A. Minor Subdivision: Application by Mary Alice Smalls and Robert M. Samuelson for minor subdivision of 2842 31st Ave S in the R4 Multiple Family District. The parcel will be divided and added to 3020 and 3016 E 29th St.

Action: The City Planning Commission adopted the findings and approved the minor subdivision of 2842 31st Ave S in the R4 Multiple Family District. The parcel will be divided and added to 3020 and 3016 E 29th St.

2. City of Minneapolis (Vac-1605, Ward: 3) (Becca Farrar).

A. Vacation: Application by The City of Minneapolis to vacate part of a public alley on Lot 3 and Lot 4, Block 7, Morrison’s Addition to North Minneapolis. The alley is located on the block bounded by 4th St N, 6th St N, Lowry Ave N, and 31st Ave N.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the vacation (Vacation File 1605) subject to the retention of an easement for Xcel Energy over the entire described area to be vacated.

3. Seward Senior Housing (BZZ-5794, Ward: 2), 2304 Snelling Ave (Janelle Widmeier).

A. Conditional Use Permit: Application by Brian Miller, on behalf of Seward Redesign, Inc. and CommonBond Communities, for a conditional use permit to allow a multiple-family dwelling with 60 units for the property located at 2304 Snelling Ave.

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow a multiple-family dwelling with 60 units for the property located at 2304 Snelling Ave, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

B. Variance: Application by Brian Miller, on behalf of Seward Redesign, Inc. and CommonBond Communities, for a variance of the PO Pedestrian Oriented Overlay District standard requiring the first floor of a building to be located within 8 feet of an adjacent street to allow the first floor to be set back more than 8 feet from Snelling Ave for the property located at 2304 Snelling Ave.

Action: The City Planning Commission adopted the findings and approved the variance of the PO Pedestrian Oriented Overlay District standard requiring the first floor of a building to be located within 8 feet of an adjacent street to allow the first floor to be set back more than 8 feet from Snelling Ave for the property located at 2304 Snelling Ave, subject to the following condition:

  1. The first floor setbacks shall be as shown on the plans.

C. Variance: Application by Brian Miller, on behalf of Seward Redesign, Inc. and CommonBond Communities, for a variance to reduce the minimum parking requirement from 54 spaces to 37 spaces for the property located at 2304 Snelling Ave.

Action: The City Planning Commission adopted the findings and approved the variance to reduce the minimum parking requirement from 54 spaces to 37 spaces for the property located at 2304 Snelling Ave.

D. Variance: Application by Brian Miller, on behalf of Seward Redesign, Inc. and CommonBond Communities, for a variance to reduce the minimum lot area requirement by 20 percent for the property located at 2304 Snelling Ave.

Action: The City Planning Commission adopted the findings and approved the variance to reduce the minimum lot area requirement by 20 percent for the property located at 2304 Snelling Ave.

E. Variance: Application by Brian Miller, on behalf of Seward Redesign, Inc. and CommonBond Communities, for a variance to reduce the rear yard requirement adjacent to the west lot line from 11 feet to 8.9 feet to allow the building for the property located at 2304 Snelling Ave.

Action: The City Planning Commission adopted the findings and approved the variance to reduce the rear yard requirement adjacent to the west lot line from 11 feet to 8.9 feet to allow building walls with residential windows for the property located at 2304 Snelling Ave.

F. Site Plan Review: Application by Brian Miller, on behalf of Seward Redesign, Inc. and CommonBond Communities, for a site plan review for the property located at 2304 Snelling Ave.

Action: The City Planning Commission adopted the findings and approved the application for site plan review for a multiple-family dwelling with 60 units for the property located at 2304 Snelling Ave, subject to the following conditions:

  1. Community Planning and Economic Development Department – Planning Division staff review and approval of the final elevations, floor, site, lighting and landscape plans.

  2. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by October 29, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  3. Architectural elements shall be added to the first floor north facing wall to prevent a blank, uninterrupted wall that exceeds 25 feet in length as required by section 530.120 of the zoning code.

4. UTEC Mixed-Use (BZZ-5814, Ward: 3), 1313 5th St SE (Kimberly Holien).

A. Conditional Use Permit: Application by Jared Schenk of GEM Realty Capital for a conditional use permit to amend a previously approved Planned Unit Development consisting of 317 dwelling units and approximately 40,655 square feet of ground floor commercial space for the property located at 1313 5th St SE, in the C2, Neighborhood Corridor Commercial district and the UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The City Planning Commission adopted the findings and approved the conditional use permit to allow a planned unit development with 317 dwelling units and 44,655 square feet of ground floor commercial space located at the property of 1313 5th St SE, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. As required by section 527.120 of the zoning code, the development shall comply with the standards for some combination of the following amenities from Table 527-1, Amenities totaling a minimum of 25 points: Recreational Green Roofs equivalent to 25 percent of the total roof area, Outdoor Open Space, Plaza, Pedestrian Improvements, Reflective Roof, Decorative Fencing, Enhanced Exterior Lighting, Water Feature and Recycling Storage Area.  

