for a child care center at the property of 2505-09 5th Ave S, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.
  2. The use shall comply with the child care center development standards required by section 536.20 of the zoning code, and applicable signage standards in Chapter 543 of the zoning code.
  3. A walkway at least four (4) feet in width shall connect the front building entrance to the adjacent public sidewalk.
  4. Screening consisting of either a masonry wall, fence, berm or hedge or combination thereof that forms a screen three (3) feet in height and not less than sixty (60) percent opaque shall be provided to screen the accessory parking area along 5th Ave S.
  5. The outdoor play area shall be screened be screened from the residential property to the south and east by a six foot tall fence.
  6. Approval of the final site plan by the Department of Community Planning and Economic Development Department.

Approved on consent 6-0.

B. Variance: Application by Hamdi Nur for a variance to reduce the minimum off-street parking requirement from 11 spaces to 10 spaces for property located at 2505-09 5th Ave S, in the R4 Multiple-family Residence District.

Action: The City Planning Commission adopted the findings approved a variance to reduce the minimum off-street parking requirement from 11 spaces to 10 spaces for a child care center at the property of 2505-09 5th Ave S, subject to the following conditions:

  1. Two designated drop-off spaces shall be provided as approved by Public Works, as specified in Chapter 541, Off-street Parking and Loading. 
  2. A minimum of four (4) bicycle parking spaces shall be provided. The bicycle parking shall be located in the right-of-way as approved by Public Works, or, if located on the subject site, outside of all required yards.

Approved on consent 6-0.

2. 1851 Central Ave NE (BZZ-5898, Ward: 1), 1851 Central Ave NE (Aaron Hanauer).

A. Conditional Use Permit: Application by Daniel Kerkinni for a conditional use permit to allow for an off-sale liquor store in the C2 zoning district at 1851 Central Ave NE.

Action: The City Planning Commission adopted the findings and approved the conditional use permit to allow an off-sale liquor store for the property located at 1851 Central Ave NE, subject to the following conditions: 

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.
  2. The use shall comply with the requirements of Title 14, Liquor and Beer, of the Minneapolis Code of Ordinances and Chapter 4 of the Minneapolis City Charter.
  3. The premises, all adjacent streets, sidewalks and alleys, and all sidewalks and alleys within one hundred (100) feet shall be inspected regularly for purposes of removing any litter found thereon.
  4. A final merchandising plan shall be submitted to CPED Staff for review and approval. No shelving, signage, merchandise, newspaper racks or other mechanisms shall be placed in front of the required ground level transparent windows, nor in front of any existing windows.
  5. Compliance with the window sign provision as stated in Chapter 543.480 of the Zoning Code.
  6. The landscaping of the site shall be maintained in a manner that is in compliance with the 2006 City Council approvals.
  7. There will be no sales of any merchandise through the drive-up window at any time. All signs related to the drive-through window, including reader boards from the previous business, shall be removed. 
  8. All cars exiting from the north driveway onto19th Ave NE will be required to turn left toward Central Ave. ‘Exit left only’ signs shall remain in place.

3. 2700 Hennepin Ave (BZZ-5908, Ward: 10), 2700 Hennepin Ave (Becca Farrar).

A. Variance: Application by Nolan Properties Group, LLC, for a variance of the front yard setback requirement along Hennepin Ave to allow a parking stall located at 2700 Hennepin Ave.

Action: The City Planning Commission continued the variance of the front yard setback requirement along Hennepin Ave to allow a parking stall for the property located at 2700 Hennepin Ave to the February 19, 2013, Planning Commission meeting.

Approved 5-0; Kronzer not present for vote.

B. Site Plan Review: Application by Nolan Properties Group, LLC, for a site plan review for a single-story, approximately 6,000 square foot multi-tenant retail development that includes a drive-through facility. The property is zoned C2 (Neighborhood Corridor Commercial) District and is located in the SH (Shoreland) Overlay District located at 2700 Hennepin Ave.

Action: The City Planning Commission continued the site plan review application to allow a new single-story, approximately 6,000 square foot multi-tenant retail development with a drive-through facility on the property located at 2700 Hennepin Ave to the February 19, 2013, Planning Commission meeting.

Approved 5-0; Kronzer not present for vote.