  3. The applicant shall implement all amenities as required by section 527.120 of the zoning code by October 29, 2014. 

  4. The applicant shall make consideration for the salvage and reuse of existing building elements per Section 527.260 of the zoning code, including but not limited to stone elements, flooring from the gymnasium, the trophy case, decorative wrought iron detailing from the building exterior, classroom desks and chalkboards.

  5. The walkway shall be open a minimum of 16 hours per day, with both ends being open and/or closed at the same time.

B. Variance: Application by Jared Schenk of GEM Realty Capital for a variance to increase the maximum floor area ratio from 2.44 to 2.80 for the property located at 1313 5th St SE, in the C2, Neighborhood Corridor Commercial district and the UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The City Planning Commission adopted the findings and approved the variance to increase the maximum floor area ratio from 2.44 to 2.80 for the property at 1313 5th St SE.

C. Variance: Application by Jared Schenk of GEM Realty Capital for a variance to reduce the minimum vehicle parking requirement from 415 stalls to 332 stalls. A total of 377 parking stalls will be located on site, 45 of which will be made available for public parking for the property located at 1313 5th St SE, in the C2, Neighborhood Corridor Commercial district and the UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The City Planning Commission adopted the findings and approved the variance to reduce the off-street parking requirement from 415 stalls to 332 stalls for the property at 1313 5th St SE.

D. Site Plan Review: Application by Jared Schenk of GEM Realty Capital for a site plan review for the property located at 1313 5th St SE, in the C2, Neighborhood Corridor Commercial district and the UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for site plan review for the property located at 1313 5th St SE, subject to the following conditions:

  1. Community Planning and Economic Development Department – Planning Division staff review and approval of the final elevations, floor, site, lighting and landscape plans.

  2. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by October 29, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  3. Blank walls in excess of 25 feet on the south interior courtyard elevation and the west elevation shall be modified to include windows, entries, recesses, projections or other architectural elements in compliance with Section 530.120 of the zoning code.   

  4. Cement board (Hardi) panels shall not exceed more than 30% coverage on any single exterior elevation of the proposed building.

  5. Shelving, mechanical equipment or other similar fixtures shall not block views into and out of the building in the area between four (4) and seven (7) feet above the adjacent grade, in compliance with Section 530.120 of the zoning code.

  6. At least 40 percent of the first floor façade for each of the non-residential uses shall be windows or doors of clear or lightly tinted glass that allow views into and out of the building at eye level, in accordance with Section 551.120 of the zoning code.   

  7. A minimum of 790 long-term bicycle parking spaces shall be provided within the underground parking area and a minimum of 48 short-term bicycle parking spaces shall be provided, in compliance with Section 541.180 of the zoning code. 

  8. The 25 parking spaces within the grade level parking structure that are reserved for residents shall be signed accordingly.

5. 525 10th Ave SE (BZZ-5770, Ward: 3), 525 10th Ave SE (Janelle Widmeier). This item was continued from the October 15, 2012 meeting.

A. Variance: Application by Pat Mackey with Mackey Malin Architects, on behalf of CPM Development, for a variance to reduce the minimum front yard requirement adjacent to 6th St SE from 15 feet to 7 feet to allow the building located at 525 10th Ave SE.

Action: The City Planning Commission approved the variance to reduce the minimum front yard requirement adjacent to 6th St SE from 15 feet to 7 feet to allow the building for the property located at 525 10th Ave SE.

B. Variance: Application by Pat Mackey with Mackey Malin Architects, on behalf of CPM Development, for a variance to reduce the minimum parking requirement from 15 to 11 spaces for the property located at 525 10th Ave SE.

Action: The City Planning Commission approved the variance to reduce the minimum parking requirement from 14 to 11 spaces for the property located at 525 10th Ave SE.

C. Variance: Application by Pat Mackey with Mackey Malin Architects, on behalf of CPM Development, for a variance to increase the percentage of required parking spaces that may be satisfied by providing compact spaces from 25 to 100 percent for the property located at 525 10th Ave SE.

Action: The variance to increase the percentage of required parking spaces that may be satisfied by providing compact spaces from 25 to 100 percent for the property located at 525 10th Ave SE has been withdrawn.

D. Site Plan Review: Application by Pat Mackey with Mackey Malin Architects, on behalf of CPM Development, for a site plan review for the property located at 525 10th Ave SE.

Action: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for site plan review for a new multiple-family dwelling with 10 units for the property located at 525 10th Ave SE, subject to the following conditions:

  1. Windows on the 10th Avenue Southeast building walls shall be provided as required by section 530.120 of the zoning code.

  2. Brick shall be used on no less than 20 percent of the total façade area and glass windows shall be used on no less than 14 percent on the total façade area. These materials shall be distributed more or less evenly between all of the facades.

  3. Green screens shall be installed at the openings of the ground level parking garage facing the interior lot lines. The structure of the green screens shall be durable and decorative.

  4. Department of Community Planning and Economic Development – Planning Division staff review and approval of the final elevations, floor, site, lighting and landscape plans.

  5. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by October 29, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

6. The Station on 4th (BZZ-5740 and PL-270, Ward: 2), 2635 4th St SE (Kimberly Holien).

A. Rezoning: Application by Fountain Residential for a rezoning from the I1, Light Industrial district with the ILOD, Industrial Living Overlay district to the R6, Multiple-family Residence district, retaining the UA, University Area and PO, Pedestrian Oriented overlay district for the property located at 2635 4th St SE, in the I1, Light Industrial district and the ILOD, Industrial Living, UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the application for the rezoning of 2635 4th St SE from the I1, Light Industrial District, ILOD, Industrial Living Overlay District, PO, Pedestrian Oriented Overlay District, UA, University Area Overlay District to the R6, Multiple-family Residence District, retaining the UA, University Area Overlay District and PO, Pedestrian Oriented Overlay District.

Approved on consent 7-0.

B. Conditional Use Permit: Application by Fountain Residential for a conditional use permit for a Planned Unit Development consisting of 194 dwelling units for the property located at 2635 4th St SE, in the I1, Light Industrial district and the ILOD, Industrial Living, UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The City Planning Commission adopted the findings and approved the conditional use permit to allow a planned unit development with 194 dwelling units located at the property of 2635 4th St SE, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. As required by section 527.120 of the zoning code, the development shall comply with the standards for some combination of the following amenities from Table 527-1, Amenities totaling a minimum of 30 points: Leadership in Energy and Environmental Design (LEED), Reflective roof, Decorative or pervious surface for on-site parking and loading areas, drives, driveways and walkways, Decorative fencing, Enhanced exterior lighting, Recycling storage area, Water feature andPpreservation of land for future right-of-way. 

  3. The applicant shall implement all amenities as required by section 527.120 of the zoning code by October 29, 2014. 

  4. The applicant shall coordinate with the Central Corridor LRT Authority to provide an enhanced landscape buffer between the subject site and the Central Corridor LRT line to serve as an appropriate transition, per section 527.260 of the zoning code. 

  5. The applicant shall make consideration for the salvage and reuse of existing building elements per Section 527.260 of the zoning code.   

  6. Outlot A shall remain free of development to allow for the extension of 27th Ave SE through the site.

C. Variance: Application by Fountain Residential for a variance to increase the maximum impervious surface in the R6 district from 85 percent to approximately 93 percent for Lot 1, Block 1 and from 85 percent to approximately 95.8 percent for Lot 1, Block 2 of the development for the property located at 2635 4th St SE, in the I1, Light Industrial district and the ILOD, Industrial Living, UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The City Planning Commission adopted the findings and approved the variance to increase the maximum lot coverage in the R6 district from 70 percent to 93 percent for the property at 2635 4th St SE.

D. Variance: Application by Fountain Residential for a variance to increase the maximum lot coverage in the R6 district from 70 percent to approximately 91.6 percent for Lot 1, Block 1 and from 70 percent to approximately 93.5 percent for Lot 1, Block 2 of the development for the property located at 2635 4th St SE, in the I1, Light Industrial district and the ILOD, Industrial Living, UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The City Planning Commission adopted the findings and approved the variance to increase the maximum impervious surface requirement in the R6 district from 85 percent to 98 percent for the property at 2635 4th St SE.

E. Site Plan Review: Application by Fountain Residential for a site plan review for the property located at 2635 4th St SE, in the I1, Light Industrial district and the ILOD, Industrial Living, UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The City Planning Commission adopted the findings and approved the application for site plan review for the property located at 2635 4th St SE, subject to the following conditions:

  1. Community Planning and Economic Development Department – Planning Division staff review and approval of the final elevations, floor, site, lighting and landscape plans.

  2. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by October 29, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  3. Blank walls in excess of 25 feet on the west elevation of Building A shall be modified to include a material change, windows, entries, recesses, projections or other architectural elements in compliance with Section 530.120 of the zoning code.   

  4. Cement board (Hardi) panels shall not exceed more than 30% coverage on any single exterior elevation of the proposed building.

  5. Shelving, mechanical equipment or other similar fixtures shall not block views into and out of the building in the area between four (4) and seven (7) feet above the adjacent grade, in compliance with Section 530.120 of the zoning code.

  6. All metal louvers throughout the development shall be replaced with decorative metal panels to serve as an alternative to the minimum window requirement, per Section 530.120 and Section 530.80 of the zoning code. 

  7. Green screens shall be provided in the two blank first floor sections that align with the upper level windows on the north elevation of Building A to serve as an alternative to the minimum window requirement, per Section 530.120 and Section 530.80 of the zoning code. 

  8. Green screens shall be provided in the blank sections that align with the upper level windows on the west end of the south elevation of Building C to serve as an alternative to the minimum window requirement, per Section 530.120 and Section 530.80 of the zoning code. 

  9. Each building shall have its own distinct color palette to provide visual relief on this large site. 

  10. An additional plant material shall be provided front of the transformers in the west side yard of Lot 1, Block 1 and the east side yard of Lot 1, Block 2 to provide year-round screening, per Section 535.70 of the zoning code. 

  11. A minimum of 10 additional shrubs shall be planted within the west side yard of Lot 1, Block 1 as an alternative to the minimum tree requirement, per Section 530.160 and Section 530.80 of the zoning code.   

  12. The wood mulch proposed in the west side yard of Lot 1, Block 1 and the east side yard of Lot 1, Block 2 shall be replaced with sod or turf grass, per Section 530.180 of the zoning code.

F. Plat: Application by Fountain Residential for a plat for the property located at 2635 4th St SE, in the I1, Light Industrial district and the ILOD, Industrial Living, UA, University Area and PO, Pedestrian Oriented overlay districts.

Action: The City Planning Commission adopted the findings and approved the preliminary plat for the property located at 2635 4th St SE, subject to the following condition:

  1. The plat shall include a deed restriction as required by section 598.260 of the subdivision ordinance. Said deed restriction shall address the future extension of 27th Avenue SE through the site.

7. Auto Repair Roof Sign (BZZ-5733, Ward: 1), 331 Ulysses St NE (Brad Ellis).

A. Nonconforming Use: Application by Eric Galatz, on behalf of Metro Star LLC, for a certificate of nonconforming use for a roof sign for the property located at 331 Ulysses St NE in the I1 Light Industrial District.

Action: The City Planning Commission adopted the findings and denied the certificate of nonconforming use to reestablish two nonconforming roof signs on one structure located at 331 Ulysses St NE in the I1 Light Industrial District and the UA University Area Overlay District.

B. Conditional Use Permit: Application by Eric Galatz, on behalf of Metro Star LLC, to amend the existing conditional use permit for major automobile repair to remove a condition relating to the removal of the roof sign for the property located at 331 Ulysses St NE in the I1 Light Industrial District.

Action: The City Planning Commission adopted the findings and denied the removal of condition 3, removal of abandoned roof signs, from the existing conditional use permit for Major Automobile Repair on the property located at 331 Ulysses St NE in the I1 Light Industrial District and the UA University Area Overlay District.

A. Rezoning: Application by M.A. Mortenson Development, Inc., on behalf of Minneapolis Public Schools (MPS), to rezone a portion of the site from the R4 (Multiple-family) District to the R5 (Multiple-family) District in order to unify the underlying zoning on the entire site located at 1310 21st Ave N, 1311 22nd Ave N, 1313 22nd Ave N, 1315 22nd Ave N, 2105 Girard Ave N, 2115 ½ Girard Ave N, 2121 Girard Ave N, 2125 Girard Ave N, 2131 Girard Ave N, 2135 Girard Ave N, 2137 Girard Ave N.

Action: The City Planning Commission recommended that the City Council adopt the findings and deny the rezoning petition to change the zoning classification of the properties located at 1310 21st Ave N, 1311 22nd Ave N, 1313 22nd Ave N, 1315 22nd Ave N, 2115 ½ Girard Ave N, and 2137 Girard Ave N to the R5 (Multiple-family) District.

B. Action: The City Planning Commission recommended that the City Council adopt the findings and deny the rezoning petition to add the Transitional Parking (TP) Overlay District to the properties located at 1310 21st Ave N, 1311 22nd Ave N, 1313 22nd Ave N, 1315 22nd Ave N, 2105 Girard Ave N, 2115 ½ Girard Ave N, 2121 Girard Ave N, 2125 Girard Ave N, 2131 Girard Ave N, 2135 Girard Ave N, and 2137 Girard Ave N in order to construct a new 150 space surface parking lot.
